Public Trails. Trails shall be done in accordance with the approved County Trails Master Plan, or as may be modified by the adoption of a revised Trails Plan by the City. i. All trails shall be completed concurrently with each phase of the development. Trails are limited to 8% grade. ii. Trail easements shall be shown on all plats and each public trail shall have an as- built easement recorded on every trail providing for public access. Easements shall be 5’ on each side of the center line for back country trails and 10’ from the center line for asphalt trails.
Public Trails. The Public Trails, as defined in the Development Agreement, consist of a 4' wide public hiking trail on the north side of ▇▇▇▇▇▇▇▇▇▇▇ Road across Parcel 1 (Resort Parcel) and Parcel 2 (Residential Parcel) and a 10' wide public pedestrian and bicycle trail that extends from Healdsburg Avenue, through Parcel 8 (Public Park Parcel), Parcel 7 (Resort Parcel), and Parcels 5 and 6 (Affordable Housing Parcels). In connection with the Public Trails, Section 6 (b) of Exhibit B to the Development Agreement provides that City agrees to accept an offer of dedication of the Public Trails “at such time as (i) the City approves the First Final Map (if such Public Trails are then completed), or (ii) such Public Trails are completed in accordance with the Subdivision Improvement Agreement for the First Final Map (if such Public Trails are not completed when such final map is approved).” While an easement for the Public Trail on the north side of ▇▇▇▇▇▇▇▇▇▇▇ Road across Parcels 1 and 2 was offered for dedication to the City on FM-1, the public hiking trail has not yet been constructed. The public pedestrian and bicycle trail through the Public Park (Parcel 8), Resort (Parcel 7), and Affordable Housing (Parcels 5 and 6) sites has not yet been constructed. In accordance with the Second Insubstantial Amendment, the timing of construction of the Public Trails was extended in an effort to coordinate with the City's master planning efforts for the Public Park and Affordable Housing parcels.
Public Trails. The Public Trails to be constructed to serve the Project are shown on the Conceptual Plan attached to this Agreement at Exhibits C. The Property Owner shall construct Public Trails to connect the Project to the adjacent walking trails in ▇▇▇▇▇ ▇▇▇▇ prior to the issuance of the certificate of occupancy for the 120th single- family residence of the Project. All Public Trails shall be concrete or asphalt and shall otherwise be constructed in accordance with the standards of the Paddocks MPD. All Public Trails shall be open to public use. The Property Owner shall pay all costs associated with the planning, engineering, construction, and installation of all Public Trails, subject to the Impact Fee reimbursements provided for at Section 3.05(2).
Public Trails. Except as may otherwise be provided herein, Tthe Developer shall, at the Developer's sole cost and expense, provide for the design and construction of public hiking trail (the “Northwest Trail”) and a public pedestrian and bicycle trail (the “Multi-Use Trail”) (collectively, the "Public Trails") in the approximate locations for pPublic tTrails shown on the pPublic and pPrivate tTrail mMap attached hereto as Exhibit B-3. The exact locations of the Public Trails shall be (i) generally consistent with the approximate locations shown on Exhibit B-3 attached hereto, (ii) determined based on consideration of topography, drainage, existing vegetation and other physical constraints, and (iii) shown in the final plans and specifications therefor as approved by the City. The Public Trails shall be designed and constructed in accordance with the Area Plan and the standards for public trails set forth on Exhibit B-4 attached hereto, and shall be posted with signs stating that the Public Trails will be open to public pedestrian use subject to the City's rules and regulations relating to public trails. The final designs for the Public Trails shall be (i) generally consistent with the conceptual standards shown on Exhibit ▇- ▇ ▇▇▇▇▇▇▇▇ ▇▇▇▇▇▇, (▇▇) based on consideration of topography, drainage, existing vegetation and other physical constraints, and (iii) shown in the final plans and specifications for the Public Trails as approved by the City. The Developer shall cause the Northwest Public Trails to be completed and open for use not later than the opening of the Public Park, and with the prior consent of City may shall have the right to keep the Public Trails closed for purposes of public safety during the course of construction activity at the Resort, or intermittently close portion(s) of the Northwest Trail during construction activities on Parcel 1 (Resort) or Parcel 2 of the (Residences) if, and for so long as, public safety concerns warrant closure as determined by City. Pursuant to City's acceptance of the Affordable Housing Land, the Public Park Land and the Pump Station Land, the City will acquire fee title to the portions of the Public Trails that are on the Affordable Housing Land, the Public Park Land and the Pump Station Land. Public Trails. The parties intend that the off-road trails constructed and maintained pursuant to this MOU are available to the public without any user fees or the purchase of a trail pass. The off-road trail system may be used by bicyclists, hikers, runners, snowshoers, cross-country skiers, or for other uses that are consistent with the use of a trail. While carefully designed to IMBA standards, the off-road bike trails are susceptible to damage from overuse or from any use during wet conditions, and for this reason should not be used for mass start races or any events which by their nature would place a large number of racers or users on the trails at the same time under wet conditions.
