Privacy/Data Collection. The Licensed Software may collect the IP address for your system on which the Licensed Software is installed and submit such IP address to Symantec through the Licensed Software, for the purpose of enabling Symantec to fulfill a technical support request from You or Your network administrator or to improve the installation process for the Licensed Software. The information will be used only for the purpose(s) set forth above. The information may be transferred to the Symantec group in the United States or other countries that may have less protective data protection laws than the region in which you are situated (including the European Union), but Symantec has taken steps so that the information, if transferred, receives an adequate level of protection. Any such information obtained by the Licensed Software will be maintained in a secure manner, and will not be correlated with any other personally identifiable information. Symantec may disclose the information if asked to do so by a law enforcement official as required or permitted by law or in response to a subpoena or other legal process.

Reseller will at all times during the term of this Agreement maintain appropriate technical and organizational measures to protect any End User data that it collects, accesses or processes in connection with this Agreement against unauthorized or unlawful use, disclosure, processing or alteration. Reseller will act only on ILS 's instructions in relation to the collection, use, disclosure and processing of any such End User data, but in all instances in accordance with all applicable laws, rules and regulations.

ActivPartner will at all times during the term of this Agreement maintain appropriate technical and organizational measures to protect any Customer data that it collects, accesses or processes in connection with this Agreement against unauthorized or unlawful use, disclosure, processing or alteration. ActivPartner will act only on NQATIV's instructions in relation to the collection, use, disclosure and processing of any such Customer data, but in all instances in accordance with all applicable laws, rules and regulations.

The Licensed Software may also collect personally identifiable information, including but not limited to, usernames, IP addresses in log files, server log files, MAC address, metering application usage by username and active directory module. This information is stored on Your system and is not transmitted to Symantec unless You voluntarily submit such information to Symantec in a support request. If submitted to Symantec, such information will be used for the purpose of troubleshooting and to provide support. The information may be transferred to the Symantec group in the United States or other countries that may have less protective data protection laws than the region in which You are situated (including the European Union) and may be shared with affiliates of the Symantec group worldwide and with Symantec licensors or service providers that operate on Symantec’s behalf, but Symantec has taken steps so that the submitted information, if transferred, receives an adequate level of protection. In case of transfer of users’ personal information to Symantec, it is Your responsibility to comply with applicable laws, including, but not limited to, communication to users.

The Licensed Software may collect some or all of the following information from the Hardware and/or Your system on which the Licensed Software is installed: case names, IP addresses, fully qualified file names and user names, product performance information, system memory monitoring statistics, logs for the Licensed Software listing errors, warnings and information messages (the “Collected Information”). The Collected Information is logged for troubleshooting and diagnostic purposes on Your system and is only sent to Symantec for purposes of enabling Symantec to fulfill a technical support request from You or Your network administrator. Symantec may correlate the Collected Information with other information about You or Your product usage to enable Symantec to fulfill Your technical support request. The information may be transferred to the Symantec group in the United States or other countries that may have less protective data protection laws than the region in which You are situated (including the European Union), but Symantec has taken steps so that the information, if transferred, receives an adequate level of protection. Any such information obtained by the Licensed Software will be maintained in a secure manner. Symantec may disclose the information if asked to do so by a law enforcement official as required or permitted by law or in response to a subpoena or other legal process.
Privacy/Data Collection. Licensee and its Affiliates shall collect, store, and use all Personally Identifiable Information of end users of the Managed Assets (“End User Data”), or any Personally Identifiable Information of any other entity consistent with applicable laws, regulations and any privacy policies applicable to the Managed Assets. For purposes of this Agreement, “Personally Identifiable Information” means any and all of the following: first and last name, e-mail address, telephone number, date of birth, credit card information, street address, or any other information which may be used to personally identify or that identifies, relates to, or could reasonably be linked to an individual or household, as well as how such terminology is defined in all applicable consumer privacy and data protection laws and regulations throughout the Territory. To the extent permitted by applicable laws, Licensor shall have all right, title, and interest in the End User Data and analytic data collected from or associated with the Managed Assets. Licensee may use such End User Data and analytic data in conjunction with fulfilling its obligations hereunder in accordance with the Data Protection Addendum attached hereto as Exhibit E and incorporated herein by reference. Licensee may not sell End User Data to third parties and/or use such End User Data to market or promote products and services other than the Managed Assets. To the extent Licensee receives any requests from consumers to “opt out” of receiving information or other privacy inquiries, Licensee and its Affiliates shall honor such requests and will forward such requests to Licensor within a commercially reasonable timeframe, but in any event in compliance with applicable law.
