Shift Work. ‌ (1) Except as varied by this Clause, all other aspects of Section 4 of the Agreement shall apply to the working of shift work. (2) The Company has the right to direct Employees to work shift work as required and the Employees shall work the shift work as directed. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holiday. (7) A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift Work. ‌ (1) Except Where agreed between Employer and Employee, shift work may be worked to meet exceptional circumstances, such as varied by this Clause, all other aspects of Section 4 where general site conditions prohibit the performance of the Agreement work during ordinary hours. Nothing in this clause shall apply be taken to limit the working of shift work. (2) The Company has the right Employer’s ability to direct Employees to work shift work as required and utilising overtime provisions to perform the Employees shall work the shift work as directedin question outside ordinary hours. Shift work must be for no less than 1 week at a time and always for a full week. No shift work will be undertaken during the ordinary hours of work, being 6:00 am to 6:00 pm, or between noon Saturday and 6:00 am Monday. No shift shall be for more than 8 continuous hours, excluding meal breaks. The unpaid crib break of shift workers shall be 45 minutes or, where the Employer and Employees agree, 30 minutes to suit particular circumstances. Employees performing shift work will receive normal daily fares and travel. There will be one 30-minute paid break in lieu of all other rest and meal breaks. Alternatively, the Employer and Employee may agree to have two paid rest breaks of 10 minutes each per day, one in the first half of the day and one in the second half of the day , as well as an unpaid meal break of not less than 30 minutes, to be taken between noon and 1:00 pm. No Employee will work more than 4 hours without a break. An Employee required to work overtime for at least 1.5 hours after working ordinary hours will be paid a meal allowance in accordance with Appendix 3 plus an additional meal allowance for each subsequent 4 hours worked. The Employer may provide a meal(s) instead of paying an allowance. When an Employee is rostered to work 3 or more hours overtime the Employee is entitled to a paid rest break of 20 minutes immediately after ordinary hours ceasing time. Where this break is not taken, the 20 minutes will be added to the total overtime worked and paid for in accordance with this subclause. (3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as such. Shift Work. (12) Workers on regular afternoon shift in the case of two roster shifts or on regular night shift to include one (1) half-hour rest break to work - the cause of 3 roster shifts work the week following the afternoon shift work or the night shift as the case may be taken without deduction of pay by Employees working the Project Working Hours on any night day shift.

Shift Work. ‌ (1) Except as varied by this Clause, all other aspects of Section 4 of the Agreement The following conditions shall apply to shift work: 17.1 The ordinary hours of the particular shifts should be the subject of Agreement between the employer, except where employees are working shift hours as determined by the roster applying to the majority of shift workworkers at the employee’s workplace. Shift Work. ‌ (1) Except as varied by this Clause, all other aspects of Section 4 Part 5 of the Agreement shall apply to the working of shift work. (2) . The Company Employer has the right to direct Employees to work shift work as required and the Employees shall work the shift work as directed. Shift work will be worked and paid for in accordance with this subclause. (3) . Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - 27 – Ordinary Hours of Work of this Agreement and when Employees are working as such. (4) . Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) . Prior to the commencement of shift work, the Company Employer shall seek the agreement of the Employees involved. Failing agreement, the Company Employer will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) . Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holiday. (7) . A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

(j) In addition to the wages paid under this Agreement, Employees on night shift shall receive be paid a flat loading of twenty-five (25) percent % of their the Ordinary Hourly Rate of Pay for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. Shift Work. ‌ (1) Except Where agreed between Employer and Employee, shift work may be worked to meet exceptional circumstances, such as varied by this Clause, all other aspects of Section 4 where general site conditions prohibit the performance of the Agreement work during ordinary hours. There will be one 30-minute paid break in lieu of all other rest and meal breaks. Alternatively, the Employer and Employee may agree to have two paid rest breaks of 10 minutes each per day, one in the first half of the day and one in the second half of the day , as well as an unpaid meal break of not less than 30 minutes, to be taken between noon and 1:00 pm. No Employee will work more than 4 hours without a break. An Employee required to work overtime for at least 1.5 hours after working ordinary hours will be paid a meal allowance in accordance with Appendix 3 plus an additional meal allowance for each subsequent 4 hours worked. The Employer may provide a meal(s) instead of paying an allowance. When an Employee is rostered to work 3 or more hours overtime the Employee is entitled to a paid rest break of 20 minutes immediately after ordinary hours ceasing time. Where this break is not taken, the 20 minutes will be added to the total overtime worked and paid for in accordance with this subclause. (8) Employees working night g) Annual Leave - In addition to the benefits provided by section 3 of the Annual ▇▇▇▇▇▇▇▇ ▇▇▇, ▇▇▇▇ (▇▇▇), with regard to an annual holiday of four weeks, an employee who, during the year of their employment with the Company with respect to which they become entitled to the said annual holiday of four weeks, gives service to the Company as a seven-day shift worker, shall be entitled to stop the additional leave as hereunder specified:- If during the year of their employment they have served the Company continuously as a seven-day shift worker the additional leave with respect to that year shall be one week. if during the year of their employment, they have served for only portion of it as a seven-day shift worker the additional leave shall be one day for every thirty-three ordinary shifts worked as a seven-day shift worker; An employee shall be paid for such additional leave at the annual leave rate of pay, for the number of ordinary hours of work which those employees would have been rostered for duty during the period of additional leave; where the additional leave calculated under this subclause is or includes a halffraction of a day such fraction shall not form part of the leave period and any such fraction shall be discharged by payment only; In this clause reference to one week and one day shall include holidays and non-hour without deduction working days. A seven-day shift worker under this subclause shall be paid at the appropriate rate for any ‘compulsory roster’ shift, also known as a ‘roster shift’ which they would have worked during this period of annual leave had they not been on annual leave. (h) Days added to the period of Annual Leave. (a) An employee who is rostered off duty on a day which is a prescribed holiday and who is not required to work on that day shall: have one day added to their annual leave period; or by mutual consent, be paid, in the pay for the purpose period in which the holiday falls, for the holiday at the rate payable pursuant to the award. For the purposes of this Agreement: (a) day shift means any shift starting after 8:00am and finishing at or before 6:00pm; (b) afternoon shift means any shift finishing after 6:00pm and at or before midnight; and (c) night shift means any shift finishing after midnight and at or before 8:00am. Shift workers, other than casuals, whilst on afternoon or night shifts, shall be paid 20% more than ordinary rates for such shifts. Shift workers, classified in accordance with Appendix 2, employed on a permanent night shift will, for work done during ordinary hours of any such shift, be paid ordinary rates plus an additional 30%. For the avoidance of doubt an employee employed on permanent night shift, is an employee who works on a night shift and does not rotate or alternate with another shift or with day work. Casuals whilst on afternoon or night shifts, shall be paid 15% more than the ordinary rates which incorporate casual loading, for such shifts. All time worked in excess of the ordinary hours for the shift shall be paid for as though overtime at the rate of double time on ordinary rates, provided that all work performed on public holidays shall be paid for at double time and one half. At the request of an Employee, the Company and the Employee may agree to compensate the working of overtime by allowing an equivalent amount of time off for actual time worked, i.e. one hour of overtime will accrue one hour of time off. The taking of such time shall be determined by agreement between the Company and the Employee concerned. Where shift work is adopted, shifts shall, as far as practicable, rotate regularly, and where two shifts are worked, one shall be regarded as the day shift, and the second, the afternoon or night shift. Where three shifts are worked they shall be divided into day, afternoon and night shift. No Employee shall work for more than four and a half hours without a break for a meal except in the following circumstances where up to six hours may be worked without a break for a meal by agreement with the Employee concerned: (a) where a casual Employee or a part-time Employee is engaged to work no more than six hours in any one day; (b) where weekly Employees are working their ordinary hours on the basis of a short day each week. 30 minutes shall be allowed to shift workers each shift for crib, and shall be counted as time worked. Where shifts are worked pursuant to this Agreement, the Company shall have the right to decide and shall decide forthwith or before the commencement of such shift work, which of the shifts shall be the day shift and shall notify each Employee concerned accordingly. The Company shall, while shift work is being worked, exhibit and keep exhibited at the place at which shifts are worked, in a place to which the Employees have access, a notice specifying the times at which each shift shall commence and finish and which of the shifts is deemed to be the day shift. The changing of shifts shall be by mutual arrangement between the Company and the Employee. Shift workers whose working period includes a Saturday, Sunday or any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at holidays specified in clause 16 - Hours of Work of this Agreement and when Employees are working as such. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Shift Work. ‌ (1) Except 7.1 The ordinary hours of shift work shall average 38 per week including such time as varied by this Clause, all other aspects of Section 4 of the Agreement mutual agreement may be taken for meals and shall apply to not exceed 152 hours in 28 consecutive days. A paid meal break shall not be provided for a driver/conductor during the working of a split shift workand therefore time taken for meals between split shifts will not count for inclusion in the average hours of 38 per week. Shift Work. 12.1 The following clauses relating to shift work do not relate to continuous shift processing operations (continuous 7 days per week operations). If during the term of this agreement the employer decides that one or more of its operations have a requirement for continuous operations then an amendment to this agreement will be negotiated with the effected employees. Shift Work. (a) The loading on the ordinary rates of pay for a Caregiver who works an afternoon shift commencing not earlier than 12.00 noon and finishing after 6.00 pm on weekdays shall be 12.5%. Shift Work. 19.1 Employees may be required to work shift work under a roster (or as otherwise directed). Shift Work. Where, by agreement between the employer and a Health Worker, the Health Worker is employed within a hospital setting and is rostered to work shifts, the provisions of this clause will apply. Afternoon/Night Shifts (1) Except as varied by this Clause, all other aspects 12.1 A Health Worker who works a complete rostered afternoon shift commencing not earlier than 12 noon and finishing after 6 pm on week days shall receive a loading on the ordinary rates of Section 4 pay of the Agreement shall 12.5%. Shift Work. ‌ (1) Except as varied by 19.1 For the purpose of this Clause, all other aspects clause "Afternoon/Night Shift" shall mean a shift on which the majority of Section 4 of the Agreement shall apply to the working of shift workordinary hours are worked after 6:00pm. (6i) Where any particular process is carried out on shifts other than day shift, and less than five (5) consecutive afternoon or five (5) consecutive night shifts are worked on that process, then Employees employed on such afternoon or night shifts shall be paid at overtime rates rates. Provided that where the ordinary hours of work normally worked in lieu the workplace are worked less than five (5) days then the provisions of the shift loading prescribed at subclause sub-clause 19.5(i) shall be as if four (74) consecutive shifts were substituted for five (5) consecutive shifts. (ii) The sequence of this clause. The consecutive nature of shifts will work shall not be deemed to be broken if under the preceding sub-clause, by reason of the fact that work on the process is not carried out on a Saturday, Saturday or Sunday, RDO or on any other day that the Company observes a shutdown for the purpose of allowing a thirty six (36) hour week or on any public holiday. Shift Work. 6.4.1 The ordinary hours of employees undertaking shift work or continuous shift work shall not exceed an average of 38 ordinary hours within the work cycle. (16.4.2 The ordinary hours of employees undertaking shift work shall not exceed eight hours per shift unless mutually agreed between the employer and the employees concerned. The agreements reached for the working of 12 Hour Shift Work Conditions by Production Employees are contained in Appendix E of this Agreement. 6.4.4 The relevant Union shall be provided with a copy of all such written agreements within 14 days of commencement of work under such arrangements. 6.4.5 Different methods of working shifts may apply to various workgroups or sections of employees. 6.4.6 No afternoon or night shift shall be recognised as such unless the shift work operation is scheduled for at least four days. 6.4.7 All employees (including employees relieving on shift) will receive the allowances and loadings outlined in this clause when they undertake shift work. (2) The Company has 6.4.8 An employee undertaking an afternoon shift will receive an allowance of 15% more than the right ordinary rate. This allowance will apply to direct Employees ordinary hours only on an afternoon shift. 6.4.9 An employee undertaking a night shift will receive an allowance of 20% more than the ordinary rate. Shift Work. ‌ (1) Except Where agreed between Employer and Employee, shift work may be worked to meet exceptional circumstances, such as varied by this Clause, all other aspects of Section 4 where general site conditions prohibit the performance of the Agreement work during ordinary hours. Nothing in this clause shall apply be taken to limit the working of shift work. (2) The Company has the right Employer’s ability to direct Employees to work shift work as required and utilising overtime provisions to perform the Employees shall work the shift work as directedin question outside ordinary hours. Shift work must be for no less than 1 week at a time and always for a full week. No shift work will be undertaken during the ordinary hours of work, being 6:00 am to 6:00 pm, or between noon Saturday and 6:00 am Monday. No shift shall be for more than 8 continuous hours, excluding meal breaks. Shift workers shall be paid 187.5% of the respective wage for ordinary hours of work. The unpaid crib break of shift workers shall be 45 minutes or, where the Employer and Employees agree, 30 minutes to suit particular circumstances. Employees performing shift work will receive normal daily fares and travel. There will be one 30-minute paid break in lieu of all other rest and meal breaks. Alternatively, the Employer and Employee may agree to have two paid rest breaks of 10 minutes each per day, one in the first half of the day and one in the second half of the day , as well as an unpaid meal break of not less than 30 minutes, to be taken between noon and 1:00 pm. No Employee will work more than 4 hours without a break. An Employee required to work overtime for at least 1.5 hours after working ordinary hours will be paid a meal allowance in accordance with Appendix 3 plus an additional meal allowance for each subsequent 4 hours worked. The Employer may provide a meal(s) instead of paying an allowance. When an Employee is rostered to work 3 or more hours overtime the Employee is entitled to a paid rest break of 20 minutes immediately after ordinary hours ceasing time. Where this break is not taken, the 20 minutes will be added to the total overtime worked and paid for in accordance with this subclause. (3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as such. If 24 hours notice is not given, and the employee transfers to day work, the overtime rate shall apply until the 24 hours notice would have occurred. c) LONG TERM SHIFT WORK - Shall mean work performed daily in recurrent periods, mainly outside of the ordinary hours defined in Clause 9 – Hours of Work, and for a period of more than 50 days (inclusive of weekends). (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The overtime rates applicable shall be paid at the rate of time and a half for the first two hours and double time thereafter. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holiday. (7) A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken taken, without deduction of pay pay, by Employees working the Project Working Hours on any night shift.

Shift Work. 6.4.1 Employees accept to undertake Afternoon or Night Shift work when required.
