LAWS, NOTICES, PERMITS, AND FEES. 10.1.1 The Owner shall obtain and pay for development approvals, building permit, easements, rights of servitude, and all other necessary approvals and permits, except for the permits and fees referred to in GC 10.1.2 or for which the Agreement specify as the responsibility of the Contractor. 10.1.2 The Contractor shall be responsible for the procurement of permits, licences, inspections, and certificates, which are necessary for the performance of the Work (including dewatering permits/agreements) and customarily obtained by contractors in the jurisdiction of the Site after the issuance of the building permit. The Contract Price includes the cost of these permits, licences, inspections, certificates and agreements, and their procurement. 10.1.3 The Contractor shall, and shall cause all Subcontractors, Suppliers and Sub- subcontractors to give the notices required by, and comply with, the Laws which are or come into force during the performance of the Work and which relate to the Work, to the preservation of health and safety.
LAWS, NOTICES, PERMITS, AND FEES. 10.2.1 The laws of the Place of the Work shall govern the Work. 10.2.2 The Owner shall obtain and pay for the building permit, temporary and permanent easements, and rights of servitude. The Contractor shall be responsible to obtain and pay for all other permits, licenses, or certificates and pay the fees and deposits necessary for the performance of the Work which were in force at the date of the RFP Submission which costs shall form part of the Guaranteed Price. 10.2.3 The Contractor shall give the required notices and comply without delay with the laws, ordinances, rules, regulations, or codes which are or become in force during the performance of the Work and which relate to the Work, to the preservation of the public health, and to construction safety. Whenever standards of the laws, ordinances, rules, regulations, codes and orders relating to the Work differ, the most stringent standards shall govern. 10.2.4 Except as may constitute a Design Issue properly characterized as a Contractor’s Design Contingency matter under GC 4.2.2 and except in respect of those Contract Documents which, under the terms of the Contract, the Contractor is required to prepare or produce, the Contractor shall not be responsible for verifying that the Contract Documents are in compliance with the applicable laws, ordinances, rules, regulations, or codes relating to the Work. If the Contract Documents are at variance therewith, or if, subsequent to the date of the RFP Submission, changes are made to the applicable laws, ordinances, rules, regulations, or codes which require modification to the Contract Documents, the Contractor shall notify the Consultant in writing requesting direction immediately upon such variance or change becoming known. The Consultant will make the changes required to the Contract Documents as provided in GC 6.1 – CHANGES, GC 6.2 – CHANGE ORDER and GC 6.3 – CHANGE DIRECTIVE. 10.2.5 If the Contractor fails to notify the Consultant in writing, fails to obtain direction as required in GC 10.2.4, and performs Work knowing it to be contrary to any laws, ordinances, rules, regulations or codes, the Contractor shall be responsible for and shall correct the violations thereof and shall bear the costs, expenses and damages attributable to the failure to comply with the provisions of such laws, ordinances, rules, regulations, or codes. 10.2.6 The Contractor shall furnish necessary certificates as evidence that the Work installed conforms with laws and regulations...
LAWS, NOTICES, PERMITS, AND FEES. 2.18.1 The laws of the Province of Newfoundland and Labrador shall govern the Work. 2.18.2 The Contractor shall obtain all permits, licenses and certificates and pay all fees required for the performance of the Work which are in force at the date of tender closing with the following exceptions: a) The Contractor shall obtain building permits for the Work but are not required to pay for said permits. b) The Contractor shall not include the obtaining of permanent easements or rights of servitude. 2.18.3 The Contractor shall give all required notices and comply with all laws, ordinances, rules, regulations, codes and order of all authorities having jurisdiction relating to the Work, to the preservation of the public health and construction safety which are or become in force during the performance of the Work. 2.18.4 The Contractor shall not be responsible for verifying that the Contract Documents are in compliance with the applicable laws, ordinances, rules, regulations and codes relating to the Work. If the Contract Documents are a variance therewith or changes which necessitate modifications to the Contract Documents are required by the authorities having jurisdiction subsequent to the date of tender closing, the Contractor shall notify the Engineer/Architect in writing requesting direction immediately when any such variance or change is observed by them. The Engineer/Architect will make the changes required to the Contract Documents, and the Contract Price and/or Contract Time shall be adjusted in accordance with 2.13.0 CHANGES IN THE WORK AND EXTRA WORK and evaluated in accordance with 2.14.0

The Contractor shall post and maintain, for the duration of the Work, a Safety Notice in the form appended to this Section, in a prominent location on the construction site. 40.4 If the Contractor becomes aware that the Contract Documents are at variance or contrary to any laws, ordinances, rules, regulations, codes, and orders of the authorities having jurisdiction, and the Contractor fails to notify the Engineer in writing and obtain his direction immediately, the Contractor shall be responsible for and shall correct the violations thereof and shall bear the cost, expense, and damages attributable to his failure to comply with the provisions of such laws, ordinances, rules, regulations, codes, and orders.

  • PERMITS, FEES AND NOTICES 4.7.1 Unless otherwise provided in the Contract Documents, the Contractor shall secure and pay for all permits and governmental fees, licenses and inspections necessary for the proper execution and completion of the Work which are customarily secured after execution of the Contract and which are legally required at the time the bids are received. Contractor shall comply with the regulations and requirements of any insurance company which issues a policy on any part of the work or site. 4.7.2 The Contractor shall give all notices and comply with all laws, ordinances, rules, regulations and lawful orders of any public authority bearing on the performance of the Work. 4.7.3 It is not the responsibility of the Contractor to make certain that the Contract Documents are in accordance with applicable laws, statutes, building codes and regulations. However, if the Contractor observes that any of the Contract Documents are at variance therewith in any respect, he / she shall promptly notify the Architect in writing, and any necessary changes shall be accomplished by appropriate modification. 4.7.4 If the Contractor performs any Work knowing it to be contrary to such laws, ordinances, rules and regulations, and without such notice to the Architect, he / she shall assume full responsibility therefor and shall bear all costs attributable thereto. 4.7.5 The Contractor agrees to comply with all the requirements of Title 21 V.S.A., Chapter 5, Subchapter 6 relating to fair employment practices and agrees further to include a similar provision in any and all subcontracts.
