Granting of Days. The initial grant of sick leave days from the Bank shall not exceed forty (40) days, after which the professional employee may reapply for no more than an additional twenty (20) days. Requests for Sick Leave Bank days shall be submitted, in writing, to the Sick Leave Bank Committee, and shall include a written statement from the professional employee's physician indicating the nature and the extent of the illness or injury and the estimated time that the professional employee will be absent from work.

Granting of Days. A member of the Bank may be granted days from the Bank under the following conditions: 1. The teacher’s Accumulated Sick Leave and Personal Leave days must be exhausted and the teacher must have been out of school for a period of five (5) consecutive attendance days without salary of any kind. Upon approval, salary shall return starting with the sixth day. 2. Written application by a Bank member or his/her family, accompanied by a physician’s certificate verifying the nature, length of disability and prognosis of the Bank member’s condition must be submitted to the EVSC Office of Human Resources. Application shall be made within thirty (30) school days prior to the expiration of all leave. The committee may waive the 30 day period in emergency situations. 3. Up to one hundred eighty (180) days may be taken over a two (2) year period. This period starts the first day the teacher receives Sick Leave Bank benefits. At the end of this two (2) year benefit timeline, or at the end of the one hundred eighty (180) day maximum leave, whichever comes first, a moratorium of one (1) year exists on access to Bank benefits. Following the one (1) year moratorium, members will be eligible for another one hundred eighty (180) days. The committee may require re-certification for continuation of benefits (up to 180 days) as needed. The Board will administer the Bank. A Bank Committee to approve or deny the requests for benefits will be established. The committee will be composed of three (3) representatives appointed by the Board and three (3) representatives appointed by the Association. Applications will be acted upon by a majority of the Bank Committee. All decisions of the Bank Committee are final. In the event a majority of the committee cannot reach a decision, the decision will be submitted to a mutually agreed upon third party to render a final decision. If Bank benefits are granted to the applicant, but the decision is not made by the end of the five (5) day exclusionary period, benefits will be retroactive to the sixth day. If no decision is made within twenty (20) days of the loss of salary and benefits, the applicant will receive Bank benefits until a decision is rendered. Requests for Sick Leave Bank days shall be submitted, in writing on the form set forth in Appendix D, to the Sick Leave Bank Committee, and shall include a written statement from the professional employee's physician indicating the nature and the extent of the illness or injury and the estimated time that the professional employee will be absent from work. Subject to the foregoing requirements, a majority of the Sick Leave Bank Committee will determine the eligibility for the use of the Bank and the amount of leave to be granted. In administering the Bank and determining the amount of leave, the following general criteria shall be applied by the Committee: a. medical evidence of serious extended illness; b. prior utilization of eligible sick leave; c. other factors as a majority of the Sick Leave Bank Committee may deem appropriate. No days may be withdrawn from the Bank for any illness other than prolonged illness or accident. Days may not be withdrawn to permit an individual to stay at home or care for other members of the family. The decision of the Sick Leave Bank Committee with respect to eligibility and entitlement shall be final and binding with any appeal limited to an appeal to the Sick Leave Bank Committee itself.

Granting of Days. The initial grant of sick leave days from the Bank to a firefighter shall not exceed twenty (20) days, after which the employee may reapply for additional periods of twenty (20) days. The total amount of time may not exceed eighty (80) days in the aggregate, unless the Committee determines otherwise. Requests for Sick Leave Bank Days shall be submitted in writing to the Sick Leave Bank Committee through the Fire Chiefs Office and shall include a written statement from the employee's physician indicating the nature and the extent of the illness or injury and the estimated time that the employee will be absent from work. The Sick Leave Bank Committee will determine whether or not granting of days is appropriate after considering all relevant information. The decisions of the Sick Leave Bank Committee shall be final and not subject to the grievance procedure.

The individual’s accumulated sick leave must be exhausted and the individual must have been out of school for a period of five (5) consecutive school days without any sick leave benefits. Medical certification of disability must be given when requested; 3. The initial benefits will include only three (3) of the five (5) days of the waiting period unless the teacher is approved for Workers’ Compensation benefits, in which case initial benefits begin on day one. 4. After the approval of the Sick Leave Bank Committee, the benefits will continue at the rate of one (1) day of benefits for each day of school missed. After thirty (30) days have been withdrawn, the committee will again meet to re- approve the request for benefits at which time a physician’s certification of disability must be presented every thirty

Granting of Days. The term “day” is defined as a full contractual workday. Days may be granted from the bank only after the member requesting leave bank days has used all his/her current and accumulated sick leave. 1. The first two (2) days of leave after the member has exhausted his/her own sick leave will not be covered by the bank. 2. At the member’s request, the two (2) deduct days at per diem may be spread over two (2) pay periods. 3. Upon acceptance by the LTD carrier, the two (2) deduct days will be reimbursed to the member. 4. When a member becomes eligible to receive benefits from the district approved LTD program; the member will no longer be eligible to receive sick leave days from the bank. (Eligibility for LTD begins sixty (60) calendar days from date of disability resulting from illness or injury that renders the member incapable of working.) 5. Days from the Sick Leave Bank will not be granted for the following: a. Non-contracted days for the member requesting days. b. Days beyond the school year in which the request for days is received (this provision may be waived by action of the Sick Leave Bank Board.) c. Days in which any compensation is available to the member from any other benefit plan. 6. Coincident with approval of days by the Sick Leave Bank Board, the approved number of days will be deducted from the bank. 7. All days granted from the bank, but not used by the member, will be restored to the bank. 8. The Board will consider requests for less than full days of disability when the following three (3) conditions are met: a. The partial days follow a period of full days of total disability verified by a physician’s statement; and b. The member is engaged in a rehabilitation/recovery program directed by a licensed physician; and c. The member’s supervisor and/or building principal approves a partial return to work. 9. Any and all information furnished to the SLBB will be kept confidential. To ensure confidentiality, each year the members of the Sick Leave Bank Board will sign confidentiality agreements. Any information provided will be used by the SLBB to determine eligibility for sick leave bank benefits and will be aggregated for distribution in an annual summary of sick leave bank usage to members of the SLB, and reasonable efforts will be made to ensure that the report does not include information that may identify individual applicants. 10.
