MEDIATION PROGRAM Clause Samples

The Mediation Program clause establishes a process for resolving disputes between parties through mediation before pursuing litigation or arbitration. Typically, this clause requires the parties to engage in good faith discussions with the assistance of a neutral third-party mediator, often within a specified timeframe after a dispute arises. Its core practical function is to encourage amicable settlement of disagreements, thereby reducing the time, cost, and adversarial nature of formal legal proceedings.
