Return from Unpaid Leave of Absence a. Return from leave rights under this provision shall correspond to the period of leave granted. b. Leaves of absence of six (6) months or less: Employees shall be returned to the same or comparable position held at the time of commencement of leave, provided that at the time of the return they have greater seniority than other qualified employees. An employee desiring to return to work before the employee leave is scheduled to end must give the City ten (10) days' written notice of the intent to return. c. Leaves of absence of more than six (6) months: An employee desiring to return to work must give the City ten (10) calendar days' written notice of the intent to return. If a vacancy does not exist at the time such employee decides to return from a leave, the employee’s name shall be placed on the appropriate laid off list in accordance with seniority and qualifications. An employee and the City may agree in writing that an employee will be assured reemployment to the same or comparable position upon return subject to the seniority provisions of this article. Such agreements will be non-precedent setting. d. The current City policy regarding notification of employees pending lay off, in effect at the date of the contract, shall continue to be followed. Any disagreement as to the qualifications of employees in regard to this section may be taken up through the grievance procedure. e. Any employee who fails to return to duty at the end of their unpaid leave will also be treated as a voluntary resignation.
Return from Unpaid Leave of Absence. A. An employee returning from a Short Term Unpaid Leave of Absence shall return to work in the same position, hours and location, and at the same rate of pay the employee would have been at had the employee not been on leave including any negotiated increase in the base rate. B. The employee on a Short Term Unpaid Leave of Absence shall retain accrued pre-leave benefits including seniority and the ability to earn seniority credit during the short term leave. C. If an employee desires to return to work early from an approved Short Term Unpaid Leave of Absence, they may consult with the Director of Human Resources or designee regarding the ending date of the unpaid leave. The Director of Human Resources may make moderate adjustments in the ending date in accordance with the needs of the School District. An early return from an unpaid leave does not necessarily guarantee an automatic early return to the employee’s former position. However, at the expiration of the original agreed upon return date, the employee would retain rights to their former position.
Return from Unpaid Leave of Absence. To return from an unpaid leave of absence for medical reasons, an employee must provide a statement from a physician that releases the employee to come back to work. An employee who is required, or wishes to return to the CDL list in accordance with legal requirements following a leave of absence for medical reasons during which the employee does not receive a City paycheck of more than 30 calendar days must successfully complete an alcohol and drug test before returning to work. Failure to inform the District by that date will result in termination. The District will inform the employee on leave of this condition of the contract. Unpaid leave requests shall specify the dates the unit member wishes to begin and end the unpaid leave.
