Common use of MANAGEMENT FUNCTIONS Clause in Contracts

MANAGEMENT FUNCTIONS. The Union recognizes that the Company has the right to manage the business, to exercise all the prerogatives of management and without affecting the generality of the foregoing, it has the right to determine the size of and direct the work force, to extend or curtail operations, and to hire and promote, except to the extent that the said rights and prerogatives have been specifically delegated to the Union or otherwise curtailed in this Agreement. The Company also has the right to discharge, suspend or otherwise discipline employees for just cause.

The Union recognizes that the right of the Company has (subject to the right limitations contained in the provisions of this contract, but otherwise not subject to manage the business, provisions of the arbitration clause) to exercise all the prerogatives functions of management managing the business which involve, among other things, the hiring and without affecting placement of Employees, the generality termination of employment, the assignment of work, the determination of methods and equipment to be used, and the control of the foregoing, it has conduct of the right to determine the size of and direct the work force, to extend or curtail operations, and to hire and promote, except to the extent that the said rights and prerogatives have been specifically delegated to the Union or otherwise curtailed in this Agreement. The Company also has the right to discharge, suspend or otherwise discipline employees for just causework.
