Payment of Valid Claims. No later than the Deadline to Pay Valid Claims, the Settlement Administrator must calculate and pay the valid claims (by check or electronic payment) and provide the Identity Theft Protection Services. The Net Settlement Fund will be responsible for providing the Settlement Administrator with all payments necessary to provide the benefits deemed valid by the Settlement Administrator within the Deadline to Pay Valid Claims. In computing payment amounts for Cash Payments, the Settlement Administrator has authority to round payments to the nearest cent. If the total of all payments to be made exceeds the amount of the Net Settlement Fund, the Settlement Administrator shall randomly reduce a sufficient number of payments by one cent until the payments no longer exceed the Net Settlement Fund. The Settlement Administrator shall report to Class Counsel and Defendants on a periodic basis, or as requested, regarding the status of valid, invalid, and deficient claims.

Payment of Valid Claims whether via mailed check or electronic distribution, shall be made within forty-five (45) days of the Effective Date (“Initial Payment Date”), or within thirty (30) days of the date that the claim is approved, whichever is later. If this Settlement Agreement is terminated or otherwise does not become Final (e.g., disapproval by the Court or any appellate court) prior to the payment of ▇▇▇▇▇ Claims, ▇▇▇▇▇▇ shall have no obligation to pay such claims and shall only be required to pay costs and expenses related to notice and administration that were already incurred.

Payment of Valid Claims. Valid Claims shall be paid by an electronic deposit through Venmo, prepaid card or Zelle with checks available upon request to the Settlement Class Member within sixty (60) days after the Effective Date, subject to reasonable extension upon mutual agreement by the Parties if necessary for the Claim Administrator, the Parties and/or the Court to complete the claim determination and processing processes described in Paragraph 4.6. All settlement checks shall be void and no longer negotiable one hundred twenty (120) day after the date the check was issued. If a settlement check is not negotiated, the Settlement Class Member shall not be entitled to any further payment under this Agreement. If a settlement check is returned as undeliverable, the Claim Administrator shall send an email to the claimant, if an email address was provided with the claim, to attempt to obtain a better address, and if obtained, shall mail the check to the new address, but the re- mailing of any check will not extend the 120-day period after which the check will become void. The return or failure to cash checks shall have no effect on a Settlement Class Member’s release of claims, obligations, representations, or warranties as provided herein, which shall remain in full effect. Funds from uncashed checks shall be paid to a cy pres charity to be agreed upon between the parties and approved by the Court.

The Settlement Administrator shall report to Class Counsel and Defendant on a periodic basis, or as requested, regarding the status of valid, invalid, and deficient claims. No Person shall have any claim against Plaintiffs, Class Counsel, Released Parties, CorrectCare, CorrectCare’s counsel, or the Settlement Administrator based on distributions made substantially in accordance with this Agreement or otherwise as further ordered by the Court. This provision does not include any claim by any party for breach of this Agreement.

Payment of Valid Claims. Payments for Valid Claims shall be transferred electronically or mailed and postmarked after the Effective Date and within sixty (60) days of the Effective Date and/or thirty (30) days of the date that the claim is approved, whichever is latest.
