Final Designs. The Design Consultant hereby assigns irrevocably to the City any and all rights to works designed or created and in any way related to the Services to be provided by Design Consultant under this Agreement, which works are developed to the Final Design stage as described in Exhibit A. This assignment of rights applies whether any one or more of the Final Designs are implemented by the City or not. The City hereby licenses back to the Design Consultant the non-exclusive right to make and use two-dimensional images or representations of the Final Designs or any aspects of the Project that are fabricated and installed. However, any such reproduction must credit the City of Fort ▇▇▇▇▇▇▇ Art in Public Places program and contain a copyright notice. With the exception of publicity pieces, the Design Consultant must not knowingly permit others to make reproductions of the Final Designs or the completed Project for commercial purposes without the written permission of the City.
Final Designs. (a) Unless otherwise stated in Schedule 5 [D&C Performance Requirements], Final Designs, including Design Data from all Design disciplines, for each Work Package shall be submitted to the City in accordance with Schedule 2 [Submittal Review Procedure] and each Final Design shall, at a minimum: (i) include Design Certificates and all pertinent Design Data, including Design Drawings and copies of all Project Approvals and Design reports, and inspection and testing requirements sufficient to demonstrate conformance with the Project Requirements, along with such other supporting Design Data as requested by the City, acting reasonably; (ii) include all information as listed in Appendix 4B [Project Specific Submission Requirements] of this Schedule, to the extent applicable to the Work Package; (iii) include all applicable Design Data, signed and stamped in accordance with Applicable Law, and the policies and requirements of applicable Governmental Authorities and regulatory agencies, including APEGA, ASET, AAA, and AALA; (iv) be comprised of designs that are Integrated appropriately, without conflicts, and presented in a consistent format; (v) include Design Drawings that are complete, searchable, legible, scalable, accurate and provided in the formats and quantities described in Section 2.2.2(d) [Drawing Submissions] of Appendix 4C [Project Drawing Standards] of this Schedule. Any revisions to previously submitted Design Drawings shall also be complete, legible, scalable, accurate and provided in the formats and quantities described in Section 2.2.2(e) [Drawing Submissions] of Appendix 4C [Project Drawing Standards] of this Schedule; (vi) include all pertinent data from the system and safety assurance activities, the pertinent information recorded pursuant to the Requirements Management protocol and an Integration Register extract, for the applicable Final Design that demonstrates that the Final Design conforms to the Project Requirements and is Integrated with the other project disciplines; (vii) include all applicable Road Safety Audit Certificates, in the form attached hereto as Appendix 4A [Certificate Forms] of this Schedule, signed and stamped by the Independent Road Safety Auditor and the Designer; (viii) include all models, mock-ups and studies applicable to the relevant Final Design or otherwise required to demonstrate compliance with the applicable Project Requirements; (ix) include all plans and procedures applicable to implementation of the relevan...
Final Designs. Under this component, the Project will finance hiring of consulting services to develop detailed engineering designs and specifications for the proposed rehabilitation of the 14 km Caracol Road segment and structures extending between Georgeville and Junction K. Said undertaking includes performing the required technical surveys and studies, as well as consideration of available preliminary design recommendations.
Final Designs. This task includes items associated with completing the final water main relocation designs. The following items are included: • Complete water main relocation designs • Review designs with City personnel • Prepare designs and details in MDT format • Prepare MDT quantity schedule for water main items • Prepare technical specifications based on City of Missoula standards and Montana Public Works Standard Specifications. Technical specification will be prepared in MDT format to be included with the ▇▇▇▇▇▇▇ Street Improvement Project. • Coordinate with the design team for MDT ▇▇▇▇▇▇▇ Street – Idaho to Dakota Project to ensure accuracy of both existing and proposed conditions base maps • Conduct an internal review of the plans, specifications, and design report. A senior engineer other than the project manager will be assigned to conduct the review.

Related to Final Designs

  • Final Design Provide OWNER with proposed final construction drawings and detailed opinions of probable total Project construction costs in writing for OWNER' s review, prior to completion of the final Contract Documents, so that any changes that may be necessary in accordance with Project' s budgetary schedule can be made prior to bid.

  • Commencement of Final Design This contract does not obligate the State to proceed with final design for any alternative. On completion of environmental documentation, the State will consider all reasonable alternatives in a fair and objective manner. Notwithstanding anything contained elsewhere in the contract or in any work authorization, the Engineer may not proceed with final design until after all relevant environmental decision documents have been issued.

  • Final Design Phase A. After acceptance by Owner of the Preliminary Design Phase documents, revised opinion of probable Construction Cost as determined in the Preliminary Design Phase, and/or any other Right of Way plan documents, subject to any Owner-directed modifications or changes in the scope, extent, character, or design requirements of or for the Project, and upon written authorization from Owner, Engineer shall: 1. Prepare final Drawings and Specifications indicating the scope, extent, and character of the Work to be performed and furnished by Contractor. 2. Visit the Site as needed to assist in preparing the final Drawings and Specifications. 3. Provide technical criteria, written descriptions, and design data for Owner’s use in filing applications for permits from or approvals of governmental authorities having jurisdiction to review or approve the final design; assist Owner in consultations with such authorities; and revise the Drawings and Specifications in response to directives from such authorities, as appropriate. 4. Advise Owner of any recommended adjustments to the opinion of probable Construction Cost. 5. After consultation with Owner, include in the Construction Contract Documents any specific protocols for the transmittal of Project-related correspondence, documents, text, data, drawings, information, and graphics, in electronic media or digital format, either directly, or through access to a secure Project website. Any such protocols shall be applicable to transmittals between and among Owner, Engineer, and Contractor during the Construction Phase and Post- Construction Phase, and unless agreed otherwise shall supersede any conflicting protocols previously established for transmittals between Owner and Engineer. 6. Assist Owner in assembling known reports and drawings of Site conditions, and in identifying the technical data contained in such reports and drawings upon which bidders or other prospective contractors may rely. 7. In addition to preparing the final Drawings and Specifications, assemble drafts of other Construction Contract Documents based on specific instructions and contract forms, text, or content received from Owner. 8. Prepare or assemble draft bidding-related documents (or requests for proposals or other construction procurement documents), based on the specific bidding or procurement-related instructions and forms, text, or content received from Owner. 9. Contract shall include contractor provided changeable message signs to communication construction information. 10. Furnish for review by Owner, its legal counsel, and other advisors, 6 copies of the final drawings and Specifications, assembled drafts of other construction Contract Documents, the draft bidding-related documents (or requests for proposals or other construction procurement documents), and any other final design Phase deliverables, by the established due date, with the Final Design Phase, and review them with Owner. Owner shall submit to Engineer any comments regarding the furnished items, and any instructions for revisions. B. Engineer’s services under the Final Design Phase will be considered complete on the date when Engineer has delivered to Owner the final Drawings and Specifications, other assembled Construction Contract Documents, bidding-related documents (or requests for proposals or other construction procurement documents), and any other Final Design Phase deliverables. C. In the event that the Work designed or specified by Engineer is to be performed or furnished under more than one prime contract, or if Engineer’s services are to be separately sequenced with the work of one or more prime Contractors (such as in the case of fast- tracking), Owner and Engineer shall, prior to commencement of the Final Design Phase, develop a schedule for performance of Engineer’s services during the Final Design, Bidding or Negotiating, Construction, and Post-Construction Phases in order to sequence and coordinate properly such services as are applicable to the work under such separate prime contracts.

  • Filing of Materials All records related to a grievance shall be filed separately from the personnel files of the employees.
