Expansion of the Premises. That certain space located on the first ------------------------- (1st), mezzanine and third (3rd) floors of the Building consisting of 15,840 rentable square feet, known as Suites 101 (2,651 rentable square feet), 102 (1,014 rentable square feet), M-100 (3,585 rentable square feet) and 310 (8,590 rentable square feet), as outlined on the floor plan attached hereto as Exhibits. "A-1" through "A-3" and made a part hereof, is referred to herein as the "Expansion Space." Tenant shall lease portions of the Expansion Space in phases, effective as of the date ("Expansion Commencement Date") that is the date Landlord tenders possession of the applicable portion of the Expansion Space to Tenant. Accordingly, effective upon the Expansion Commencement Date for a particular portion of the Expansion Space, the Existing Premises shall be increased to include such portion of the Expansion Space. The addition of the entire Expansion Space to the Existing Premises shall, effective as of the last Expansion Commencement Date, increase the number of rentable square feet leased by Tenant in the Building to a total of 32,391 rentable square feet. The Expansion Commencement Date is anticipated to be July 1, 2000 as to Suite 101, August 1, 2000 as to Suites M-100 and 102, and November 1, 2000 as to Suite 310; however, Landlord will not be in default under the Lease if the applicable Expansion Commencement Date does not occur by such dates. In the event that Landlord has not delivered the applicable portion of the Expansion Space to Tenant on or before the "Outside Date," which shall be one hundred eighty (180) days after the anticipated date of delivery of such portion of the Expansion Space, then the sole remedy of Tenant shall be the right to deliver a notice to Landlord (the "Outside Date Termination Notice") electing to terminate this Amendment as to that portion of the Expansion Space only (and monthly Base Rent and Lessee's Percentage Share shall be adjusted accordingly and the Stated Amount of the Letter of Credit shall be decreased by an amount equal to $61.75 multiplied by the number of rentable square feet terminated by Tenant), effective upon receipt of the Outside Date Termination Notice by Landlord (the "Effective Date"). Except as provided hereinbelow, the Outside Date Termination Notice may be delivered by Tenant to Landlord, if at all, during the period from the Outside Date through the date of delivery of the applicable portion of the
Expansion of the Premises. (a) Tenant desires to expand the Existing Premises to include an additional approximately 16,339 rentable square feet commonly known as Suite 140 located in the first (1st) floor of the Building, all as further shown on Exhibit A attached hereto and incorporated herein by reference (the “Expansion Premises”). For avoidance of ambiguity, Section 1.2 of the Existing Lease shall also apply to the measurement of the Expansion Premises. Effective as of the Expansion Premises Rent Commencement Date (as defined in Section 2(b) below), the Existing Premises shall be expanded by adding the Expansion Premises and the term “Premises” under the Lease shall be redefined to be that area shown on Exhibit A as the Existing Premises plus the Expansion Premises, totaling approximately 33,635 rentable square feet of space (the “Revised Premises”). (b) The Expansion Premises shall be added to the Lease on the “Expansion Premises Rent Commencement Date” which shall be defined as the earlier of: (i) delivery of the certificate of occupancy for the Expansion Premises; or (ii) July 1, 2020. Notwithstanding the foregoing, Landlord shall allow limited beneficial occupancy of up to ten (10) Tenant employees in that area of the Expansion Premises as shown on Exhibit D (“Limited Occupancy Space”). Tenant shall ensure that such limited beneficial occupancy falls under an existing certificate of occupancy and complies with any and all occupancy laws and applicable regulations.
Expansion of the Premises. That certain space located on the ground floor of the Building consisting of approximately 579 rentable square feet, as outlined on the floor plan attached hereto as Exhibit A and made a part hereof, is referred to herein as the "Expansion Space." Tenant shall lease the Expansion Space effective as of March 1, 2004 (the "Expansion Commencement Date"). Accordingly, effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Space. Such addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement Date, increase the number of rentable square feet leased by Tenant in the Building to a total of 43,956 rentable square feet, subject to verification pursuant to Section 3 below. Effective as of the Expansion Commencement Date, all references in the Lease to the "Premises" shall mean and refer to the Existing Premises as expanded by the Expansion Space. The period from the Expansion Commencement Date through the Expiration Date is referred to herein as the "Expansion Term".
Expansion of the Premises. The parties acknowledge and agree that the Premises shall be enlarged by the addition of the Expansion Area upon delivery thereof as of the Expansion Commencement Date by Landlord to Tenant, broom-clean (other than existing FFE of the current occupant pursuant to separate agreement between Tenant and the current occupant) and free of claims of other occupants, but otherwise in its current condition, “As Is” and “Where Is,” with no representations or warranty by the Landlord as to the condition thereof or suitability thereof for Tenant’s intended use. Tenant covenants that it shall perform Tenant’s Work in the Expansion Area (as more fully set forth in Paragraph 3 of this Second Amendment) and shall commence payment of Rent thereon on the Expansion Commencement Date. From and after the Expansion Commencement Date, the Premises shall contain 29,562 rentable square feet for all purposes including the calculation of Tenant’s Percentage Share of Excess Operating Expenses and Taxes, and any reference in the Lease to Premises shall thereupon and thereafter include and refer to the Expansion Area, PROVIDED, HOWEVER, that Annual Fixed Rent on the Expansion Area shall be as set forth in Paragraph 5 of this Second Amendment. Landlord agrees to provide an allowance to Tenant for the performance of Tenant’s Work as more fully set forth in Paragraph 4 hereof.
Expansion of the Premises. That certain space consisting of the entirety of the first (1st) floor of the Building and consisting of approximately 31,628 rentable square feet is referred to herein as the “Expansion Space.” The Expansion Space includes a vivarium consisting of approximately 4,052 rentable square feet (the “Vivarium”), which space will be delivered to Sublessee in advance of the Expansion Commencement Date, as more fully set forth in Section 3 below. The Expansion Space, exclusive of the Vivarium, contains approximately 27,576 rentable square feet, and such portion of the Expansion Space may be referred to herein as the “Remainder Space.” Sublessee shall sublease the Remainder Space effective as of the date (“Expansion Commencement Date”) that is the earlier of (a) the date Sublessee commences business operations in the Remainder Space, or (b) January 1, 2019. Accordingly, effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Space. Such addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement Date, increase the number of rentable square feet subleased by Sublessee to include the entire Master Premises leased by Sublessor pursuant to the Master Lease. Except as provided in Section 3 below as to the Vivarium, Sublessor will not be in default under this Amendment if the Expansion Commencement Date is delayed for any reason. Effective as of the Expansion Commencement Date, all references to the “Premises” shall mean and refer to the Existing Premises as expanded by the Expansion Space.
Expansion of the Premises. As of the Effective Date, Exhibit A to the First Amendment is hereby deleted in its entirety and replaced with Exhibit A attached hereto, and Section 2(a) of the First Amendment is hereby deleted in its entirety and replaced with the following: (a) Tenant desires to expand the Existing Premises to include an additional approximately 16,532 rentable square feet commonly known as Suite 140 along with an adjoining mailroom located on the first (1st) floor of the Building, all as further shown on Exhibit A attached hereto and incorporated herein by reference (the “Expansion Premises”). For avoidance of ambiguity, Section 1.2 of the Existing Lease shall also apply to the measurement of the Expansion Premises. Effective as of the Expansion Premises Rent Commencement Date (as defined in Section 2(b) of the First Amendment), the Existing Premises shall be expanded by adding the Expansion Premises and the term “Premises” under the Lease shall be redefined to be approximately 33,828 rentable square feet of space (the “Revised Premises”).
Expansion of the Premises. On the Expansion Premises Commencement Date (defined below), the Premises shall be expanded to contain an additional 18,421 rentable square feet (the "Expansion Premises") shown on Exhibit A hereto, such that the Premises shall contain a total of 33,594 rentable square feet.
Expansion of the Premises. Effective as of October 1, 2013 (the “Expansion Commencement Date”), the Original Premises shall be expanded to include the Additional Premises, as shown on Exhibit A and incorporated herein by this reference. Therefore, the Lease is hereby amended such that, from and after the Expansion Commencement Date, all references in the Lease to the “Premises” shall mean and refer to the entirety of the space in the Original Premises and the Additional Premises, which is approximately nine thousand two hundred thirty (9,230) rentable square feet of rentable area (the entirety of such space is referred to herein as the “Expanded Premises”). Notwithstanding anything to the contrary contained herein, Landlord shall not be obligated to deliver possession of the Additional Premises to Tenant until Tenant has provided to Landlord evidence of liability and property insurance coverage covering the Additional Premises pursuant to Section 9.1 of the Lease, the advance rent pursuant to Section 6 of this First Amendment and the increased Security Deposit pursuant to Section 9 of this First Amendment.
Expansion of the Premises. Section 4 of the Basic Lease Information (the “BLI”) of the Lease is hereby amended to provide that, effective as of the Suite 1300 Expansion Premises Commencement Date (as defined below), the Existing Premises shall be expanded by approximately 9,333 rentable square feet of space located in Suite 1300 of the Building (the “Expansion Premises”), such that the entire Premises Rentable Area (i.e., the Existing Premises and Expansion Premises, but excluding the Suite 110 Premises being surrendered, as set forth below) shall be increased to equal a total of 125,286 rentable square feet. Landlord herby confirms that the square footage calculations for the Existing Premises and the Expansion were made in accordance with the BOMA method. Effective as of the Suite 1300 Expansion Premises Commencement Date, the Premises shall include the Expansion Premises as shown on Exhibit B attached hereto.
Expansion of the Premises. Tenant desires to expand the Existing Premises to include an additional eight thousand two hundred sixty-four (8,264) rentable square feet commonly known as Suite 200 located in the Building, as shown on Exhibit A attached hereto and incorporated herein by reference (the “Expansion Premises”). Effective as of the Expansion Premises Rent Commencement Date (as defined in Section 4 of this Expansion Premises Amendment), the Existing Premises shall be expanded by adding the Expansion Premises and the term “Premises” under the Lease shall be redefined to be the Existing Premises plus the Expansion Premises, totaling approximately 45,095 rentable square feet of space (the “Revised Premises”).
