Lunch and Rest Periods. 11.01 Each part-time employee who works a shift of more than four (4) hours duration shall be afforded a meal break of not more than one (1) hour between the third and fifth hour of the shift except in the case of an emergency when such lunch period shall be at the discretion of the immediate supervisor of such employees. It shall be understood and agreed that the City shall be the sole judge of what constitutes an emergency. Where possible, employees should be permitted to leave their work location during such period. (a) Each part-time employee shall be afforded rest periods of fifteen (15) minutes during each morning and afternoon at such times and places as may be decided by the Head of the Division, and the rest periods for those employees on shift work shall be during the first four (4) hour and the second four (4) hour periods respectively. (b) Employees who are not able to take their rest periods, due to operational needs, shall at their Division Head’s discretion, have their rest periods rescheduled within the shift. If that is not possible, the employee shall be compensated for the lost rest period at time and a half (1½), or with mutual agreement, the employee shall have the time added to his/her lieu bank. 11.03 When an employee's shift is being changed, a minimum of twelve (12) hours shall be scheduled off as a rest period between the end of the "old" regularly scheduled shift and the commencement of the "new" regularly scheduled shift. If an employee's "new" regularly scheduled shift commences during such rest period, he/she shall be paid at the overtime rate for all hours worked on the first shift.

Lunch and Rest Periods. 11.01 Each part-time employee who works a shift of 9 .1 Employees shall not be required to work more than five (5) hours from the start of their shift without a one-half (½) hour (nor more than one [1] hour) break for lunch . This period shall not begin earlier than three and one-half (3 ½) hours after the start of the shift and shall not begin later than five (5) hours after the start of the shift. If they are required to work past this time and they are denied time to eat, they shall be paid at the applicable overtime rate until such time as they are allowed to eat their lunch . If not allowed to eat lunch, employees will be paid an additional one-half (½) hour of overtime . Employees required to work more than two (2) hours after the end of the regular shift shall be al- lowed to at least one-half (½) hour meal period which shall be considered as time worked, and if it is impractical for the employees to leave the job, they shall be provided a lunch by the Employer . 9 .2 Employee’s lunch period may be staggered during the period of three and one-half (3 ½) to five (5) hours from the start of the shift to cover necessary work of a continuous nature . 9 .3 Employees shall be allowed a rest period of not less than 10 minutes, on the Employer’s time, for each four (4) hours duration of working time . Rest periods shall be afforded a meal break scheduled as near as possible to the midpoint of not the work period . No em- ployee shall be required to work more than one three (13) hour between hours without a rest period . The rest period may be taken at the third and fifth hour work station when reasonable . Where the nature of the shift except in the case of an emergency when such lunch work allows employees to take intermittent rest periods equiva- lent to ten minutes for each 4 hours worked, scheduled rest periods are not required . A rest period shall be at the discretion of the immediate supervisor of such employeesmeans to stop work duties, exertions, or activities for personal rest and rejuvena- tion . It shall be understood and agreed that the City shall will be the sole judge responsibility of what constitutes an emergency. Where possible, employees should be permitted each employee to leave their work location during such period. The lunch rooms shall have adequate seating based upon usage. (d) No employee shall be afforded a meal break of not more than one (1) hour between the third and fifth hour of the shift interrupted from completing his lunch or coffee breaks, except in the case of an emergency when such lunch period shall be at the discretion of the immediate supervisor of such employees. It shall be understood and agreed that the City shall be the sole judge of what constitutes an emergency. Where possible, employees should be permitted to leave their work location during such period. Rest periods shall be scheduled as near as possible to the midpoint of the work period. No employee shall be required to work more than three (3) hours without a rest period. The rest period may be taken at the work station when reasonable. Where the nature of the work allows employees to take intermittent rest periods equivalent to ten minutes for each 4 hours worked, scheduled rest periods are not required. A rest period means to stop work duties, exertions, or activities for personal rest and rejuvenation. It will be the responsibility of each employee to take rest periods. If an employee does not take a rest period, then the employee must notify their supervisor and a rest period will be provided.

Lunch and Rest Periods. 11.01 Each part-time (a) No employee who works a shift of more shall be worked longer than four five (45) hours duration during his regular shift without a minimum half (2) hour off for the purpose of eating a meal. This shall be afforded a meal exclusive of rest breaks which must be given as follows. (b) Each employee shall receive an uninterrupted fifteen (15) minute break in each half (2) of their daily shift. The time for said breaks to be determined by Management. However, such shall not be earlier than one and one-half (12) hours from the commencement of each half of an employee's work shift. Employees who are working away from the Plant may have their breaks one (1) hour from the commencement of each half of the employee's work shift. Notwithstanding, such employees who are Distribution employees shall be required to be in their area of delivery prior to the taking of their first break. Production and Shipping Department employees who are required to work more than one (1) hour between the third and fifth hour of the shift except in the case of an emergency when such lunch period overtime but not more than two (2) hours overtime shall be at the discretion of the immediate supervisor of such employees. It shall be understood and agreed that the City shall be the sole judge of what constitutes an emergency. (ac) Each part-time When it becomes necessary to work overtime of more than two (2) working hours beyond his regular shift, the Employer shall see that each employee so worked shall receive a meal break of thirty (30) minutes, without pay, but shall receive a meal allowance of ten dollars ($10.00). Employees that are working away from the plant who anticipate working more than two (2) hours overtime may decide to forego their meal break and meal allowance and instead receive payment for all hours worked. The employee must call his supervisor and inform him of the decision before completing the shift. (d) When an employee is required by the Employer to work through or part of the regularly established breaks, such employee shall be afforded rest periods paid the applicable overtime rate and be allowed reasonable time off to take a break with no loss of fifteen (15) minutes during each morning pay.
