Emergency Layoffs Clause Samples

The Emergency Layoffs clause allows an employer to terminate employees or reduce the workforce quickly in response to unforeseen or urgent circumstances, such as natural disasters, government orders, or other emergencies. Typically, this clause outlines the specific conditions under which emergency layoffs can be enacted and may detail the notice requirements, severance provisions, or exceptions to standard layoff procedures. Its core practical function is to provide flexibility for employers to respond rapidly to crises while clarifying the process and expectations for both parties during such events.
Emergency Layoffs i. During inclement weather, when construction work must be closed down and there is no immediately available alternative work, the City shall have the right to lay off employees from a position class other than Labourer without regard to seniority for a period not exceeding five (5) days. Such employees shall have the option of working as labourers. ii. Layoff of labourers under this Section shall be on the basis of City Seniority. iii. Employees assigned to operate equipment from a central pool shall revert to and be re-assigned within the pool.
Emergency Layoffs. In the event of an emergency, due to acts or occurrences not initiated or controlled by the Board, the employees affected may be laid off without regard to seniority for a period not to exceed one (1) week. Emergency lay-offs, which exceed the one (1) week period, will be regulated by seniority application.‌
Emergency Layoffs. In the event the Company finds it necessary to declare an emergency layoff the Company has the right to displace the least senior employees in the classification with the surplus employees without regard to shift and job assignment preference.
