OVERTIME AND STANDBY PAY. A Overtime 1. For FLSA non-exempt employees, all hours worked in excess of the normal work week (40 hours), when worked upon the direction or approval of the member's supervisor, shall be paid at the rate of one and one-half (1 Y2) times the member's straight-time regular rate of pay or compensated by granting one and one-half (1 Y2) times the number of overtime hours worked as compensatory time off. The member shall have the option to express his/her preference (overtime or compensatory time), to be made known to the employer not later than the end of the pay period in which overtime was earned. The final decision in each instance, however, shall be at the discretion of the employer. If accrued compensatory time is to be taken, it shall be at a time convenient to the employee(s) and consistent with the operating needs of the employer. Compensatory time shall be taken under this Section as required by the Fair Labor Standards Act, if such continues to be applicable to local government employees. 2. Members shall receive a minimum of two (2) hours of compensation paid at the rate of one and one,half (1 ½) times the member's straight,time hourly rate, or compensated by granting one and one,half (1 Y2) times compensatory time off, when required to return to work after regular work hours or on weekends or holidays. The member shall have the option to make his/her preference (overtime or compensatory time) known to the employer not later than the end of the pay period in which overtime is earned. The final decision in each instance, however, shall be at the discretion of the employer. If compensatory time is to be taken, it shall be at a time convenient to the employee(s) and consistent with the operating needs of the employer. OVERTIME AND STANDBY PAY. 18.1 Employees who meet the definition of overtime-exempt under Federal and State law are exempt from overtime. 18.2 Non-exempt employees who work more than 40 compensable hours in a work week (including regular, vacation or compensatory time) will be paid overtime or granted compensatory time off accrual (if elected by the employee) at the rate of one and one-half hour for every hour worked. Overtime will be paid at the rate of 1.5 times the compensated hours in excess of 40 hours per week. Overtime will be computed to the nearest one-quarter hour. Work performed beyond 40 hours a week must have prior approval from the department director or manager. All compensatory time shall be scheduled in advance and mutually agreed upon by the supervisor and the employee. Employees may accrue up to 120 hours of compensatory time with a rolling cap. Employees may carry-over up to forty (40) hours of compensatory time to the following year and will be paid for all other compensatory time at their regular rate of pay on the pay check for the final pay period of the year. Employees working overtime for grant- funded or other third-party reimbursable/billable hours shall be paid overtime only, unless the Department Head agrees in writing to allow compensatory time in advance of the time earned. The process for requesting and using compensatory time is the same as requesting vacation time. All compensatory time shall be scheduled in advance with prior approval from the supervisor. A leave request/report form is completed and turned into a supervisor for review and approval. Denial of a request to use compensatory time shall be at the sole discretion of the supervisor and therefore can not be grieved as any violation of compensatory rules. 18.3 Time and one half shall be paid for all work performed on the employee’s first scheduled day off. Double time shall be paid for all work performed by the employee on their second scheduled day off. In the event of a declared emergency, see Article 6.

  • Standby Pay Standby pay shall be at the rate of four ($4.00) dollars per hour. An additional two dollars ($2) per hour will be paid for all hours of standby assigned by the Employer beyond seventy-five (75) hours in a pay period. Standby pay shall be paid for actual hours on standby prior to reporting for duty. Standby pay shall not be paid when the nurse is receiving the four (4) hour minimum callback guarantee, even though the nurse has returned to standby status.

  • Standby An employee who is required to remain available for duty on standby, outside the normal working hours for that particular employee, shall receive standby pay in the amount of $2.00 per hour for all hours on standby. Standby pay shall, however, cease where an employee is called into work under Article 15.06 above and works during the period of standby."

  • Standby Provisions (a) Employees required to be on standby will be paid one dollar per hour, or portion thereof. (b) The minimum standby requirement will be four consecutive hours. (c) Should the Employer require an employee to have a pager, beeper, or a cellular phone available during their standby period, then all related expenses for such device will be the responsibility of the Employer.

  • Standby Duty (a) An employee shall be on standby duty when required to be available for work outside their normal working hours, and subject to restrictions consistent with the FLSA which would prevent the employee from using the time while on standby duty effectively for the employee’s own purposes. (b) Compensation for standby duty shall be at FLSA-eligible employee’s straight time rate of pay or for FLSA-exempt employees hour for hour compensatory time off. Overtime hours shall be at the appropriate overtime pay rate pursuant to Article 32.

  • Standby Time All standby time shall be considered as regular hours worked and shall be compensated on a straight time or overtime basis as are other hours worked under this Agreement.
