Service Limitation. We are not responsible for and will not pay or otherwise reimburse you for special, secondary, incidental, indirect, consequential, exemplary, or other related damages resulting from any delay or neglect, whether due to our or the Service Contractor’s delay or neglect in providing, or failing to provide, repair or replacement of such Covered Item, including, but not limited to, food spoilage, loss of income, utility bills, additional living expenses, or personal and/or real property damage.
Service Limitation. SBA shall not permit and is under no obligation to notify the Accountholder/Cardholder for the following: (a) transaction that will result in an overdraft or close the Account/Card; (b) transfer and payment from an Account/Card in an “Unavailable” status such as dormant or expired, or (c) transfer and payment from an Account/Card that is subject to legal process or other encumbrance restricting the transaction.
Service Limitation. Client acknowledges and agrees that:
(a) KMO’s ability, and obligation, to provide the Services is subject to Client complying with its obligations under clause 6.1 and any other limitation or exclusion set out in this Master Services Agreement and any applicable Order Document;
(b) unless otherwise expressly included in an Order Document, the cost of third party application support consumables, software, network upgrades and any associated services are outside the scope of the Services and are the full responsibility of the Client;
(c) unless otherwise expressly included in an Order Document, the maintenance or support of any Deliverables, any server upgrades, network device upgrades and software upgrades are outside the scope of this Agreement;
(d) unless otherwise expressly included in an Order Document, KMO is under no obligation to backup or otherwise retain data or applications not included in the Services;
(e) if an Order Document dictates that KMO is to perform any search engine optimisation services, KMO’s obligations extend only to the algorithm used by Third Party search engine operators to determine the relevant search engine ranking at the commencement date of the Order Document. Changes to any search engine algorithms connected with the Services to be provided under an Order Document subsequent to the commencement date of the Order Document are outside of the scope of this Agreement;
(f) where KMO is engaged under an Order Document to provide digital marketing services via the management of Client social media accounts or the provision of AdWords services, such services do not extend to:
(1) the moderation of any content posted on the Client’s social media pages by social media users other than KMO;
(2) ensuring compliance with any industry- specific rules, Laws or guidelines or similar concept governing Client’s conduct on social media, advertising practices or interactions with its clients or customers; and
(3) advising Client on, or ensuring compliance with, the legality or legal ramifications of any content it posts, shares, endorses, or directs KMO to post, share or endorse, on its social media pages;
(g) Where KMO is engaged under an Order Document to provide digital marketing services via the management of marketing emails, such services do not extend to compiling or maintaining Client contact or customer lists;

Service Limitation. The Maintenance does not include, nor will CocoNET be obligated to provide, services required as a result of: (i) any modification, reconfiguration or maintenance of the Software not performed or recommended by CocoNET; (ii) any use of the Software on a system that does not meet CocoNET’s minimum standards (iii) any third‐party hardware or software not supported or embedded by CocoNET; (iv) any configuration of the Software (or hardware configurations) other than as recommended by CocoNET; or (v) any error caused by Cosmetic Physicians College of Australasia, CPCA 's or any third party's negligence, abuse, misapplication, or use of Software other than as expressly permitted under the Agreement.
Service Limitation. The Accountholder/Cardholder shall not be able to process the following transactions: (a) fund transfer and payment from an Account/Card in an “Unavailable” status such as dormant or expired, or (b) fund transfer and payment from an Account/Card that is subject to legal process or other encumbrance restricting the transaction.
Service Limitation. The Services may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. While We designed the Platform and the Service to provide a secure system, no security systems are fail-safe or immune from unauthorized intrusion; thus, You acknowledge and represent that such contingencies may occur, that You have evaluated this and accept such limitations. As a consequence, We shall not be responsible for any delays, failures, or other damage resulting from such problems and the Limited Warranty does not apply to the foregoing.

In the event that there is no Internet connection established between a Customer’s Device(s) at a Site and the 75F network through which Facilisight is offered, or such connection becomes inoperable during the term of service, 75F will not have access to Site data and Facilisight will be significantly limited.

Client acknowledges that Consultant’s services are limited to recommendations, and that nothing in this Agreement requires Client to implement or follow any recommendation or investment advice provided by IAR and that the implementation of all (or any portion) of IAR’s recommendations or investment advice is at the discretion of Client. Consultant shall cooperate with any investment manager, trustee, attorney, accountant, or broker-dealer chosen by Client with regard to implementation of any recommendations.
