Performing Duties Clause Samples
The "Performing Duties" clause defines the obligations and standards by which a party must carry out its responsibilities under an agreement. Performing Duties. The Governmental Unit will faithfully and punctually perform all duties with respect to the System required by the Constitution and the laws of the State and the ordinances and resolutions of the Governmental Unit, relating to the System and this Loan Agreement, including, but not limited to, making and collecting reasonable and sufficient rates and charges for services rendered or furnished by the System as hereinabove provided.

Performing Duties. The District will faithfully and punctually perform all duties with respect to the System required by the Constitution and laws of the State and the resolutions of the District, including but not limited to the making and collecting of reasonable and sufficient Rates and Charges for services rendered or furnished by the System, and the proper segre- gation of the revenues of the System and their application to the respective funds provided from time to time therefor. Similarly the Special Connector will so perform all duties with respect to its Sewer System required by the Constitution and laws of the State, by ordinances or resolutions of the Special Connector, and by resolutions of the District, as permitted by law, including but not limited to the prompt payment of Annual Charges.
Performing Duties. When an employee is required to substantially perform the duties of a higher paid position temporarily, shall be paid the minimum salary which has been established for such higher paid position for such time as performs the duties thereof, provided this minimum shall be at least seven (7) cents per hour above regular rate. If this minimum is equal to or less than regular rate, shall be paid at the step in the range of the higher paid position which is at least seven (7) cents per hour above regular rate. When an employee is required to replace the incumbent of any one (1) higher paid decertified position, shall be paid an additional amount equal to of normal rate of pay. Before any employee can be assigned to substitute for another employee in a higher paid position, it must be established that the substitute employee has the required qualifications including administrative and supervisory skills in the division in which the substitution is to be made. It is agreed that any payment for superior duties shall only apply to one (1) position and further, that as a result of a higher classification within this Agreement becoming temporarily vacant, a chain reaction of superior duties will not follow. Performing Duties.
