PROGRESS SCHEDULES. 9.1 To enable the Work to be performed in an orderly and expeditious manner, the Contractor, within fifteen (15) Days after the Notice to Proceed or Order to Work, unless otherwise directed by the Engineer, shall submit to the Engineer a proposed progress schedule based on the Critical Path Method in the form of a bar graph or in such other form as specified by the Engineer, and monthly cash flow requirements, showing: 9.1.1 The anticipated time of commencement and completion of each of the various operations to be performed under this Contract; and 9.1.2 The sequence and interrelation of each of these operations with the others and with those of other related contracts; and 9.1.3 The estimated time required for fabrication or delivery, or both, of all materials and equipment required for the Work, including the anticipated time for obtaining required approvals pursuant to Article 10; and 9.1.4 The estimated amount in dollars the Contractor will claim on a monthly basis. 9.2 The proposed schedule shall be revised as directed by the Engineer, until finally approved by the Engineer, and after such approval, subject to the provisions of Article 11, shall be strictly adhered to by the Contractor. 9.3 If the Contractor shall fail to adhere to the approved progress schedule, or to the schedule as revised pursuant to Article 11, it shall promptly adopt such other or additional Means and Methods of Construction, at its sole cost and expense, as will make up for the time lost and will assure completion in accordance with the approved progress schedule. The approval by the City of a progress schedule which is shorter than the time allotted under the Contract shall not create any liability for the City if the approved progress schedule is not met. 9.4 The Contractor will not receive any payments until the proposed progress schedule is submitted.

PROGRESS SCHEDULES. The OWNER will provide for coordination of the activities of the OWNER's own forces, of each separate City contractor, and of any other utility owners performing work in relation to the Work of CONTRACTOR, who will cooperate with them. CONTRACTOR will participate with other City contractors and the OWNER in reviewing their construction progress schedules when directed to do so. On the basis of such review, CONTRACTOR will make any revisions to the current approved Progress Schedule deemed necessary after a joint review and mutual agreement. The agreed upon Progress Schedules will then constitute the progress schedules to be used by CONTRACTOR, other City contractors and the OWNER until subsequently revised.

A Progress Schedule must be submitted with each request for payment, and the data contained in the Progress Schedule must coincide with the information stated in the request for payment. Each Progress Schedule must accurately reflect the actual progress of the Work, as well as any revisions to the logic, sequence, durations of work activities or level of detail of the number, description or division of the Work activities. Any failure to approve or modify on time may be construed as approval of said organizational design of the construction (or construction plan) and progress schedule. Party B shall organize the construction work pursuant to the approved schedule, and shall allow Party A's Representative to inspect and monitor the progress. When the actual progress of the project falls behind schedule, Party B shall, as requested by Party A's Representative, submit a proposal of improvement measures, and, after obtaining Party A's Representative's approval, shall implement said measures.
