The Overpayment of Salary clause defines the employer's right to recover any salary payments made to an employee in excess of what is properly owed. Typically, this clause outlines the process for identifying overpayments, notifying the employee, and arranging for repayment, which may include deductions from future wages or agreed-upon repayment schedules. Its core function is to ensure that salary errors can be corrected efficiently, protecting the employer from financial loss while providing a clear procedure for resolution.
Overpayment of Salary. 7.4.1 The District will contact any employee who has been overpaid at the time of termination, or at any other time, to arrange for repayment of the excess salary received.
Overpayment of Salary. Where an employee is overpaid an amount of salary or benefits including allowances, the overpayment will be recovered in accordance with the provisions of ASADA’s Accountable Authority Instructions. These provisions do not operate to limit the right of the Agency to recover a debt from monies that are, or become, payable to an employee under this Agreement.
Overpayment of Salary. In the event of overpayment of salary or allowance to an employee, where the Pay and Conditions Team has not already advised the employee, the employee must notify the Pay and Conditions Team immediately following recognition of an overpayment.
Overpayment of Salary. While employees receive 1/12th of their calculated annual salary every month, not every month includes 1/12th of the annual contracted workdays. For employees terminating during a school year this can result in an overpayment of wages. Our payroll department carefully calculates the pay status of each terminating employee. Any employee who has been overpaid at the time of termination will be contacted to arrange for repayment of the excess salary received.
Overpayment of Salary. In the event of an overpayment of salary, recovery of the overpayment will be made in accordance with the council’s Procedure for the Recovery of Overpaid Salary. In accepting your contract of employment, you are deemed to agree to a recovery of overpaid salary in accordance with the procedure. Where it is clear that an overpayment has been made, you must contact your line manager or submit a query through the IBC immediately to notify them. Failure to do so could result in disciplinary procedures.
Overpayment of Salary. (1) An overpayment occurs if the AFP provides an Employee with an amount of money to which the Employee was not entitled (including but not limited to salary, entitlements or allowances payable under this Agreement). (2) An overpayment of salary does not occur where: (a) an Employee initiates an adjustment or roster change; or (b) there is a change or adjustment to travel payments or allowances payable under this Agreement as a result of changes to an Employee's travel plans. (3) Where the AFP considers that an overpayment has occurred, the AFP will provide the Employee with notice in writing. The notice will provide details of the overpayment. (4) If an Employee disagrees that there has been an overpayment including the amount of the overpayment, they will advise the AFP in writing within 28 calendar days of receiving the notice. In this event, no further action will be taken until the Employee’s response has been reviewed. (5) If after considering the Employee’s response (if any), the AFP confirms that an overpayment has occurred, the overpayment will be treated as a debt to the Commonwealth that must be repaid to the AFP in full by the Employee. (6) The AFP and the Employee will discuss a suitable recovery arrangement. A recovery arrangement will take into account the nature and amount of the debt, the Employee’s circumstances and any potential hardship to the Employee. The arrangement will be documented in writing. (7) The AFP and Employee may agree to make a deduction from salary to be paid to an employee, or final monies where there is an outstanding payment upon cessation of employment. (8) Interest will not be charged on overpayments. (9) Nothing in sub-sections 97(1) to (7) above prevents: (a) the AFP from pursuing recovery of the debt in accordance with an Accountable Authority Instruction issued under the Public Governance, Performance and Accountability Act 2013; (b) the AFP from pursuing recovery of the debt through other available legal avenues; or (c) the Employee or the AFP from seeking approval to waive the debt under the Public Governance, Performance and Accountability Act 2013.

City shall, within 30 days of receiving such statement, review the statement and pay all approved charges thereon.

When the Employer has determined that an employee has been overpaid wages, the Employer will provide written notice to the employee that will include the following items: 1. The amount of the overpayment; 2. The basis for the claim; and 3. The rights of the employee under the terms of this Agreement.
