The Hosting Provider clause defines the responsibilities and obligations of the party supplying hosting services for digital content, applications, or websites. Hosting Provider. Customer acknowledges and agrees that the Hosting Services are provided by and made available to the Customer by a hosting provider identified in the Data Processing Addendum (Exhibit A) (the “Hosting Provider”), which is authorized to make modifications and enhancements to the Hosting Services at any time and in its discretion. The term Hosting Provider shall include any and all successors thereto. Customer’s ability to use the Platform is dependent upon the availability and capabilities of the Hosting Services and may be affected or limited by the Hosting Services. CUSTOMER IS AT ALL TIMES IS RESPONSIBLE FOR ADHERING TO THE ENCRYPTION METHODS PROVIDED BY HATHR AND HOSTING PROVIDER WHILE CUSTOMER DATA IS IN TRANSIT TO AND FROM THE HOSTING PROVIDER OR WHEN PROCESSED OR STORED BY HOSTING PROVIDER.
Hosting Provider. Server Hosting for Hosted Platform involves Processor from Microsoft Azure. Microsoft Azure was chosen as hosting provider because Microsoft Azure is ISO 9001, 22301, 20000-1, 27018, 27017 and 27001 certified. Hosted Platform uses one Microsoft Azure data center Controller agrees that Disaster Recovery and Availability are adequately covered by this.
Hosting Provider. CCD is happy to host Client’s website and can discuss hosting plans upon request. The Client may secure a Hosting Provider independently, and is encouraged to do so as a way to help control Client costs. If however, the Client does not wish to do so, or is not an advanced user of the Internet, CCD will be more than happy to secure a Hosting Provider on the Client’s behalf for a nominal fee.
Hosting Provider. The Software will be hosted by an authorized subcontractor (the "Hosting Provider") that has been engaged by Branching Minds and shall only be accessed by Customer on the Websites, using the Customer's computers. As a part of the Services, the Hosting Provider shall be responsible for maintaining a backup of Customer data. The Hosting Provider shall have access to Customer data solely for the purpose of enabling Branching Minds to provide the Services and will not access or use Customer data for any other purposes.

  • Hosting Services NCR Voyix shall furnish facilities, equipment, computer programs and services, as specified from time to time by NCR Voyix, that NCR Voyix deems necessary for operation and maintenance of the System (collectively, the “Hosting Services”).

  • Provider If the Provider is a State Agency, the Provider acknowledges that it is responsible for its own acts and deeds and the acts and deeds of its agents and employees. If the Provider is not a State agency, then the Provider agrees to indemnify and save harmless the State and its officers and employees from all claims and liability due to activities of itself, its agents, or employees, performed under this contract and which are caused by or result from error, omission, or negligent act of the Provider or of any person employed by the Provider. The Provider shall also indemnify and save harmless the State from any and all expense, including, but not limited to, attorney fees which may be incurred by the State in litigation or otherwise resisting said claim or liabilities which may be imposed on the State as a result of such activities by the Provider or its employees. The Provider further agrees to indemnify and save harmless the State from and against all claims, demands, and causes of action of every kind and character brought by any employee of the Provider against the State due to personal injuries and/or death to such employee resulting from any alleged negligent act by either commission or omission on the part of the Provider.

  • THIRD-PARTY CONTENT, SERVICES AND WEBSITES 10.1 The Services may enable You to link to, transfer Your Content or Third Party Content to, or otherwise access, third parties’ websites, platforms, content, products, services, and information (“Third Party Services”). Oracle does not control and is not responsible for Third Party Services. You are solely responsible for complying with the terms of access and use of Third Party Services, and if Oracle accesses or uses any Third Party Services on Your behalf to facilitate performance of the Services, You are solely responsible for ensuring that such access and use, including through passwords, credentials or tokens issued or otherwise made available to You, is authorized by the terms of access and use for such services. If You transfer or cause the transfer of Your Content or Third Party Content from the Services to a Third Party Service or other location, that transfer constitutes a distribution by You and not by Oracle. 10.2 Any Third Party Content we make accessible is provided on an “as-is” and “as available” basis without any warranty of any kind. You acknowledge and agree that we are not responsible for, and have no obligation to control, monitor, or correct, Third Party Content. We disclaim all liabilities arising from or related to Third Party Content. 10.3 You acknowledge that: (i) the nature, type, quality and availability of Third Party Content may change at any time during the Services Period, and (ii) features of the Services that interoperate with Third Party Services such as Facebook™, YouTube™ and Twitter™, etc., depend on the continuing availability of such third parties’ respective application programming interfaces (APIs). We may need to update, change or modify the Services under this Agreement as a result of a change in, or unavailability of, such Third Party Content, Third Party Services or APIs. If any third party ceases to make its Third Party Content or APIs available on reasonable terms for the Services, as determined by us in our sole discretion, we may cease providing access to the affected Third Party Content or Third Party Services without any liability to You. Any changes to Third Party Content, Third Party Services or APIs, including their unavailability, during the Services Period does not affect Your obligations under this Agreement or the applicable order, and You will not be entitled to any refund, credit or other compensation due to any such changes.
