Eligibility and Allowance. All regular full time employees shall be granted an annual paid vacation period at the end of each fiscal year. The paid vacation period shall be based upon the employment in that fiscal year and shall be prorated for those employees that work less than the full fiscal year. All yearly service requirements shall be based on service during complete fiscal years. More than eleven (11) months employment in the first fiscal year shall count as one (1) full fiscal year of employment. No vacation days may be taken in advance of their accrual.

Annual leave shall be earned by an employee for any month in which the employee is compensated for eighty (80) or more hours of work and the leave shall be prorated to hours worked. A. Employees who are unable to discharge the duties of their position on account of personal illness, shall be granted full pay during such absences to the extent that sick leave credits as described herein will allow. Sick leave may be taken in one hour segments.
B. Employees on a five-day workweek, who are on a paid status for at least *fifteen

B) Employees on a five-day workweek who are on a paid status for at least *fifteen (15) days during the preceding calendar month shall be credited with .9 (9 tenths) of a day per month on the first day of each calendar month for the first year of service.
C) For employees hired prior to July l, 1986, at the completion of one (l) full year of employment, employees on a five-day workweek who were on a paid status for at least *fifteen (15) days during the preceding calendar month shall be credited with 1.3 days per month on the first day of each calendar month.
D) For employees hired on or after July 1, 1986, at the completion of (1) full year of employment, employees on a five-day workweek who were on a paid status for at least *fifteen (15) days during the preceding calendar month shall be credited with 1.1 days per month on the first day of each calendar month.
E) Unused sick leave may be accumulated in an amount not to exceed 300 (three hundred) days for employees on a five-day workweek who were hired prior to October 1, 1989. Employees hired after October 1, 1989, who are on a five-day workweek, may accumulate up to 180 days of sick leave. The unused portion of the sick leave credited to the employees for prior service with the City of Buffalo, the Buffalo Sewer Authority or the Buffalo Board of Education shall be included in such accumulation and the length of such prior service shall become part of the basis for determining the rate of credit under subdivisions (b), (c) and (d).
F) Regular staff holidays occurring during an employee's sick leave with pay shall not be counted as a working day against sick leave. Employees absent on sick leave without pay shall not be compensated for any holidays occurring during such leave.
G) Employees shall be permitted to use their sick leave for necessary care of a member of their immediate family for up to five (5) days (in or out of home). Additional sick time may be used upon presentation of medical documentation that stipulates the need to care for the family member.

Eligibility and Allowance. 9.1.1 Employees shall start to earn annual leave allowance as of the first of the month nearest their date of hire. Employees hired on or before the 15th of the month shall receive credit for the full month. Employees hired after the 15th of the month shall not receive credit for that month. Newly hired probationary employees shall not be eligible to take paid vacation until they have accrued six (6) days of vacation. Employees separating from service on or before the 15th of the month will not receive any credit for that month. Employees separating after the 15th of the month will receive credit for the full month.
9.1.2 Annual leave allowance shall be earned annually based on the following schedule:
9.1.2.1 One (1) working day per month for all employees having less than five (5) years of service.
9.1.2.2 One and one-fourth (1-1/4) days per month for all employees having at least five (5) years of service, but less than ten (10) years of service.
9.1.2.3 One and one-half (1½) days per month for all employees having at least ten (10) years of service, but less than fifteen (15) years of service.
9.1.2.4 One and three-quarter (1-3/4) days per month for all employees having fifteen (15) years of service, but less than twenty (20) years of service.
9.1.2.5 Two (2) days per month for all employees having twenty (20) years of service, but less than twenty-five (25) years of service.
9.1.2.6 Two and one-quarter (2-1/4) days per month for all employees having twenty-five (25) years or more of service.
Eligibility and Allowance. The bargaining unit members will earn vacation hours which will be determined by the length of service according to the following parameters: Vacation benefits are earned based on the completion of one (1) full calendar year of service according to the table below. Vacation hours are prorated at the beginning of the next calendar year, for a first-year employee, based on the employee’s hire date. In the case of a new employee, the employee will be credited with 6.6 hours of vacation leave per completed month of service prior to the commencement of the first full calendar year of service with the City. Vacation leave accrued during this period may be taken, upon completion of the probationary period and with the approval of the Director of Public Works, Supervisor and/or their designee during the first full calendar year (commencing January 1), of service with the City. As an example, an employee who is employed by the City in the middle of September would be credited with 19.8 hours of vacation (6.6 hours for each of the months of October, November and December). This vacation, however, could not be taken until the employee has successfully completed the probationary period. Thereafter, all vacation time would be earned and taken on a calendar basis. Number of Completed Earned Vacation Calendar Years of Service Leave Vacation time shall not accrue beyond the number of days credited in a one (1) year period. An extension of accrued vacation days used in the next calendar year is strongly discouraged; however should the need arise, requests for an extension must be submitted no later than November 15th of each year to the Department Director and approved by the City Manager. Earned vacation not used and not approved for an extension shall be forfeited. Earned vacation benefits shall not be converted to cash compensation, except upon separation or retirement from the City.
