Where two (2) or more employees have submitted requests for the same job, seniority, as defined in Paragraphs 902 and 912, shall prevail where qualifications to perform the work of the new job are relatively equal. Where the seniority of two (2) or more employees bidding for the job opening is the same, the date of the individual employee’s original employment application shall be used to determine the senior employee. If an issue of seniority remains, representatives of the parties will meet to resolve the matter. An employee may be denied an opening regardless of seniority, if said employee has a current Final Warning in file. 912 Seniority for bidding on any posted opening within the bargaining unit shall prevail first by classification seniority within the Area Pharmacy Operation where openings exist, then to employees by bargaining unit seniority within the Area Pharmacy Operations. Thereafter, employees by classification seniority at any licensed pharmacy within the Southern California Region and finally employees by bargaining unit seniority at any licensed pharmacy within the Southern California Region will be considered for any posted opening provided a request form is on file with the Area Personnel Office prior to the end of the posting period. Employees who successfully bid on a posted position shall not be unreasonably delayed in assuming the new position. 913 Employees who move to a posted opening shall have a trial period of not less than ninety (90) calendar days. During such ninety (90) day trial period, the employee shall be given thorough instruction and proper orientation in the new work and shall be given an evaluation by the Employer between the fortieth (40th) and fiftieth (50th) day from the date in the new position. After such trial period, if the employee is unable to perform the duties of the new position satisfactorily said employee will be restored to the position immediately held prior to the new position without discrimination. During the trial period, an employee may be restored to their former position where it is determined that clear and present danger exists by allowing said employee to remain in the new position. An employee who is voluntarily reassigned pursuant to Article IX shall have seven (7) calendar days to change their mind and upon written request, shall be returned to their former position. This right shall be available only once during the term of the agreement. If additional circumstances occur, the Union and the Company will meet and confer. 914 For bidding and reduction in force purposes only, the Antelope Valley pharmacy locations will be considered as an Area Pharmacy Operation. 915 Temporary Position 916 If a position opens on a temporary basis, it will be treated as any job opening for bidding purposes. When a temporary position ceases to exist, the employee holding the position will return to his or her former job and employees displaced as a consequence can similarly return to their former position. If a temporary position becomes permanent, it must be posted as a permanent job. The employer’s obligation to rotate overtime shall be satisfied by calling employees who are working at the time the overtime determination is made (i.e., not on vacation or other leave of absence) in seniority order and offering them the opportunity to work. 5. If there are insufficient volunteers available for any specific assignment, the employer may require the least senior employee in the division to perform the work. 6. Substantiated errors made in the rotation of overtime (Article XIII Section G.4) will be corrected on the basis of offering the by-passed employee an amount of overtime equal to the time lost due to the error of assignment. Depending on the number of hours involved, it is possible that this may take more than (1) one overtime offer/assignment. Acceptance of the compensatory overtime will not change the employees spot in the overtime rotation, thus the employee will remain eligible for overtime in the same rotation as before the error. Refusal of overtime in the temporarily assigned area will preclude any other overtime offer for that time period. J. Alternate shift rules and policies are referenced in Appendix C. K. If overtime work should arise which the qualified employees within the occupational group and shift refuse to perform, the overtime will be made available to any qualified bargaining unit employee. When qualified bargaining unit employees are unavailable due to refusal of overtime, Article 8 Section 1 will be utilized. L. When circumstances arise, which may compromise the Company’s ability to comply with the overtime provisions of this agreement, the Company and Union shall meet to discuss a resolution. M. With the intent to manage overtime within the recognized out of spread conditions, the Company is committed to review opportunities to train employees on new systems or any changes to existing systems affecting that job classification and status within each licensed pharmacyin order to conduct the work.

In this instance, the next senior qualified employee who has been required to work less than 80 hours of overtime that contract year will be required to perform the work. All hours worked on a Sunday shift will be on a voluntary basis. Before the Company starts to mandate employees into the Operator Classification, the Company has to follow the procedures in Article 18.05. When it is necessary to mandatory bargaining unit employees in the operator classification for Saturday overtime, the company will allow a minimum of thirty (30%) percent of the mandatoried operators per shift in order of seniority to be excused from working the overtime and be replaced with TPT employees in accordance with Letter of Understanding #8 of the collective agreement provided they are available for work. Such employees will be charged as having refused the overtime for recording purposes. h) The Company will allow employees to attend union membership meetings. The meetings will be scheduled every three (3) months on a Saturday and such that work interruptions due to these meetings will only effect the day shift operation of the plant. The union must provide written notice of such meeting to the Manager Human Resources and Vice President, Operations at least five (5) days prior to such meeting. The company and the union will work together to ensure all urgent customer requirements can be fulfilled on these occasions. i) When employees work weekend OT, they will work weekend OT on the same shift as their last regularly scheduled shift. Where a paid holiday follows weekend overtime, employees will not rotate or switch shifts until their next regularly scheduled workday. Unscheduled overtime shall be offered by classification seniority to those employees present when When the need for overtime arises, the ▇▇▇▇▇▇▇ will call or ask the man in each job title with the least amount of hours listed if he wants to work, if he refuses then he will proceed to the next man in that job title and so on until he has enough men in a given job title. Unclaimed In no event will the supervisor perform bargaining unit work until the call out list for overtime whether has been exhausted. If no employee in job title accepts the overtime, it will be offered to qualified employees within the affected department prior to forcing the least senior in the job title. If no employee in the job title or affected department accepts the overtime, then it will be offered to qualified employees in another department. Employees transferring or newly hired into a department will be placed on the overtime rotation on the level equal to the employee with the lowest amount or number of overtime hours in that department. The first time through each job title as needed will be voluntary. If there are not enough men by voluntary call out, the ▇▇▇▇▇▇▇ will proceed again through the list as before. The employee is called the second time will then be required to work the overtime as long as it is still the same job he was asked to work the first time around. The only exception will be if the employee is sick or a member of his/her family is sick and he is needed to stay home. Symbols to be used on the overtime list shall include the following: • W – Worked time specified. Would be charged against employee overtime hours. • M – Mandatory work – worked time – specified as ordered by second time through the list. Would be charged against employee overtime hours. • NA – No answer – would not be charged against employee overtime. • R – Refused – would be charged against employee, same as if he had worked the time. • R/S – Refused sick – would not be charged against employee overtime hours. When the City determines that an emergency exists then call out for overtime will be administered on a single request basis and will be considered mandatory. In the event that the City determines that an emergency exists then call out may be made across job titles. A copy of the overtime opportunity list currently in use is attached hereto as an exhibit. Overtime scheduling at the Waste Water Treatment Plant, and only the W.W.T.P. varies from previously agreed upon language contained in Article 7, Section 7, Overtime Scheduling for the Plant Operators in the following manner. It is mutually understood and agreed by the City and Teamsters that there being a 24 hour per day, 7 days per week operation at the W.W.T.P. and the need at time for overtime scheduling for operations in the event of scheduled and/or unscheduled absences of a plant operator, assigned to operate the Wastewater Treatment Plant on any shift or shifts: In the event of an Operator absence on their scheduled shift, either scheduled or unscheduled, before being assigned it is understood that the operator on duty directly preceding the absence shall split the shift with the operator scheduled on shift directly following the absence. If either operator is unable to do so, they shall contact another plant operator according to call out procedures. If there is not an available operator, then the least senior employee(s) within a classification who working operator shall be required to work the overtime. At no time is the plant to be left unattended. In the event that two operators are scheduled on a shift, will first then the operator with seniority and least overtime hours shall be offered by bargaining unit seniority the overtime first before the other operator and before proceeding to any member calling other operators. It is understood that this Overtime call out procedure affects only the Wastewater Treatment Plant operations overtime scheduling “only” and its intent is to create harmony, lessen the disturbances of operator scheduling, and improve operations of the bargaining unit within plant. It is not intended to interfere with any other Article or section of the licensed pharmacy who can perform the work. 908 Job Posting 909 Notices Agreement Overtime call out of all job openings within the bargaining unit plant operators for other than operations issues shall be posted by the Employer by the usual and customary job posting process. Where two (2) or more employees have submitted requests for the same job, seniority, as defined in Paragraphs 902 and 912, shall prevail where qualifications to perform the work of the new job are relatively equal. Where the seniority of two (2) or more employees bidding for the job opening is the same, the date of the individual employee’s original employment application shall be used to determine the senior employee. If an issue of seniority remains, representatives of the parties will meet to resolve the matter. Overtime Scheduling. Provisions In accordance with existing practice, prescheduled overtime will be emailed via county email to all Facility Security Specialists by Tuesday for the following week. All prescheduled overtime will be awarded on a first-come, first-serve basis according to the order of this language the email response. An employee who is voluntarily reassigned pursuant to Article IX shall have seven (7) calendar days to change their mind and upon written request, shall be returned to their former position. This right shall be available only once during the term of the agreement.
