Hardware and Warranty. 6.1. The Client will be responsible to use the Unit and the Service in the manner advised by Cartrack and as reflected in Cartrack’s Product brochures. The Client shall not, in any way remove, alter or tamper with the Unit. 6.2. Subject to the Client complying with clause 6.1, the Unit and the installation thereof carries a 12 (twelve) month warranty. Any maintenance and/or repairs must be carried out at an Installation Centre. 6.3. All risk of loss and damage in and to the Unit shall, from the date of installation, pass to the Client, but ownership of the Unit shall remain with Cartrack. If this Agreement is terminated in accordance with clause 3 or clause 9, Cartrack may at its expense remove the Unit and the Client shall, within 5 (five) days of receipt of any written or verbal request, deliver the Vehicle to an Installation Centre for such removal.

The Camera System carries a 2 (two) year warranty and the installation carries a 12 (twelve) month warranty, subject to damage to the Camera System not arising from: 5.1.1.1. an accident in which the vehicle is involved; 5.1.1.2. tampering with the Camera System and/or any ancillary devices, or any work being carried out on the Camera System by a person not authorised in writing by Cartrack to work on the Camera System, or vandalism or malicious damage howsoever caused, or misuse, abuse, or negligent handling of the Camera Systems and/or the Service; Date Initial 5.1.1.3. any damage caused by fire, attempted theft or water; 5.1.1.4. any theft of a Camera System from the vehicle; 5.1.1.5. any damage caused by a faulty electrical supply; 5.1.1.6. any damage caused as a result of the ingress of any fluid penetrating the Camera System; 5.1.1.7. any tampering of the seal covering for the SD card in the Camera System; 5.1.1.8. rodents or insects; 5.1.1.9. any other event out of the direct control of Cartrack.

All risk of loss and damage to the Unit shall, from the date of installation, pass to the Client, but ownership of the Unit shall remain with Cartrack until payment has been made in full and/or, if the Unit is rented, until the end of the Term. If the Unit has not been paid for in full, or the Unit is rented, and this Agreement is terminated in accordance with clause 3 or clause 10, Cartrack may at its expense remove the Unit and the Client shall, within 5 (five) days of receipt of any written or verbal request, deliver the vehicle to an Installation Centre for such removal.

  • Hardware Warranty Company warrants that for a period of one (1) year from delivery of Hardware, Hardware will be free from defects in material and workmanship in normal use, but does not cover any of the following: (i) improper installation, maintenance, adjustment, repair or modification by Customer or a third party; (ii) misuse, neglect, or any other cause other than ordinary use, including without limitation, accidents or acts of God; (iii) improper environment, excessive or inadequate heating or air conditioning, electrical power failures, surges, water damage or other irregularities; (iv) third party software or software drivers; or (v) damage during shipment.

  • Software Warranty We warrant that the Tyler Software will perform without Defects during the term of this Agreement. If the Tyler Software does not perform as warranted, we will use all reasonable efforts, consistent with industry standards, to cure the Defect in accordance with the maintenance and support process set forth in Section C(9), below, the SLA and our then current Support Call Process.

  • Hardware and Software In order to use the Services, you must obtain and maintain, at your expense, compatible mobile hardware and software as specified by Credit Union from time to time. Credit Union is not responsible for any third party software you may need to use the Services. Any such software is accepted by you as is and is subject to the terms and conditions of the software agreement you enter into directly with the third party software provider at time of download and installation.

  • Limited Software Warranty MyECheck represents, warrants, and covenants that: MyECheck warrants to the original end user (“Customer”), and not to subsequent end users, of the Extreme Networks software product (“Software”) that for ninety (90) days from the date of installation of the Software from MyECheck, the Software shall substantially conform with the specification for the Software at the (“Documentation”). MyECheck does not warrant (i) that the Software is error free, (ii) that Customer will be able to operate the Software without problems or interruptions or (iii) that the Software will be free of vulnerability to intrusion or attack. Except for the limited warranty set forth in this section, the Software is provided “AS IS.”

  • Manufacturer’s Warranty The Goods include the manufacturer’s standard limited parts warranty to replace defective parts covered under such warranty exclusive of labor. Labor is warranted by the Elevator Contractor for 90 days following installation. The manufacturer’s parts warranty may require that the Goods be maintained throughout the warranty period by an authorized manufacturer’s representative under a separate maintenance contract. Any warranty is conditioned on written notice to the Elevator Contractor within warranty period and contingent upon receipt of final payment to Elevator Contractor.
