PUBLIC CONVENIENCE AND SAFETY. (a) The Prime Contractor shall place materials stored about the Work and shall conduct the Work at all times in a manner that causes no greater obstruction to the public than is considered necessary by the Owner. Sidewalks or streets shall not be obstructed, except by special permission of the Owner. The materials excavated and the construction materials or plant used in the performance of the Work shall be placed in a manner that does not endanger the Work or prevent free access to all fire hydrants, water mains and appurtenances, water valves, gas valves, manholes for the telephone, telegraph signal or electric conduits, wastewater mains and appurtenances, and fire alarm or police call boxes in the vicinity. (b) The Owner reserves the right to remedy any neglect on the part of the Prime Contractor in regard to public convenience and safety which may come to the Owner's attention, after twenty-four (24) hours notice in writing to the Prime Contractor. In case of an emergency, the Owner shall have the right to immediately remedy any neglect without notice. In either case, the cost of any work done by the Owner to remedy the Prime Contractor’s neglect shall be deducted from the Contract Sum. The Prime Contractor shall notify the City Traffic Control Department when any street is to be closed or obstructed. The notice shall, in the case of major thoroughfares or street upon which transit lines operate, be forty-eight (48) hours in advance. The Owner reserves the right to postpone or prohibit any closure or obstruction of any streets or thoroughfares to the extent necessary for the safety and benefit of the traveling public. The Prime Contractor shall, when directed by the Architect/Engineer or the Owner, keep any street or streets in condition for unobstructed use by City departments. When the Prime Contractor is required to construct temporary bridges or make other arrangements for crossing over ditches or around structures, the Prime Contractor’s responsibility for accidents shall include the roadway approaches as well as the crossing structures.

PUBLIC CONVENIENCE AND SAFETY. The Contractor shall comply with all Federal, State, Municipal and local laws, bylaws, ordinances, and regulations applicable to the Work under this Contract, including OSHA and MIOSHA. He shall furnish and use all material, safeguards, safety devices, and protective equipment as required by such laws, ordinances, or regulations. He shall also be responsible for taking any other needed actions to protect the life and health of the Contractor's and County's employees on the Work and safety of the public, and to protect the Work and adjoining utilities and property during the construction of the Project.

PUBLIC CONVENIENCE AND SAFETY. The Licensee shall be familiar with and operate within the guidelines set forth by the Occupational Safety and Health Act. The Licensee is granted the right to use dedicated streets, alleys and refuse/recycling collection easements for the purpose of performing the Scope of Work specified in this Agreement; the Licensee is not, however, granted exclusive use of such streets, alleys or easements. The Licensee shall handle the Work in a manner that will cause the least inconvenience or annoyance to the general public and to property owners. Whenever the Licensee’s operations create a condition hazardous to traffic or to the public, the Licensee shall furnish, erect, and maintain such fences, barricades, lights, signs and other devices, and take such other protective measures as are necessary to prevent accidents or damage or injury to the public. All such conditions must be immediately reported to the City and any barricades, lights, signs or other devices erected must be coordinated with the City and conform to City requirements. Whenever there may be a temporary modification in a contained or uncontained refuse/recycling collection point due to the Licensee's operations or utility/street service operations, the Licensee shall be responsible for written notification of such modifications to each affected customer. Notification must be placed on the customer’s door. A notice attached to the container is not authorized. The Licensee shall be responsible for Collection Services during temporary disruptions as specified in the Agreement Documents.

PUBLIC CONVENIENCE AND SAFETY. The Contractor shall at all times observe the ordinances of the Town, monitor, direct and control its employees, and engage in training programs to acquaint its employees with applicable laws, safety programs and procedures.

PUBLIC CONVENIENCE AND SAFETY. The safety, protection and convenience of the School District’s students, the general public, the School District’s employees, and the Contractor’s employees are of primary importance, and shall be monitored by the Construction Manager in an adequate and satisfactory manner. Precaution shall be exercised at all times for the protection of persons and property. The safety provisions of the School District of Philadelphia Safety Manual and applicable laws, rules and regulations, and codes shall be observed. If any operation, practice or condition during the course of the work is deemed by the School District or its representatives to be unsafe, the Construction Manager shall make sure that appropriate corrective action is taken by the Contractor. Where and when any operation, practice or condition endangers persons or property, it shall be discontinued and adequate remedial action taken before such work is resumed. The Construction Manager shall monitor corrective actions. The Construction Manager shall maintain NCR (Non-Compliance Reports) log using the approved project management program.

Materials excavated and construction materials or plants used in the performance of the ARTWORK shall be placed in a manner that does not endanger the ARTWORK or prevent free access to public infrastructure. The ARTIST shall, when directed by the CITY, keep any street or streets in condition for unobstructed use by CITY departments.

PUBLIC CONVENIENCE AND SAFETY. The Contractor shall comply with all Federal, State, Municipal and local laws, by-laws, ordinances, and regulations applicable to the work under this Contract, including OSHA and MIOSHA. He shall furnish and use all material, safeguards, safety devices, and protective equipment as required by such laws, ordinances or regulations. The Contractor shall also be responsible for taking any other needed actions to protect the life and health of the Contractor's and Owner's employees on the work and safety of the public, and to protect the work and adjoining utilities and property during the construction of the project. In order to freely prosecute the work, the Contractor shall occupy only such parts of the public property along the line of the work as is reasonably needed. Regardless of its degree of proximity of the work, private property shall not be used by the Contractor except upon his obtaining express permission from the owners involved. During the progress of the work, the Contractor shall accommodate both vehicular and foot traffic and shall provide free access to fire hydrants, water and gas valves. Gutters or waterways must be kept open or other provisions made for removal of storm water. Street intersections may be blocked but one-half at a time, and the Contractor shall lay and maintain temporary driveways, bridges, and crossing, such as in the opinion of the Engineer are necessary to reasonably accommodate the public. In the event of the Contractor's failure to comply with these provisions, the Engineer may cause the same to be done, and will deduct the cost of such work from any money due or to become due the Contractor under this contract, but the performance of such work by the party of the first part, or at its insistence, shall serve in no way to release the Contractor from his general or particular liability for the safety of the public or the work.
