Common use of Scheduling System Clause in Contracts

Scheduling System. CLW and the Union recognize CLW’s ongoing need to improve its scheduling system. CLW and the Union also further understand and support the significance of the proper implementation and execution of any new scheduling system. CLW therefore acknowledges and agrees that prior to the replacement of its scheduling system, advance discussions will take place between CLW and the Union, in order that the Union is kept properly apprised of the matter. In the event, therefore, that CLW implements a new scheduling system the Union will have an opportunity to identify any/all issues/concerns that may arise with the new scheduling system for the purposes of discussing any and all necessary solutions thereto. New contract language that relies upon the scheduling system updates shall not be subject to grievances by the Union or discipline by the employer until such time as they are fully implemented. The parties agree to endeavor to convene a meeting at least every sixty (60) days to review the status and progress of the implementation of the system. Further to our discussions during negotiations, this is to confirm that the Employer and the Union have agreed to bring the issue of retiree benefits to the Labour Management Committee for discussion. This will also confirm that the Employer will take any agreements reached by the Committee with respect to this issue to its Board of Directors and will recommend ratification of same by the Board. (Ontario Registered Pension Plan) In the event that the Ontario government establishes an Ontario Registered Pension Plan, the Union and the Employer will use their best efforts to encourage the Multi Sector Pension Plan (MSPP) to ensure comparability as a workforce pension plan and for the MSPP to provide the union and the Employer with any information required for pension registration.
