Posting. Each Credit Party hereby agrees that it will provide to the Administrative Agent all information, documents and other materials that it is obligated to furnish to the Administrative Agent pursuant to this Agreement and any other Loan Document, including all notices, requests, financial statements, financial and other reports, certificates and other information materials, but excluding any such communication (unless otherwise approved in writing by the Administrative Agent) that (i) relates to a request for a new, or a conversion of an existing, Borrowing or other extension of credit (including any election of an interest rate or interest period relating thereto), (ii) relates to the payment of any principal or other amount due under this Agreement prior to the scheduled date therefor, (iii) provides a Notice of Intent to Cure, (iv) provides notice of any Default under this Agreement or (v) is required to be delivered to satisfy any condition precedent to the effectiveness of this Agreement and/or any borrowing or other extension of credit hereunder (all such non-excluded communications, collectively, the “Communications”), by transmitting the Communications in an electronic/soft medium in a format reasonably acceptable to the Administrative Agent at such e-mail address(es) provided to the Borrower from time to time or in such other form, including hard copy delivery thereof, as the Administrative Agent shall require. In addition, each Credit Party agrees to continue to provide the Communications to the Administrative Agent in the manner specified in this Agreement or any other Loan Document or in such other form, including hard copy delivery thereof, as the Administrative Agent shall reasonably request. Nothing in this Section 10.01 shall prejudice the right of the Agents, any Lender or any Credit Party to give any notice or other communication pursuant to this Agreement or any other Loan Document in any other manner specified in this Agreement or any other Loan Document or as any such Agent shall require.
Posting. The Employer undertakes the responsibility of posting all job vacancies as they occur on designated notice boards. Such a posting shall remain on the Central notice board for ten calendar days before the job is permanently filled and shall stipulate the qualifications, classification, rate and department concerned. The Employer agrees to provide the chief ▇▇▇▇▇▇▇ with a copy of each job posting. The parties agree that an administrative oversight in this regard does not void the job posting. The Employer is free to temporarily fill a vacancy as it sees fit during the posting period and up to the time an ap- pointment is made; and no grievance may be filed concerning such temporary arrangements until a selection has been made. An ap- pointment shall be made within seven days of the end of the posting period unless the Employer has given the Union written notice that it intends to postpone or not fill the vacancy. In the event the Employer plans to change a vacant full- time position to a part-time position, it will advise the Union and discuss its plans with them. Where vacancies are posted for positions within the full-time bargaining unit and no applicants within the full-time unit are successful in obtaining the positions, applications submitted for such posting from part-time employees will be considered prior to consideration of persons not employed by the Home. In the event one or more part-time employees apply, the Employer shall consider the qualifications, experience, ability and seniority of the applicants. Where these factors are equal, the applicant with the greatest seniority shall fill the vacancy provided she can perform the work. Where vacancies are posted for positions within the part-time bargaining unit and no applicants within the part-time unit are successful in obtaining the positions, applications submitted for such posting from the full-time employees will be considered prior to consideration of persons not employed by the Home. In the event one or more full-time employees apply, the Employer shall consider the qualifications, experience, ability and seniority of the applicants. Where these factors are equal the applicant with the greatest seniority shall fill the vacancy provided she can perform the work. Posting. Before hiring an applicant to fill a vacancy in a job classification (whether a new or previously existing job classification) within the bargaining unit, the College will post a notice of the vacancy on the official College-Union bulletin boards and electronically. Such notice will be on salmon-colored paper and will include the job title, rate and the date the vacancy is expected to occur. Employees applying for vacancies will be required to apply through Workday by means of an electronic application that has been agreed upon by the parties. Such notice will be posted for not less than five (5) working days before such vacancy is filled on a permanent basis. The College will provide bargaining unit employees with access to computers to be used for electronic applications and will provide training and assistance to employees upon request. If it is necessary to fill the vacancy in less than five (5) working days, it will be filled on a temporary basis in order to allow time for the College to consider the qualifications of employees who apply for the job. If a posted position is not filled by a qualified applicant within sixty (60) days of the end of the posting period, the College will re-post the position, accepting both internal and external applicants from the date of reposting. To re-post a position, the College will a) send an updated posting to the Union and b) either re-post an updated posting on Workday or notify the Union that the original Workday posting is still posted and that the College is still accepting applicants for that posting. The preference for bargaining unit employee applicants under Article 19.1 will continue to apply. After each subsequent 60- day period, the same posting process will be repeated until the position is filled or the Union has been notified that the position has been withdrawn. If the College selects an applicant other than the most senior applicant to fill a vacancy on a permanent basis, the College will give the Union a written statement of the reason or reasons for such selection. If a job is filled under the procedure set forth in this Section and thereafter a vacancy occurs in the same job classification, such vacancy may be filled by the College, without repetition of the posting procedure, from among employees who applied within the posting period of the previous notice, provided that such vacancy is filled within one (1) month after the end of the posting period of the previous notice. Posting. Where a vacancy occurs, a new position is created within the Bargaining Unit or a temporary position exists as the result of a leave of absence of eight (8) weeks or more, a notice shall be posted as soon as possible after the Employer has determined that the vacancy exists and such notice shall be posted for a period of ten (10) calendar days. All applications for vacancies will be in writing. The name of the successful applicant shall normally be provided to the President of the Local Union within fourteen (14) calendar days of the appointment to the position.
Posting. Each Loan Party further agrees that the Administrative Agent may make the Communications available to the Lenders by posting the Communications on Intralinks or a substantially similar electronic transmission system (the “Platform”).
Posting. (i) The Contractor shall post the relevant contents of the compliance plan, no later than the initiation of contract performance, at the workplace (unless the work is to be performed in the field or not in a fixed location) and on the Contractor's Web site (if one is maintained). If posting at the workplace or on the Web site is impracticable, the Contractor shall provide the relevant contents of the compliance plan to each worker in writing.
(ii) The Contractor shall provide the compliance plan to the Contracting Officer upon request.
Posting. Each Loan Party further agrees that the Administrative Agent may make the Communications available to the Lenders by posting the Communications on SyndTrak Online or a substantially similar electronic transmission system (the “Platform”). The Borrower hereby acknowledges that (i) the Administrative Agent and/or the Joint Lead Arrangers will make available to the Lenders materials and/or information provided by or on behalf of the Borrower hereunder (collectively, “Borrower Materials”) by posting the Borrower Materials on the Platform and (ii) certain of the Lenders (each, a “Public Lender”) may have personnel who do not wish to receive material non-public information with respect to the Borrower or its Affiliates, or the respective securities of any of the foregoing, and who may be engaged in investment and other market-related activities with respect to such Persons’ securities. The Borrower hereby agrees that it will use commercially reasonable efforts to identify that portion of the Borrower Materials that may be distributed to the Public Lenders and that (w) all such Borrower Materials shall be clearly and conspicuously marked “PUBLIC” which, at a minimum, shall mean that the word “PUBLIC” shall appear prominently on the first page thereof; (x) by marking Borrower Materials “PUBLIC,” the Borrower shall be deemed to have authorized the Administrative Agent, the Joint Lead Arrangers, the Issuing Banks and the Lenders to treat such Borrower Materials as not containing any material non-public information (although it may be sensitive and proprietary) with respect to the Borrower or its Affiliates or their respective securities for purposes of United States Federal and state securities laws; (y) all Borrower Materials marked “PUBLIC” are permitted to be made available through a portion of the Platform designated “Public Side Information;” and (z) the Administrative Agent and the Joint Lead Arranger shall be entitled to treat any Borrower Materials that are not marked “PUBLIC” as being suitable only for posting on a portion of the Platform not designated “Public Side Information.” Notwithstanding the foregoing, the Borrower shall not be under any obligation to ▇▇▇▇ any Borrower Materials “PUBLIC” to the extent the Borrower determines that such Borrower Materials contain material non-public information with respect to the Borrower or its Affiliates or their respective securities for purposes of United States Federal and state securities laws.
Posting i) Employers shall ensure that the internal selection procedure in the applicable local collective agreement has been concluded prior to job postings being listed on the system-wide registry.
ii) Institutions will post on the Registry all employment opportunities of half-time or more and longer than three (3) months in duration that are available to applicants beyond those employed by the institution.
iii) Postings will be removed from the registry one (1) week after the closing date.
iv) Employers may elect to include job postings from institutions not covered by this Agreement.
v) Unions, Employers and employees have the right to access the information on the system-wide registry. Computer terminal access will be provided and the location will be mutually agreed at the local level. Where Internet access is not available, other arrangements will be made.
Posting. The Contractor must publicly post on the work site, in a prominent and accessible place, a legible schedule of the prevailing wage rates and supplements.
Posting. In the event new jobs are created or vacancies occur, the City will post such new jobs or vacancies for a period of five (5) working days in order that permanent employees (but not part time, temporary or probationary employees), may have the opportunity of applying. Such job will be posted as per job description, and the wage or wage ranges. All employees wishing to apply shall do so using the approved internal application. Employees must complete the qualifications section and attach copies of any documents pertinent to their application, such as licenses and certificates. Incomplete applications will not be considered. Creation of New Jobs In the event new jobs are created or vacancies occur in jobs, the new jobs or vacancies shall be posted prior to an employeebeing selected and trained for the job. However, it is recognized that the City must assign personnel to these vacancies on a temporary basis. This temporary period not to exceed fifteen (15) working days, unless extended by mutual agreement. No outside advertisement or interviews for any vacancy within the bargaining unit shall be placed until the applications of permanent employees available from within the bargaining unit have been processed. If no application within the bargaining unit is accepted, the City may secure applications from outside or other sources. Part-time or temporary employees who have filled out a permanent application form shall be given an opportunity to apply and the City will interview all qualified applicants with the qualified applicants who apply to the advertised position from outside sources. In the event that one or more employees applies, suitable applicants will be interviewed by two of: a member of the Employee Resources Department, the Supervisor or Superintendent. Upon request, all unsuccessful applicants shall get a written reply setting out the reasons why the applicant was not selected for the position. If the applicant requires more information than is set out in the written reply they may request and receive an interview with one of the above persons who conducted the interview with the employee. An employee with greater seniority shall receive preference provided he has the skill, ability, experience and qualifications to do the work. A successful applicant from within the bargaining unit shall be subject to a trial period of up to forty-five (45) days worked.
