Return to Work from Leave of Absence. An employee returning to work after a leave of absence shall notify the Board of the employee's intent to return at least thirty (30) days prior to the expiration date of the leave of absence. An employee returning to work from a leave of absence from personal illness or medical disability during the 180 calendar day "waiting period," or employees returning to work from a workers’ compensation disability leave shall also submit a physician's statement indicating the employee's ability to return to employment and to perform the employee's essential duties. Employees who do not return to work during the 180 calendar day waiting period, and who go on a medical leave of absence shall not be permitted to return to work prior to the last approved date of the leave of absence. The employee's right to return to work shall be subject to the following and also subject to the provisions of the "Layoff" article. Any employee who fails to return to work, or to provide the notices required herein, consistent with the Board’s reasonable time requirements, shall be deemed to have resigned and to have terminated employment with the school district, unless an extension of the leave of absence has been granted:

An employee returning to work from a leave of absence for personal illness or medical disability shall submit a physician’s statement indicating the employee’s ability to return to work and perform employee’s essential job duties (with or without restrictions). Any employee who, consistent with the Board’s reasonable time requirements, fails to request an extension of the leave of absence or fails to return to work, or fails to provide the required physician’s statement, shall be deemed to have resigned and the employee’s employment with the school district shall be terminated. The employee’s right to return to work shall be subject to the following:
Return to Work from Leave of Absence. (a) An employee who returns to work after a leave of absence as described in Sections 1-5 of this Article will be reinstated in the job classification group which he left and for which he is qualified provided he has more seniority than the least senior employee in said job classification.
(b) Unless excused, an employee who does not return to work within five (5) days following the expiration of his leave of absence will be considered as having resigned voluntarily and will forfeit all of his seniority rights.
Return to Work from Leave of Absence. (a) Before a Nurse may return to work from a leave granted under Article 9.00, she or he must provide a minimum of four (4) weeks written notice of the specific date of his or her return to work, or such shorter time as mutually agreed. This clause requiring four (4) weeks written notice, does not apply to other leaves granted by an express provision of this Collective Agreement with different requirements for written notice.
(b) Upon return from an approved Unpaid Leave of Absence, a Nurse shall be reinstated to her or his former position and status unless the position has been discontinued, in which case the Nurse shall be appointed to an equivalent position and status. A Casual Nurse shall be returned to the Nurse's previous Casual Status.
Return to Work from Leave of Absence. An Employee shall not lose seniority rights if he/she is absent from work because of sickness, or a compensable accident. An Employee returning to work after any of the above reasons shall return to the same job with the same hours as previously worked, as long as the job is available and the Employee is physically and mentally able to perform the work. The Employer may request medical verification of an Employee's ability to resume his/her work duties.
Return to Work from Leave of Absence. Section 11.1 An employee with seniority returning from a leave of absence shall be returned to his former position if possible; if not, to a position designated by the Public Works Director in his discretion, for which the employee is qualified and to which the employee's seniority entitles him, at the appropriate step on the pay scale.
Section 11.2 A probationary employee returning from a leave of absence may be returned to an available vacancy designated by the Public Works Director in his discretion, for which the employee is qualified.
Return to Work from Leave of Absence. An employee on an Occupational Injury/Illness Leave of Absence cannot return to work without the written approval of a medical doctor. The returning employee will be placed in the same position held at the time of leaving, or one as nearly like it as possible. If no job opening exists for which the employee is qualified he/she will be placed on a preferred hiring list. Employees returning from a medical leave of absence for maternity reasons within and including the four (4) months will have her position, or a comparable position, waiting for her upon her timely return from leave. The returning employee must provide his/her immediate supervisor with at least two (2) weeks written advance notice of the date the employee intends to return to work. After the employee receives supervisory approval of his/her return to work date, and then fails to report to work on the date confirmed with the immediate supervisor, the Employee with be terminated.
