HOURS OF WORK, OVERTIME AND PREMIUMS. 13.01 For the purpose of computing pay only, the work week is from 12 o’clock Midnight on Saturday to 12 o’clock Midnight the following Saturday. (a) Each party to this agreement understands the success of the business is dependent upon satis- fying customer needs for products and services. In order to meet the normal customer require- ments for products and services, the core hours of work will be 7:00 a.m. to 9:00 p.m. each day of the week. In addition, the Company and its employees must be prepared to provide service when necessary on a twenty-four (24) hour basis. (b) Employees will be assigned to work eight (8) consecutive hours, five (5) consecutive days, forty (40) hours per week. These employees will have either a one-half hour or one hour unpaid lunch period as indicated on the posted work schedule. The Company will endeav- our to allocate the meal period four (4) hours after the commencement of the employee’s starting time. However, except in the event of an emergency such employees will have their meal not later than five (5) hours from their scheduled starting time. The parties may agree locally to hours of work other than those set out herein. 13.03 Work schedules indicating the employee’s days and hours of work, lunch periods, and days off, will be determined locally by mutual agreement of manage- ment and the employees in an effort to accommodate the employees’ wishes while still meeting the needs of the customer and the business. However, should an agreement not be reached through mutual agreement within a reasonable timeframe, management reserves the right to create work schedules which meet the needs of the customer and the business, and to the extent possible accommodate the employees’ wishes. Schedules will be posted at least one month in ad- ▇▇▇▇▇. 13.04 Insofar as possible shift work shall be kept to a min- imum; however, it is understood and agreed that em- ployees shall be required to work on a shift basis to complete assigned work which they are qualified to do. 13.05 The Company will provide two (2) fifteen (15) minute coffee breaks during each work day, one (1) in the morning and one (1) in the afternoon. 13.06 A shift premium will be paid for regular, non-over- time hours worked outside the core hours of work, 7:00 a.m. to 9:00 p.m. daily as follows: (a) 9:00 p.m. to 7:00 a.m. - sixty-three ($0.63) cents per hour. (b) Employees who commence their work day at 4:00 p.m. or later will be paid a shift premium of sixty ($0.60) cents per hour for all regularly scheduled hours of work. (c) Employees who commence their workday at 4:00 p.m. or later and work a scheduled shift of eight (8) consecutive hours will be allowed a thirty (30) minute paid meal period during this regular shift, providing such an employee re- mains available during the paid meal period. (d) A premium of two dollars and twenty-five cents ($2.25) per hour will be paid to employees work- ing regularly scheduled hours of work on Sunday in accordance with the posted work schedule. (e) Shift premium will not be included in computing overtime pay, vacation pay, or pay for holidays not worked. 13.07 It is understood and agreed that the Company’s oper- ations must be maintained and that employees are required, by the Company, to respond to reasonable requests to work overtime for this purpose. (a) One and one-half (1½) times the regular hourly rate for hours worked on a statutory holiday or on an employee’s scheduled days off. (b) One and one-half (1½) times an employee’s regular hourly rate for all hours worked in excess of forty (40) hours on a regular scheduled day. (c) For hours worked on call between midnight to 7:00 a.m., for each call out, employees shall be paid one and one-half (1½) times for hours worked or a two (2) hour minimum at their over- time rate whichever is the greater. If a subse- quent call is received within the initial two (2) hour period, there will be no pyramiding. (d) An employee who is required to work overtime and has not had five (5) hours of continuous rest in the eight (8) hour period preceding the indi- vidual’s next regular shift shall be provided time off without loss of regular pay for up to five (5) hours less the employee’s actual rest time. Such time off with pay shall be considered as time worked for the purpose of computing overtime. 13.08 The Company will provide a meal allowance of fif- teen dollars ($15.00) and a paid fifteen (15) minute break to be taken after an employee works two (2) hours beyond their regularly scheduled eight (8) hour shift and provided there is a minimum of one (1) additional call scheduled following the break. A similar allowance and a paid fifteen (15) minute break shall be given for each additional four (4) hours worked thereafter.
