The Redundancy / Severance clause outlines the rights and obligations of an employer and employee in the event that a position is eliminated due to redundancy. Redundancy / Severance. The provisions of this clause do not apply to casual employment or if the company engages15 employees or less. An employee’s job is considered to be redundant if the employer has made a definite decision that the job is no longer required and will not be done by any person due to operational requirements such as economic, structural or technical changes. The employer will consult with employees likely to be effected by a redundancy situation and where possible will attempt to obtain re-employment opportunities for affected employees. An employee who has received notice of termination due to redundancy may terminate their employment during the period of notice and shall be entitled to the same severance payment had they remained until the expiry of such notice. However, such employee shall not be entitled to payment in lieu of notice. The company shall provide employees with one (1) day’s notice of redundancy or pay in lieu of such notice. In addition to the period of notice prescribed above, an employee whose employment is terminated by reason of redundancy shall be entitled to severance pay in accordance with the following table: Completed Years of Service Entitlement 1 year or more but less than 2 years 2.4 weeks pay plus for all service in excess of 1 year, 1.75 hours pay per completed week of service up to a maximum of 4.8 weeks pay 2 years or more but less than 3 years 4.8 weeks pay plus, for all service in excess of 2 years, 1.6 hours pay per completed week of service up to a maximum of 7 weeks pay 3 years or more but less than 4 years 7 weeks pay plus, for all service in excess of 3 years, 0.73 hours pay per completed week of service up to a maximum of 8 weeks pay 4 years or more 8 weeks pay A week’s pay is defined as 38 hours at the employeesrate of pay as provided in this agreement without any allowances. The above Redundancy provisions do not apply in any of the following circumstances: • Where an incoming employer offers to continue the employment of the employee; • Where the Employer transfers the employee to a related company and ensures continuity of service; • Where employment is terminated as a consequence of conduct that justifies instant dismissal, including malingering, inefficiency, misconduct or neglect of duty, or in the case of casual employees, apprentices or trainees engaged for a specific period of time or for a specific task or tasks. Redundancy / Severance a) Subject to Subclause (c) and (d) hereof, employees shall be entitled to a severance payment of $55.00 per completed week of service. Redundancy / Severance. The company will commence contributions to ACIRT on behalf of each employee when he/she has completed 12 months continuous service. The contribution will be at the rate of $25 per week. Contributions will cease when the amount the company has paid into the individual employee's ACIRT account reaches the equivalent of 8 weeks pay. Redundancy / Severance. 33.1 Where the Company decides that the job an employee is doing or a number of employees are doing will no longer be done or no longer be done in the manner in which the work has traditionally been performed, and the decision may lead to termination of employment, the Company will as soon as practicable after that decision meet with the employee or employees concerned to discuss the following: 33.1.1 The reasons for the proposed termination(s). 33.1.2 Measures to avoid or minimise the terminations. 33.1.3 Measures to mitigate any adverse effects of the termination or terminations on the employee(s) concerned. 33.2 Reasons for the terminations might include but not necessarily be limited to organisation change, changes in work practice or procedure or in the nature of work to be performed, technological or equipment change, market forces and diminution of reserves 33.3 To assist the discussions, the Company shall provide as soon as practicable relevant information about the proposed terminations to the employees concerned: 33.3.1 The number of employees normally employed. 33.3.2 The number and classifications of employees likely to be affected. 33.3.3 The reasons for the terminations, and 33.3.4 The period over which the terminations are likely to be carried out and/or the dates on which the terminations are likely to be effected. 33.3.5 Notwithstanding the above, the Company is not required to disclose confidential information if the disclosure of information may be contrary to the Company’s interests. 33.4 Subject to the provisions of clause 19 which may require a longer period of notice to be given, where the Company wishes to terminate the employment of an employee as a result of redundancy, the employee shall be given four (4) calendar weeks written notice of the termination. 33.5 Notwithstanding the provisions in subclause 33.4 above requiring notice to be given by the Company, the employment may be terminated by payment in lieu of the required notice, in which case payment shall be made as if the employee had continued to work as rostered for the whole of the notice period.‌ 33.6 Redundant employees will be entitled to payment on termination of three weeks at the aggregate rate for each completed year of continuous employment with the Company, provided that in no case will an employee be paid in total less than three weeks at the aggregate rate.
