Neutral Reference Clause Samples
A Neutral Reference clause defines how an employer will respond to reference requests about a former employee, typically limiting the information provided to basic facts such as dates of employment and job title. In practice, this means the employer will not disclose details about the employee’s performance, reasons for departure, or any subjective assessments. The core function of this clause is to protect both parties: it shields the former employee from potentially negative or damaging references, while also reducing the employer’s risk of defamation or legal claims related to the content of a reference.
