Security of the Service Clause Samples
The 'Security of the Service' clause defines the obligations and standards related to protecting the service and its associated data from unauthorized access, breaches, or other security threats. Security of the Service. 1. Elements of the network infrastructure used to process personal data are secured against the loss of accessibility through application and provision of maintenance services provided by producers and distributors.
2. Periodical independent tests of the vulnerability of IT systems that process personal data to threats are carried out.
3. Security gaps are periodically scanned on the platforms and in the networks that process personal data so that general security standards connected specifically with system reinforcement are complied with.
4. As a result of penetration tests, vulnerability scanning and compliance assessment, a corrective program is run on a periodic basis according to a risk-based approach to make effective use of the tests’ results.
5. A training program regarding the rules of secure software has been developed and provided.
6. A software security testing program has been developed and provided.
7. The subcontractor and provider selection rules that have been developed guarantee adequate level of technical and organizational security of the services provided and the tasks performed.
8. The sub-processors and other service providers auditing standards and mechanisms have been developed and their implementation has been guaranteed.
Security of the Service. 8.1 HBT provides no guarantee or warranty as to the security of the Service and the Customer shall indemnify, keep indemnified and hold harmless HBT from and against any claim or demand of whatsoever nature and howsoever arising as a result of the said security or any failure thereof.
8.2 Where the Customer is aware or becomes aware of any matter which the Customer knows or ought reasonably to be expected to know constitutes a threat to the security of the Service, then the Customer has a duty pursuant to this Contract immediately to advise HBT of such matter.
8.3 The Customer is responsible for all use and misuse of any User IDs and Passwords giving access to the Service and must take all necessary steps to ensure that they are kept confidential, secure, used properly and not disclosed to unauthorised people.
8.4 Customer acknowledges that the Service may impair, or be impaired by, the uploading or downloading of data and/or the making or receiving of simultaneous Calls using the same broadband enabled connection, or by other circumstances beyond HBT’s reasonable control.
Security of the Service. SERVI-CLOUD DOMINICANA and/or its hosting provider implements security measures in accordance with the best standards in force, within the framework of a best-efforts obligation, against unauthorized access or Data breaches. It ensures the software and physical locking of the infrastructure. However, the Reseller is solely re- sponsible for securing its own computer system and web access, and in particular for implementing firewalls, antivirus software or any other means of security to protect its system and ensure integrity of access to resources.
Security of the Service. 7.1 ACUTEC provide no guarantee or warranty as to the security of the Services and the Client shall indemnify and hold ACUTEC harmless against any claim or demand of whatsoever nature and howsoever arising as a result of the said security or any failure thereof.
7.2 Where the Client is aware or becomes aware of any matter which the Client knows or ought reasonably to be expected to know constitutes a threat to the security of the Services, then the Client has a duty pursuant to this Contract immediately to advise ACUTEC of such matter.
7.3 The Client is responsible for all use and misuse of any passwords giving access to the Services.
7.4 ACUTEC and its Third Party Service Providers and/or other sub-contractors shall be entitled to inspect and monitor from time to time all usage being made of the Services including communications being made and received to verify compliance with this Contract.
7.5 ACUTEC may at any time vary the Services:
7.5.1. If it needs to do so to comply with any applicable safety or other statutory requirements; or 7.
Security of the Service. MC3 and/or its hosting provider implements security measures in accordance with the best standards in force, within the framework of a best-efforts obligation, against unauthorized access or Data breaches. It ensures the software and physical locking of the infrastructure. However, the Reseller is solely responsible for securing its own computer system and web access, and in particular for implementing firewalls, antivirus software or any other means of security to protect its system and ensure integrity of access to resources.
Security of the Service. Autotech shall take measures to ensure the security of the Service, by evaluating operations, systems, networks and applications to protect the Customer's data. This is done, for example, by scanning and monitoring operations, systems and networks, perform continuous backups, secure communication and data transfer through HTTPS and ensure encryption of sensitive data. The application is kept secure through, among other things, security by design, separated development environments and product security functions such as login authentication and the possibility of Single Sign On (SSO).
Security of the Service. Throughout the term of applicability of this ▇▇▇▇, HappyOrNot will maintain a data security program for the Service that will include reasonable administrative, physical, technical, organizational, and other security measures to protect against unauthorized access to, destruction, loss, unavailability, or alteration of, Subscriber’s Data processed or stored by the Service. HappyOrNot shall not be responsible or liable for any deletion, correction, damage, destruction, or loss of Subscriber Data that does not arise from a breach of this ▇▇▇▇ by HappyOrNot, or where any such deletion, correction, damage, destruction, or loss of Subscriber Data is attributable to the act or omission of the Subscriber.
Security of the Service. 7.1 Customer acknowledges that the Service must be accessed using unique user login identifications and passwords, and agrees that it has sole responsibility for the creation of such unique identifiers and for maintaining the confidentiality and security of the passwords used to access the Service. bioMérieux shall have no liability to Customer or any third party’s unauthorized access to the Service resulting from a failure of Customer to maintain the confidentiality and security of their passwords.
7.2 Customer acknowledges that the EPISEQ® Platform and Applications are not security software products and do not offer protection against the transmission of viruses, hacking or other attempts to gain unauthorized access to the Customer’s network. Customer will not access, store, distribute or transmit any viruses, and bioMérieux may, without liability to Customer, disable Customer’s access to the Service if Customer is in breach of this clause or in the event of an attack emanating from the Customer’s connection point.
Security of the Service. Service Provider"’s data security program for the Service will: (a) include reasonable security measures to protect against unauthorized access to any Customer Data residing in the Service; and (b) comply with PCI DSS. "Service Provider" will not be responsible or liable for any deletion, correction, damage, destruction or loss of Customer Data that does not arise from a breach by "Service Provider" of its obligations under this Agreement.
Security of the Service. PV’s data security program for the Service will: (a) include reasonable security measures to protect against unauthorized access to any Customer Data residing in the Service; and (b) comply with PCI DSS. PV will not be responsible or liable for any deletion, correction, damage, destruction or loss of Customer Data that does not arise from a breach by PV of its obligations under this Agreement.
