GPS TECHNOLOGY. The SkyAngelGPS device uses GPS technology to provide location information to the Center. The availability and accuracy of this location information depends on a number of factors that are also outside our control and that of our subcontractors. GPS TECHNOLOGY. If the City installs and uses global positioning system (GPS) technology on City vehicles to enhance employee safety, assure all vehicles are properly maintained, increase personnel safety, locate disabled or stolen vehicles, and to conduct historical review of employee locations that can provide accuracy and transparency during complaint investigations; the City agrees to meet and confer with ACEA to develop a GPS technology policy no later than 60 days after purchase of such GPS Technology. Components of the policy will include: 1. That all City vehicles will be marked with signage indicating that GPS devices may be in use. 2. That City vehicles equipped with GPS devices may not be monitored in real time when the sole purpose of such monitoring is to discipline employees. 3. A list of classifications that can monitor vehicles equipped with GPS data in real time. An outline of the process by which historical data may be accessed including: the purpose for access, those that may access the system and those with whom the data may be shared.
GPS TECHNOLOGY. To improve deployment and supervision of personnel, to decrease incident/ service response times, to protect its property and increase employee safety, the City intends to install GPS or other similar technology on its equipment and vehicles. The City offers to bargain about the impacts, if any, resulting from its decision to implement such technology. The City shall also provide the Union with written notice thirty (30) calendar days prior to such installation. In its written notice to the Union, the City shall identify the types of equipment and types of vehicles within which it intends to install GPS technology.

Our repair and replacement service procedures and policies are set forth on Exhibit A, attached hereto and incorporated by reference herein. 4.5 REPAIR OR REPLACEMENT OF THE SKYHELP DEVICE IS OUR ONLY DUTY UNDER THIS LIMITED WARRANTY. WE MAKE NO OTHER EXPRESS WARRANTY INCLUDING ANY WARRANTY OF MERCHANTABILITY OF THE SKYHELP DEVICE OR ITS FITNESS FOR ANY SPECIAL PURPOSE. WE CANNOT NOT WARRANT THAT THE SKYHELP DEVICE OR SERVICES WILL ALWAYS OPERATE. THIS WARRANTY DOES NOT COVER REPAIRS THAT ARE NEEDED BECAUSE OF AN ACCIDENT, DAMAGE, ACTS OF NATURE, YOUR FAILURE TO PROPERLY USE THE SKYHELP DEVICE, OR IF SOMEONE OTHER THAN US ATTEMPTS TO REPAIR OR CHANGE THE SKYHELP DEVICE, OR ANY OTHER REASON EXCEPT A DEFECT IN THE EQUIPMENT. WE MAKE NO REPRESENTATION OR WARRANTY AS TO THE PROMPTNESS OF OUR RESPONSE, AND WE HAVE NO CONTROL OVER THE RESPONSE TIME OR CAPABILITY OF ANY AGENCY OR PERSON WHO MAY BE NOTIFIED OF AN EMERGENCY. ALL IMPLIED WARRANTIES ARE LIMITED IN DURATION TO THE TERM OF THIS EXPRESSED LIMITED WARRANTY. WE ARE NOT LIABLE FOR CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGES. YOU AGREE THAT THIS IS OUR ONLY WARRANTY AND WE HAVE GIVEN YOU NO OTHER WARRANTY FOR THE SKYHELP DEVICE. 4.6 STATE LAW: SOME STATES DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR A LIMITATION ON THE DURATION OF IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THE WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH MAY VARY FROM STATE TO STATE.

GPS TECHNOLOGY. The employer shall have the authority, without further consultation with the Union, to adopt, install, use, or otherwise take advantage of any technology (such as, but not limited to, GPS and vehicle monitoring units) that shall allow it to monitor the performance of its employees and the operation of its equipment. All discipline would follow the guidelines and conditions listed here within and shall be subject to the grievance procedures listed here within.
