Common use of Shift Work Clause in Contracts

Shift Work. ‌ (1) Except as varied by this Clause, all other aspects of Section 4 of the Agreement shall apply to the working of shift work. (2) The Company has the right to direct Employees to work shift work as required and the Employees shall work the shift work as directed. Shift work will be worked and paid for in accordance with this subclause. (3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as such. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holiday. (7) A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift work will be worked and paid for in accordance with this subclausesub-clause. (3b) Shift work is deemed to be any arrangement of Project Working Hours working hours where the majority of the Ordinary Hours ordinary hours are worked outside of the spread of Ordinary Hours defined at hours specified in sub-clause 16 - Hours of Work of this Agreement (1) hereof and when Employees employees are working as such. Shift Work. ‌ (1) Except Where agreed between Employer and Employee, shift work may be worked to meet exceptional circumstances, such as varied by this Clause, all other aspects of Section 4 where general site conditions prohibit the performance of the Agreement work during ordinary hours. Nothing in this clause shall apply be taken to limit the working of shift work. (2) The Company has the right Employer’s ability to direct Employees to work shift work as required and utilising overtime provisions to perform the Employees shall work the shift work as directedin question outside ordinary hours. Shift work must be for no less than 1 week at a time and always for a full week. No shift work will be undertaken during the ordinary hours of work, being 6:00 am to 6:00 pm, or between noon Saturday and 6:00 am Monday. No shift shall be for more than 8 continuous hours, excluding meal breaks. The unpaid crib break of shift workers shall be 45 minutes or, where the Employer and Employees agree, 30 minutes to suit particular circumstances. Employees performing shift work will receive normal daily fares and travel. There will be one 30-minute paid break in lieu of all other rest and meal breaks. Alternatively, the Employer and Employee may agree to have two paid rest breaks of 10 minutes each per day, one in the first half of the day and one in the second half of the day , as well as an unpaid meal break of not less than 30 minutes, to be taken between noon and 1:00 pm. No Employee will work more than 4 hours without a break. An Employee required to work overtime for at least 1.5 hours after working ordinary hours will be paid a meal allowance in accordance with Appendix 3 plus an additional meal allowance for each subsequent 4 hours worked. The Employer may provide a meal(s) instead of paying an allowance. When an Employee is rostered to work 3 or more hours overtime the Employee is entitled to a paid rest break of 20 minutes immediately after ordinary hours ceasing time. Where this break is not taken, the 20 minutes will be added to the total overtime worked and paid for in accordance with this subclause. (3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as such. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday nightaccordingly. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. The third shift (graveyard shift) shall consist of eight (8) consecutive hours worked beginning at a start time between 8:01 p.m. and 4:59 a.m. Workmen on the "graveyard shift" shall be paid at the regular hourly rate of pay plus 31.4% for all hours worked. If the parties to the Agreement mutually agree, the shift week may commence with the third shift (graveyard shift) beginning before 4:59 a.m. Monday (which would normally be any arrangement of Project Working Hours where the majority considered part of the Ordinary Hours are worked outside of Sunday workday) to coordinate the spread of Ordinary Hours defined work with the customer's work schedule. However, any such adjustment shall last for at clause 16 - Hours of Work of this Agreement and when Employees are working as such. All overtime work required after the completion of eight (8) hours of any shift shall be paid at one and one-half times the "shift" hourly rate. There shall be no pyramiding of overtime rates in lieu and double the straight rate shall be the maximum compensation for any hour worked. There shall be no requirement for a first shift (day shift) when either the second shift (swing shift) or third shift (graveyard shift) is worked. The shift rate of pay is determined by the start time of the shift loading prescribed at subclause (7) of this clause. (b) On "Casual Shift Work" that is on one weekly shift only worked in any department, casual day, afternoon and night shifts to start and finish at the times respectively referred to in the preceding paragraph. Failing agreement, week will begin on Sunday at 11.30pm and the Company will provide to the Employees concerned one (1) week's notice last shift of the commencement of shift work week shall finish at 11.30pm on Friday. Duty Rosters shall be posted on Friday in each week and shall show the starting and finishing times of Ordinary Hours each worker during each week. Particulars relating to these starting and finishing times shall be rigidly adhered to. (3) The provisions contained in the previous subclause of this clause may be varied by mutual agreement between the shiftsemployer and the Union. (4) All workers employed on regular day shift work shall be paid an allowance equal to ten percent of their ordinary weekly rate of pay. (5) All workers employed on a regular afternoon shift shall be paid an allowance equal to 15 percent of their ordinary weekly rate of pay. (6) Where less than five (5) consecutive shifts are worked then Employees All workers employed on casual afternoon shift work shall be paid at overtime rates in lieu an allowance equal to 17½ percent of the shift loading prescribed at subclause (7) their ordinary weekly rate of this clause. Except as aforesaid the Project Working Hours above allowances shall not be included for Employees working the purpose of calculating any other penalty rates under this Agreement. (11) Where less than five consecutive afternoon or five consecutive night shifts are worked, workers employed on such afternoon or night shifts shall be paid for such shifts at overtime rates; provided that time not worked on a Saturday or a Sunday shall not constitute a break in the sequence of shifts for the purpose of this subclause. (12) Workers on regular afternoon shift in the case of two roster shifts or on regular night shift to include one (1) half-hour rest break to work - the cause of 3 roster shifts work the week following the afternoon shift work or the night shift as the case may be taken without deduction of pay by Employees working the Project Working Hours on any night day shift.

Shift Work. ‌ (1) Except as varied by this Clause, all other aspects of Section 4 of the Agreement The following conditions shall apply to shift work: 17.1 The ordinary hours of the particular shifts should be the subject of Agreement between the employer, except where employees are working shift hours as determined by the roster applying to the majority of shift workworkers at the employee’s workplace. (2) The Company has 17.2 Thirty minutes crib time shall be granted in respect of each shift of eight hours. Employees working twelve hour shifts shall be allowed reasonable crib breaks as agreed between the right to direct Employees to work shift work as required employer and the majority of the employees in the enterprise or part of the enterprise concerned. 17.3 Employees working afternoon or night shift over a five day roster shall be paid the following shift allowances, calculated as a percentage of the ordinary rate of salary for the appropriate job classification: 17.4 In this clause the following definitions apply: 17.5 An employee working a non-continuous shift roster which requires work the shift work as directed. Shift work on either Saturday or Sunday but not both days will be paid a shift allowance for each shift worked on either Saturday or Sunday. The Allowance will be reviewed annually. 17.6 An employee working a non-continuous shift roster which requires work on both Saturday and Sunday will be paid a shift allowance for each shift worked on both Saturday and Sunday. Such payments are in lieu of the allowances provided for in 17.3. The Allowance will be reviewed annually. 17.7 For the purpose of this clause, Saturday or Sunday shifts are those shifts occurring between twelve midnight Friday and 11.00 p.m. Sunday, or 8.00 17.8 Employees working a seven day continuous roster shall be paid an allowance in lieu of afternoon and night shift allowances, weekend penalty rates and payment for any rostered overtime shift included in the cycle. This allowance shall be determined at each location by the employer and the Association. Provided that employees working a seven day continuous roster which operates over a four week, 38 hours per week, roster cycle shall be paid a shift allowance of 40% of ordinary salary for time worked. 17.9 Shift allowances prescribed by this clause will not be payable where the time worked attracts an overtime payment in accordance with this subclauseAgreement. (4) . Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) . Prior to the commencement of shift work, the Company Employer shall seek the agreement of the Employees involved. Failing agreement, the Company Employer will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) . Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holiday. (7) . A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift Work. ‌ (1) Except as varied by this Clause, all other aspects of Section 4 of the Agreement shall apply to the working of shift work. (2a) The Company Employer has the right to direct Employees to work perform shift work as required to meet operational requirements and the Employees Employee shall work the perform shift work as directed. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accruecycle. (5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. To avoid doubt, the paid meal break will not be counted as time worked. (i) The Employer may stagger the times Employees take rest periods and meal breaks to suit the operational requirements of the Project. (j) In addition to the wages paid under this Agreement, Employees on night shift shall receive be paid a flat loading of twenty-five (25) percent % of their the Ordinary Hourly Rate of Pay for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift Work. ‌ (1) Except Where agreed between Employer and Employee, shift work may be worked to meet exceptional circumstances, such as varied by this Clause, all other aspects of Section 4 where general site conditions prohibit the performance of the Agreement work during ordinary hours. Nothing in this clause shall apply be taken to limit the working of shift work. (2) The Company has the right Employer’s ability to direct Employees to work shift work as required and utilising overtime provisions to perform the Employees shall work the in question outside ordinary hours. No shift work as directed. Shift work will be undertaken during the ordinary hours of work, being 6:00 am to 6:00 pm, or between noon Saturday and 6:00 am Monday. Shift workers shall be paid 187.5% of the respective wage for ordinary hours of work. The unpaid crib break of shift workers shall be 45 minutes or, where the Employer and Employees agree, 30 minutes to suit particular circumstances. There will be one 30-minute paid break in lieu of all other rest and meal breaks. Alternatively, the Employer and Employee may agree to have two paid rest breaks of 10 minutes each per day, one in the first half of the day and one in the second half of the day , as well as an unpaid meal break of not less than 30 minutes, to be taken between noon and 1:00 pm. No Employee will work more than 4 hours without a break. An Employee required to work overtime for at least 1.5 hours after working ordinary hours will be paid a meal allowance in accordance with Appendix 3 plus an additional meal allowance for each subsequent 4 hours worked. The Employer may provide a meal(s) instead of paying an allowance. When an Employee is rostered to work 3 or more hours overtime the Employee is entitled to a paid rest break of 20 minutes immediately after ordinary hours ceasing time. Where this break is not taken, the 20 minutes will be added to the total overtime worked and paid for in accordance with this subclause. (3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as such. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday nightaccordingly. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior to the commencement of shift workIn addition, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work Employee is not carried out on a Saturday, Sunday, RDO or on any public holiday. (7) A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a halfpaid rest break of 30 minutes after each 4-hour without deduction block of pay for the purpose of taking a meal breakcontinuous overtime. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work - Day workers may be employed as and the starting and finishing times become shift workers for a period of Ordinary Hours of the shifts. (6) Where not less than five (5) consecutive shifts are worked then Employees or not less than four shifts when the fifth shift is their 38 hour week rostered day off shift and paid accordingly. An employee shall be paid at overtime rates in lieu of the for any shift loading prescribed upon which they have not been given at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holidayleast 48 hours’ notice. (7f) Transfer of shift workers - A shift Employee worker who is required to work on a shift other than the shift on which they would ordinarily be rostered shall receive a flat loading be paid at overtime rates for any such shift in respect of twenty-five (25) percent of their Ordinary Hourly Rate for each hour workedwhich they have not been given at least 48 hours’ notice. This provision shall not apply when the employee reverts to the shift on which they would ordinarily have been rostered. (8) Employees working night g) Annual Leave - In addition to the benefits provided by section 3 of the Annual ▇▇▇▇▇▇▇▇ ▇▇▇, ▇▇▇▇ (▇▇▇), with regard to an annual holiday of four weeks, an employee who, during the year of their employment with the Company with respect to which they become entitled to the said annual holiday of four weeks, gives service to the Company as a seven-day shift worker, shall be entitled to stop the additional leave as hereunder specified:- If during the year of their employment they have served the Company continuously as a seven-day shift worker the additional leave with respect to that year shall be one week. if during the year of their employment, they have served for only portion of it as a seven-day shift worker the additional leave shall be one day for every thirty-three ordinary shifts worked as a seven-day shift worker; An employee shall be paid for such additional leave at the annual leave rate of pay, for the number of ordinary hours of work which those employees would have been rostered for duty during the period of additional leave; where the additional leave calculated under this subclause is or includes a halffraction of a day such fraction shall not form part of the leave period and any such fraction shall be discharged by payment only; In this clause reference to one week and one day shall include holidays and non-hour without deduction working days. A seven-day shift worker under this subclause shall be paid at the appropriate rate for any ‘compulsory roster’ shift, also known as a ‘roster shift’ which they would have worked during this period of annual leave had they not been on annual leave. (h) Days added to the period of Annual Leave. (a) An employee who is rostered off duty on a day which is a prescribed holiday and who is not required to work on that day shall: have one day added to their annual leave period; or by mutual consent, be paid, in the pay for the purpose period in which the holiday falls, for the holiday at the rate payable pursuant to the award. Except on a Saturday in the case of taking a meal breakemployees employed as Monday to Saturday shift workers who are regularly rostered for duty on Saturdays as ordinary working days. (9i) Shift Cover Due to the Company’s commitment to the provision of maintenance services, it will become necessary for it’s employees to follow 12 hour shift patterns as worked by our clients personnel. The Company may stagger provision of such will be required to cover planned and unplanned absences of our client's employees. Implementation will proceed by agreement with the times for Employees to take meal breaks to meet operational requirements. Shift Work. ‌For employees who work on a rotating or irregular basis: a. (3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside employees affected. b. Every reasonable effort shall be made by the Employer: i. not to schedule the commencement of a shift within eight (8) hours of the spread completion of Ordinary Hours defined at clause 16 - Hours the employee’s previous shift; ii. to avoid excessive fluctuations in hours of Work work; iii. to consider the wishes of this Agreement and when Employees are working as such.the majority of employees concerned in the arrangement of shifts within a shift schedule; (4) Ordinary Hours for shift Employees will comprise thirtyiv. to arrange shifts over a period of time not exceeding fifty-six (3656) hours per week averaged over days and to post schedules at least fourteen (14) days in advance of the starting date of the new schedule; v. to grant an employee a defined minimum of two (2) consecutive days of rest. c. The Employer shall make every reasonable effort to schedule a meal break of one half (1/2) hour during each full shift which shall not constitute part of the work cycle and will not commence before 5.00pm on Sunday nightperiod. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior meal break shall be scheduled as close as possible to the commencement of shift work, the Company shall seek the agreement midpoint of the Employees involvedshift, unless an alternate arrangement is agreed to at the appropriate level between the Employer and the employee. Failing agreementIf an employee is not given a meal break scheduled in advance, all time from the Company will provide commencement to the Employees concerned one (1) week's notice termination of the commencement of employee’s full shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holiday. (7) A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour time worked. (8) Employees working night d. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift Work. ‌ (1) Except as varied by this Clause, all other aspects of Section 4 of the Agreement shall apply to the working of A shift work. (2) The Company has the right to direct Employees to work shift work as required and the Employees shall work the shift work as directed. Shift work worker will be worked a person engaged as such and paid for who works hours in accordance with this subclause.clause. The ordinary hours of work for a shift worker are 38 hours per week, Monday to Friday. Employees may work up to 10 hours on any shift without payment of overtime, provided that: (3a) in any arrangement of working hours where the ordinary working hours are to exceed eight on any day, the arrangement of hours shall be subject to the Agreement of the Company and the majority of Employees in the plant or section or sections concerned; (b) by arrangement between the Company and the majority of Employees in the plant or section or sections concerned, ordinary working hours not exceeding 12 on any day may be worked. For the purposes of this Agreement: (a) day shift means any shift starting after 8:00am and finishing at or before 6:00pm; (b) afternoon shift means any shift finishing after 6:00pm and at or before midnight; and (c) night shift means any shift finishing after midnight and at or before 8:00am. Shift workers, other than casuals, whilst on afternoon or night shifts, shall be paid 20% more than ordinary rates for such shifts. Shift workers, classified in accordance with Appendix 2, employed on a permanent night shift will, for work done during ordinary hours of any such shift, be paid ordinary rates plus an additional 30%. For the avoidance of doubt an employee employed on permanent night shift, is an employee who works on a night shift and does not rotate or alternate with another shift or with day work. Casuals whilst on afternoon or night shifts, shall be paid 15% more than the ordinary rates which incorporate casual loading, for such shifts. All time worked in excess of the ordinary hours for the shift shall be paid for as though overtime at the rate of double time on ordinary rates, provided that all work performed on public holidays shall be paid for at double time and one half. At the request of an Employee, the Company and the Employee may agree to compensate the working of overtime by allowing an equivalent amount of time off for actual time worked, i.e. one hour of overtime will accrue one hour of time off. The taking of such time shall be determined by agreement between the Company and the Employee concerned. Where shift work is adopted, shifts shall, as far as practicable, rotate regularly, and where two shifts are worked, one shall be regarded as the day shift, and the second, the afternoon or night shift. Where three shifts are worked they shall be divided into day, afternoon and night shift. No Employee shall work for more than four and a half hours without a break for a meal except in the following circumstances where up to six hours may be worked without a break for a meal by agreement with the Employee concerned: (a) where a casual Employee or a part-time Employee is engaged to work no more than six hours in any one day; (b) where weekly Employees are working their ordinary hours on the basis of a short day each week. 30 minutes shall be allowed to shift workers each shift for crib, and shall be counted as time worked. Where shifts are worked pursuant to this Agreement, the Company shall have the right to decide and shall decide forthwith or before the commencement of such shift work, which of the shifts shall be the day shift and shall notify each Employee concerned accordingly. The Company shall, while shift work is being worked, exhibit and keep exhibited at the place at which shifts are worked, in a place to which the Employees have access, a notice specifying the times at which each shift shall commence and finish and which of the shifts is deemed to be the day shift. The changing of shifts shall be by mutual arrangement between the Company and the Employee. Shift workers whose working period includes a Saturday, Sunday or any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at holidays specified in clause 16 - Hours of Work of this Agreement and when Employees are working as such. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. Millwright Local 2736 Standard Agreement May 1, 2019 to April 30, 2023 Shift Premiums (for scheduled nine (9) or ten (10) hour shifts only) (d) The Employer shall pay a shift premium over and above the otherwise applicable straight time hourly wage rate to any Millwright who is employed on an afternoon or night shift. The minimum straight time hourly wage rate applicable for all other Employee classifications shall be recalculat­ ed accordingly. Such shift premium shall be paid in accordance with the following schedule. Day Shift: Afternoon Shift: Night Shift: No premium Six dollars ($6.00) per hour worked on any shift which commences be­ tween 3:30 pm and 8:30 pm. Second and subsequent meal breaks are not considered to be hours worked. Six dollars ($6.00) per hour worked on any shift which commences be­ tween 8:30 pm. and before 1:01 a.m. Second and subsequent meal breaks are not considered to be hour worked. Notwithstanding any contrary interpretation of the foregoing schedule, a shift loading prescribed commencing at subclause (7) of this clause. Thus for these Employees the average of 38 ordinary hours may be achieved over a period which exceeds 28 consecutive days. 7.2 There shall be a roster of shifts which shall: (a) provide for rotation unless all the Employees desire otherwise; (b) provide for not more than eight shifts to be worked in any arrangement nine consecutive days; and (c) not be changed until after four weeks notice, provided that an Employee's place on each roster shall not be changed except on one weeks notice of Project Working Hours where such change or payment of penalty rates; (d) so far as Employees present themselves for work in accordance with this clause, shifts shall be worked according to the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as suchroster. (4) Ordinary Hours 7.3 For work done by a shift worker excluding an Employee on split shifts outside the ordinary hours of his or her shift double time shall be paid. Provided that this shall not apply to private arrangements regarding the working of shifts other than in accordance with the roster made between Employees or in cases due to rotation of shift or when the relief does not come on duty at the proper time. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shiftsbe paid 15% more than their ordinary rates. (6) Where less 7.5 A shift worker other than an Employee on a split shift who works on any afternoon or night shift which does not continue for at least five (5) consecutive shifts are worked then Employees afternoons or nights in a five-day workshop or for at least six successive afternoons or nights in a six-day workshop shall be paid at overtime rates in lieu the rate of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on time and a Saturday, Sunday, RDO or on any public holidayhalf. 7.6 Except when employed on split shifts, an Employee who: (7a) A during a period of engagement on shift work, works night shift only; or (b) remains on night shift for a longer period than four consecutive weeks; or (c) works on night shift which does not rotate or alternate with another shift or with day work so as to give the Employee at least 1/3 of his or her working time off night shift in each cycle, shall receive a flat loading during such engagement, period or cycle be paid at the rate of twenty-five (25) percent of their Ordinary Hourly Rate single time plus 30% for each hour workedall time worked during ordinary working hours on such night shifts. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break.7.7 Shift definitions (9a) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night Day shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on means any night shift.shift starting at or after 6.00 a.m. and before 10.00 a.m.

(3b) Shift work An employee working rotating day, afternoon and night shifts or where an employee works afternoon or night shifts only, will be paid a shift allowance of 20% of their base salary per week, paid weekly as a shift allowance, including when the employee is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as suchday shifts. (4c) Ordinary Hours for shift Employees Shift workers will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include paid one (1) half-hour rest break day’s pay for the public holiday or have one (1) day added to be taken without deduction of pay by Employees working the Project Working Hours on any night shifttheir annual leave.

Failing agreement, the Company will provide to the Employees concerned one (1) week's weeks notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. Shift Work. ‌ Shift work may be utilized to meet the Construction Contract schedule, or otherwise to comply with the Construction Contract requirements or written directive from the Owner. Shift work options under this RTSA include the following: (1a) Except as varied by this ClauseTwo-Shift Operation. Where a two-shift operation is scheduled, all other aspects the first eight (8) hours of Section 4 work per day (exclusive of no-paid meal period) shall be paid for at the Agreement Covered Employee's regular straight time rate of pay. Where a two-shift operation is scheduled on the basis of a workweek of four (4) consecutive ten (10) hour days, then the straight-time rate of pay shall apply to prevail for the working Covered Employee ' s first eight (8) hours of shift workwork (exclusive of non-paid meal period). (2b) The Company has the right to direct Employees to work Three-Shift Operation. Where a three-shift work as required and the Employees shall work the shift work as directed. Shift work will be worked and paid for in accordance with this subclause. (3) Shift work operation is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as such. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior to the commencement of shift workscheduled, the Company shall seek the agreement first eight (8) hours of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one work per day (1exclusive of a non-paid meal period) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu the Covered Employee's regular straight-time rate of pay. The length and schedule of working hours on any of the three shifts (whether 8, 7-1/2, or 7 hours) shall be as determined and scheduled at the Contractor-Employer's sole discretion provided; That on each shift loading prescribed at subclause (whether scheduled on a 8, 7-1/2, or 7 hour basis), the Contractor-Employer shall provide Covered Employees with eight (8) straight-time hours of work opportunity (exclusive of meal periods) or pay for same. This does not apply where the Covered Employee quits, voluntarily lays out, or is suspended or discharged prior to the completion of this clausean eight (8) hour period, or the Contractor-Employer is unable to provide such work due to weather conditions, equipment breakdown, power failure, work stoppage, labor disputes, accident, or other circumstances beyond the control of the Contractor-Employer. Shift Work. ‌12.1 The following clauses relating to shift work do not relate to continuous shift processing operations (continuous 7 days per week operations). If during the term of this agreement the employer decides that one or more of its operations have a requirement for continuous operations then an amendment to this agreement will be negotiated with the effected employees. (1) Except 12.2 Employees who routinely only works day work hours or day shift hours are not classified as varied by this Clausea shift worker. In such cases overtime penalty rates are defined in section 11.‌ 12.3 Employees who are required to work shift work, all other aspects of Section 4 are to work the hours according to the employer approved shift roster. 12.4 The nominal shift hours shall be 7.00 am - 3.00 pm; 3.00 pm - 11.00 pm and 11.00 pm - 7.00 am. 12.5 Those shifts may be worked outside of the Agreement shall apply to the working ordinary hours of shift workwork provided for in section 9. (2) The Company has 12.6 Employees regularly required to work shift will be given a shift allowance of 12.5% of the right to direct ordinary wage for any ordinary hours worked by them on any afternoon shift and 15% of the ordinary wage for any ordinary hours worked by them on any night shift. Shift work on a Saturday or Sunday will be worked and paid for in accordance with this subclause. (3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as such. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior entitled to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) 1 week's ’s notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) 5 consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holiday. (7) A shift Employee shall receive a flat loading of twenty-five (25) 25 percent of their Ordinary Hourly Rate for each hour worked.. MEAL BREAK – SHIFT WORK (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements.. REST PERIODS – SHIFT WORK (10) The Company shall structure the Project Working Hours working hours for Employees working night shift to include one (1) half-1 half- hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shiftpay.

Shift Work. ‌25.1. For the purposes of this clause, Shift Work refers to both Afternoon Shift and Night Shift as follows: (1a) Except as varied by this Clause, all other aspects Afternoon Shift – is a shift that finishes between the hours of Section 4 of the Agreement shall apply to the working of shift work6:00 PM and at/or before midnight. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence Company; however, before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. Shift Work requires at least 5 consecutive shifts to be rostered by the Company, otherwise overtime provisions will apply. To avoid any doubt, it is the shift loading prescribed arrangement as established by the Company that will satisfy the requirement that there be at subclause (7) of this clauseleast 5 consecutive shifts. The consecutive nature of shifts will not be deemed to be regarded as broken if work is not carried out on an RDO, public holiday, Saturday or Sunday. 25.5. Ordinary hours for shift Employees will average 38 hours per week over a Saturday, Sunday, RDO or defined work cycle and can be worked on any public holidayday of the week. Unless otherwise agreed, no more than 8 ordinary hours will be worked on any single shift. (7) A 25.6. The ordinary hours for Employees on Shift Work will include a paid meal break not exceeding 30 minutes. 25.7. Employees on Shift Work, Monday to Friday, shall be paid a shift Employee shall receive a flat loading of twenty-five (25) percent 30% of their Ordinary Hourly Rate the Employee’s ordinary rate for each ordinary hour worked. (d) A Caregiver rostered to work ordinary hours between midnight Friday and midnight on the working following Saturday shall be paid a loading of shift work50% on actual hours worked during this period. (e) A Caregiver rostered to work ordinary hours between midnight Saturday and midnight on the following Sunday shall be paid a loading of 60% on actual hours worked during this period. Such Ordinary Hours are the specified hours under each shift Employee's terms qualifying period of employment by reference to which for annual leave and personal/carer's purposes shall be entitled to receive additional annual leave accrueas follows: (i) If 35 or more ordinary shifts on such days have been worked - one week’s additional leave in each qualifying period; (ii) If less than 35 ordinary shifts on such days have been worked the Caregiver shall be entitled to have one additional day’s leave for each seven ordinary shifts worked, provided that the maximum allowed leave shall not exceed five days. (5) Prior When a Caregiver who regularly works shiftwork proceeds on annual leave, other than one referred to the commencement of shift workin subclause (4), the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts are worked then Employees he or she shall be paid at overtime rates in lieu a loading of either 17.5% of ordinary salary for four weeks or an amount equivalent to the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will and weekend penalties the Caregiver would have received if he had not be deemed to be broken if work proceeded on annual leave, whichever is not carried out on a Saturday, Sunday, RDO or on any public holidaygreater. (7) A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift Work. ‌ (1) Except as varied by this Clause, all other aspects of Section 4 of the Agreement shall apply to the working of shift work. (2) The Company has the right to direct Employees 12.2.1. Where an employee is required to work a rostered shift work as required and the Employees shall work the shift work as directed. Shift work will be worked and paid for in accordance with this subclause. (3) Shift work is deemed to be any arrangement of Project Working Hours where which has the majority of the Ordinary Hours are worked working hours falling outside of the spread ordinary day work hours, the employee shall be paid an additional shift penalty calculated on the employee's base rate of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as suchpay for all ordinary hours worked on that shift. (4) Ordinary Hours 12.2.2. An employee whilst engaged on rostered afternoon shift shall be paid for such shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal17.5% more than his/carer's leave accrueher ordinary rate. (5) Prior 12.2.3. An employee whilst engaged on rostered night shift shall be paid for such shift 25% more than his/her ordinary rate. 12.2.4. If the employee works overtime in addition to the commencement of shift workordinary hours for that shift, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts are worked then Employees he or she shall be paid at overtime rates in lieu of prescribed by this agreement but no shift penalty shall apply to those overtime hours beyond the shift loading prescribed first 2 hours at subclause (7) of this clause. The consecutive nature of shifts will not be deemed 1.5 times rate when worked Monday to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holidayFriday. (7) A 12.2.5. Where an employee engaged as a day worker is transferred to shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-period of less than 5 consecutive nights, those hours worked shall count towards the employee's ordinary hours for that week but the employee will be paid at overtime rates where there is no shift roster as part of the normal process. 12.2.6. Employees will be required to work shift work as directed by the company subject to the company giving the employee at least 24 hours notice of the requirement to work shift work and taking into account employee personnel circumstances at that time. 12.2.7. All employees, when changing from one shift to another shall observe a minimum ten hour break commencing at the conclusion of the previous shift (including any overtime worked beyond the normal completion of that shift) and shall be released from duty without deduction loss of pay for rostered or ordinary hours falling within the purpose ten hour break. Current Roster 12.2.8. On commencement of taking a meal break. In the event that the Company may stagger the times for Employees consider it necessary to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break amend work hours, shifts and roster arrangements, such amendments to be taken without deduction of pay by Employees working the Project Working Hours on any night shiftdone after consultation and agreement with affected employees.

Shift work hours will be paid at the rate of time and one half for the first two hours and double time for hours worked and paid for in accordance with this subclausethereafter. (3ix) Where Afternoon/Night Shifts are worked for less than 5 consecutive shifts in a week, the hours worked as part of a Aftenoon/Night Shift will be paid at the rate of time and one half for the first two hours and double time for hours worked thereafter. (x) On selected projects, where there is a need for variation to the normal hours of work is deemed to be any arrangement of Project Working Hours and/or shift work and where the Company and the majority of employees concerned agree. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift Work. ‌ (Section 1) Except as varied by this Clause. Night shifts may be established for the fabrica- tion, all other aspects installation, or erection of Section 4 of the Agreement shall apply to the working of shift work. (2) The Company has the right to direct Employees to work shift work as required material and the Employees shall work the shift work as directed. Shift work will be worked and paid for in accordance with this subclause. (3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and equipment only when Employees are working as such. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts night shifts, Monday through Friday, are worked then Employees worked, and the following conditions exist and shall be paid at overtime rates in lieu complied with: (a) The site must be an existing completed building where the current operations of the owner or tenant may be interfered with if the work is performed during the regular work- ing hours except, that by mutual agreement between Employer and the Union, the shift loading prescribed at subclause (7) work provisions of this clause. (e) When only one night shift (second shift) is established in either the shop or in the field by Sheet Metal Workers or any other trade, such second shift shall work eight (8) hours and be paid a shift premium of fifteen percent (15%) above the Journeypersons’ hourly wage rate. When two night shifts are established in either the shop or in the field by Sheet Metal Workers or another trade (second and third shifts), the second shift shall work seven and one-half (7½) hours and be paid for eight (8) hours plus a shift premium of fifteen percent (15%) above the Journeypersons’ hourly wage rate. The third shift shall work seven (7) hours and be paid for eight (8) hours plus (f) Work performed by night shift Employees outside the established shift hours shall be paid for at time and one half (1½) for the first two (2) hours and at double the regular rate of wages thereafter. Shift Work. ‌19.1 Employees may be required to work shift work under a roster (or as otherwise directed). (1) 19.2 Except as varied by otherwise provided for in this Clauseclause, all other aspects shift workers will be paid a loading of Section 4 15% more than their base rate of the Agreement shall apply to the working of pay for such shift work. 19.3 Employees (2other than Casual Employees) who work on any afternoon or night shift roster which does not continue for at least 5 successive afternoons or nights; will be paid for each shift 50% for the first 2 hours, and 100% for the remaining hours, in addition to the ordinary rate (with no shift loading paid). 19.4 All time worked on Saturdays (with the exception of an afternoon or night shift that commences on a Friday) and Sundays will be paid at the appropriate overtime rates (with no shift loading paid). 19.5 All time worked on Public Holidays will be paid at the rate of double time and a half (with no shift loading paid). 19.6 All time worked outside the ordinary hours of shift work on Monday to Friday (except for unpaid meal breaks) will be paid at the appropriate overtime rates (with no shift loading paid). 19.7 Subject to any individual flexibility arrangement made under this Agreement and the accrual of RDOs under sub clause 18.7 the method of working shift work will be by Employees working 8 ordinary hours each shift, excluding unpaid meal breaks arranged in accordance with this Agreement. The Company has the right to direct Employees shift loading of 15% will be paid on 8 ordinary hours worked, but will not be paid when any accrued RDOs are taken or paid out. 19.8 An Employee required to work shift work as required and the Employees shall work the shift work as directed. Shift work will be worked and paid for in accordance with this subclause. (3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as such. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's receive 5 days' notice of the commencement of the shift work and or payment of penalty rates (as set out in clause 21 - but with no shift loading paid) for the starting and finishing times of Ordinary Hours of time worked, until the shiftsnotice period expires. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu 19.9 No notice period will apply to the completion of shift work. At the completion of the shift loading prescribed at subclause (7) of this clause. (10) The Company shall structure the Project Working Hours for Employees 19.11 A Casual Employee working an afternoon or night shift will be paid a loading of 40% more than the base rate for the ordinary hours of shift work (Monday to include one (1Friday) half– which includes both shift and casual loadings under this Agreement. However; sub-hour rest break clause 19.3 will not apply to be taken without deduction of pay by Employees working the Project Working Hours on a Casual Employee in any night shiftevent.

(10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift Work. ‌Where, by agreement between the employer and a Health Worker, the Health Worker is employed within a hospital setting and is rostered to work shifts, the provisions of this clause will apply. Afternoon/Night Shifts (1) Except as varied by this Clause, all other aspects 12.1 A Health Worker who works a complete rostered afternoon shift commencing not earlier than 12 noon and finishing after 6 pm on week days shall receive a loading on the ordinary rates of Section 4 pay of the Agreement shall 12.5%. This loading does not apply to the working where a Health Worker commences his/her ordinary hours of shift workwork on any weekday after 12 noon and completes those hours before 6 pm on that day. (2) The Company has 12.2 A Health Worker who works a complete rostered night shift between the right to direct Employees hours of 6pm and 7.30 am on a weekday shall receive a loading on the ordinary rates of pay of 15%. Weekend Work 12.3 A Health Worker rostered to work shift work as required ordinary hours between midnight Friday and midnight on the Employees following Saturday shall work the shift work as directed. Shift work will be paid a loading of 50% on actual hours worked and paid for in accordance with during this subclauseperiod. (3) Shift 12.4 A Health Worker rostered to work is deemed to ordinary hours between midnight Saturday and midnight on the following Sunday shall be any arrangement paid a loading of Project Working Hours where the majority of the Ordinary Hours are 75% on actual hours worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of during this Agreement and when Employees are working as suchperiod. (4) Ordinary Hours 12.5 These rates shall be in substitution for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm cumulative on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave rates prescribed for afternoon and personal/carer's leave accrue. (5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the night shifts. (6) 12.6 Where less than five (5) consecutive shifts a Health Worker's rostered hours of duty on any day are worked then Employees extended by an early start or a late finish the afternoon/night shift work or weekend rates as the case may be shall be paid for such additional time in addition to any overtime payable under Clause 11 of the Award. 12.7 Where a Health Worker who is regularly rostered to work day duty Monday to Friday is required to work on a Sunday she/he shall be paid at overtime rates the rate of double time for all time worked on the Sunday. Annual Leave for Shift Workers 12.8 An employee whose ordinary hours of work regularly rotate afternoon and/or night shift with day shift as defined in lieu of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not clause shall be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holidaygranted an additional week's annual leave. 12.9 An employee who works afternoon and/or night shifts, which are not subject to regular rotation, shall be granted an additional day's leave (7up to an extra five days) A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours seven weeks actually worked on any afternoon and/or night shift. 12.10 An employee who has worked thirty-one weeks on non-rotating shifts shall be granted an additional weeks leave.

Shift Work. ‌ (1) Except as varied by 19.1 For the purpose of this Clause, all other aspects clause "Afternoon/Night Shift" shall mean a shift on which the majority of Section 4 of the Agreement shall apply to the working of shift workordinary hours are worked after 6:00pm. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrueshift. (5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6i) Where any particular process is carried out on shifts other than day shift, and less than five (5) consecutive afternoon or five (5) consecutive night shifts are worked on that process, then Employees employed on such afternoon or night shifts shall be paid at overtime rates rates. Provided that where the ordinary hours of work normally worked in lieu the workplace are worked less than five (5) days then the provisions of the shift loading prescribed at subclause sub-clause 19.5(i) shall be as if four (74) consecutive shifts were substituted for five (5) consecutive shifts. (ii) The sequence of this clause. The consecutive nature of shifts will work shall not be deemed to be broken if under the preceding sub-clause, by reason of the fact that work on the process is not carried out on a Saturday, Saturday or Sunday, RDO or on any other day that the Company observes a shutdown for the purpose of allowing a thirty six (36) hour week or on any public holiday. The Company may stagger the times for Employees to take time of taking a meal breaks break to meet operational requirements. 19.7 A shift Employee, in addition to their Ordinary Hourly Rate, shall be paid per shift of eight (108) hours, a loading of twenty five (25) The Company shall structure per cent for shift work. Shift hours in excess of eight (8) hours will be paid at the Project Working Hours rate of time and a half for Employees working the first two hours and double time thereafter based on the Employees’ Ordinary Hourly Rate (excluding shift loading and casual loading). 19.8 Subject to the other provisions of this clause 19, when any shift is rostered for 12 hours an Employee will be paid for 12 hours in accordance with sub-clause 19.7. 19.9 Where a permanent Employee is required to change from night shift to include one (1) half-hour rest break to day shift and the last night shift worked is on a day other than Friday or Saturday, for the day of the change, the Employee shall be taken without deduction of pay by Employees working paid 8 hours at the Project Working Hours on any night shiftOrdinary Hourly Rate for the following day.

Shift Work. ‌6.4.1 The ordinary hours of employees undertaking shift work or continuous shift work shall not exceed an average of 38 ordinary hours within the work cycle. (16.4.2 The ordinary hours of employees undertaking shift work shall not exceed eight hours per shift unless mutually agreed between the employer and the employees concerned. Ordinary hours of up to twelve hours on any day may be worked subject to:- a) Except as varied The employer and employees concerned being guided by this Clause, all other aspects of Section 4 of the Agreement shall apply to relevant occupational health and safety provisions; b) Proper health monitoring procedures being introduced; c) Suitable roster arrangements being made; and d) Proper supervision being provided. 6.4.3 Where an agreement has been reached for the working of rosters involving more than 8 ordinary hours per shift, the specific hours, roster, overtime, penalties, loadings, etc. will be documented and executed by the relevant parties. The agreements reached for the working of 12 Hour Shift Work Conditions by Production Employees are contained in Appendix E of this Agreement. 6.4.4 The relevant Union shall be provided with a copy of all such written agreements within 14 days of commencement of work under such arrangements. 6.4.5 Different methods of working shifts may apply to various workgroups or sections of employees. 6.4.6 No afternoon or night shift shall be recognised as such unless the shift work operation is scheduled for at least four days. 6.4.7 All employees (including employees relieving on shift) will receive the allowances and loadings outlined in this clause when they undertake shift work. (2) The Company has 6.4.8 An employee undertaking an afternoon shift will receive an allowance of 15% more than the right ordinary rate. This allowance will apply to direct Employees ordinary hours only on an afternoon shift. 6.4.9 An employee undertaking a night shift will receive an allowance of 20% more than the ordinary rate. This allowance will apply to work ordinary hours only on a night shift. Nightshift allowance to increase to 22% the first full pay period following 01 August 2027. Notwithstanding clauses 6.4.8 and 6.4.9, maintenance employees are paid shift work as required allowances and the Employees shall work the shift work as directed. Shift work will be worked and paid for other benefits in accordance with the document Engineering and Maintenance 12 Hour Shift Conditions – September 2019” and “Production Employee 12 Hour Shift Work conditions which are contained in Appendix D & E of this subclauseAgreement. (3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as such. (4) Ordinary Hours for 6.4.10 Where a shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of worker undertakes shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, they will be paid at time and a half. 6.4.11 Where a shift worker undertakes shift work on a Sunday, RDO or on any public holidaythey will be paid at time and three quarter. (7) 6.4.12 A shift Employee shall worker will receive the appropriate penalties as it falls on the day midnight to midnight. In order to avoid any doubt, this means that a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work worker commencing a shift at 10.00 pm on a Sunday evening and concluding at 6.00 am on Monday morning will only receive Sunday penalty rates for a half-hour without deduction of pay for the purpose of taking a meal break2 hours between 10.00 pm and midnight. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift Work. ‌ (1) Except Where agreed between Employer and Employee, shift work may be worked to meet exceptional circumstances, such as varied by this Clause, all other aspects of Section 4 where general site conditions prohibit the performance of the Agreement work during ordinary hours. Nothing in this clause shall apply be taken to limit the working of shift work. (2) The Company has the right Employer’s ability to direct Employees to work shift work as required and utilising overtime provisions to perform the Employees shall work the shift work as directedin question outside ordinary hours. Shift work must be for no less than 1 week at a time and always for a full week. No shift work will be undertaken during the ordinary hours of work, being 6:00 am to 6:00 pm, or between noon Saturday and 6:00 am Monday. No shift shall be for more than 8 continuous hours, excluding meal breaks. Shift workers shall be paid 187.5% of the respective wage for ordinary hours of work. The unpaid crib break of shift workers shall be 45 minutes or, where the Employer and Employees agree, 30 minutes to suit particular circumstances. Employees performing shift work will receive normal daily fares and travel. There will be one 30-minute paid break in lieu of all other rest and meal breaks. Alternatively, the Employer and Employee may agree to have two paid rest breaks of 10 minutes each per day, one in the first half of the day and one in the second half of the day , as well as an unpaid meal break of not less than 30 minutes, to be taken between noon and 1:00 pm. No Employee will work more than 4 hours without a break. An Employee required to work overtime for at least 1.5 hours after working ordinary hours will be paid a meal allowance in accordance with Appendix 3 plus an additional meal allowance for each subsequent 4 hours worked. The Employer may provide a meal(s) instead of paying an allowance. When an Employee is rostered to work 3 or more hours overtime the Employee is entitled to a paid rest break of 20 minutes immediately after ordinary hours ceasing time. Where this break is not taken, the 20 minutes will be added to the total overtime worked and paid for in accordance with this subclause. (3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as such. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday nightaccordingly. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior to the commencement of shift workIn addition, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work Employee is not carried out on a Saturday, Sunday, RDO or on any public holiday. (7) A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a halfpaid rest break of 30 minutes after each 4-hour without deduction block of pay for the purpose of taking a meal breakcontinuous overtime. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift Work. ‌ (1) Except as varied by this Clause, all other aspects of Section 4 of the Agreement shall apply to the working of shift work. (2) The Company has the right to direct 24.1 Employees may be required to work shift work as according to a roster. 24.2 Those shifts may be worked outside the ordinary hours of work provided in clause 20.3. 24.3 Employees required and the Employees shall to work the shift work as directed. Shift work will be given a shift allowance of 15% of the Base Rate for any ordinary hours worked and paid for on any afternoon or night shift in accordance with this subclausethe following: (a) Afternoon shift means any shift finishing after 6:00pm and at or before midnight; and (b) Night shift means any shift finishing after midnight or at or before 8:00am. 24.4 Where ordinary hours are worked by an Employee (excluding Trades Assistants and Storepersons) over 5 days of the week which is made up of at least 4 afternoons and/or night shifts, a shift allowance of 15% of the Base Rate will apply to all ordinary hours worked over the 5 days. 24.5 An Employee engaged on permanent night shift will be given a shift allowance of 30% of the Base Rate for any ordinary hours worked on permanent night shift. 24.6 Employees required to work shift work will be entitled to the following weekend shift penalty rates for any ordinary hours worked on a Saturday or Sunday, in lieu of any shift allowance: (a) Saturday, time and a half. (3b) Sunday, double time, with a minimum payment of four hours. 24.7 Shift work is deemed allowances and weekend shift penalties are in lieu of overtime rates that may otherwise have applied to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are hours worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as suchordinary hours. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) 24.8 If an Employee works in excess of ordinary hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts allowance will not be deemed payable and the Employee will be entitled to the appropriate overtime rate. 24.9 If a shift commences between 11pm and midnight on the day before a Sunday or public holiday, and the shift extends into the Sunday or public holiday, the entire shift will be broken if work is not carried out treated as time worked on a Saturday, Sunday, RDO the Sunday or on any public holiday. (7) A 24.10 If a shift Employee shall receive starts between 11pm and midnight on a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour workedSunday or public holiday, the entire shift will not be treated as time worked on the Sunday or public holiday. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift Work. ‌ (1) Except as varied by this Clause, all other aspects of Section 4 of the Agreement shall apply to the working of shift work. (2) The Company has the right to direct Employees to work Any employee may be employed on shift work as required and the Employees shall work the shift work as directed. Shift work will be worked and paid for in accordance with this subclause.the following provisions: (3) Shift work is deemed to be any arrangement of Project Working Hours where 11.1 For the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work purpose of this Agreement "shift work" shall mean all regular and when Employees are working as suchcontinuing periods of duty of up to 12 hours commencing before 7.00 am or after 10.30 am but not including any duty which is rostered to finish at or before 7.00 pm. (4) Ordinary Hours 11.2 The provisions of clause 10 - Overtime shall not apply to shift work. The ordinary hours of duty for employees required to perform shift Employees will comprise thirty-six (36) work shall be 150 per 4 week cycle. By agreement between the employee and the relevant department/section supervisor, ordinary hours worked, while not to exceed 150 per 4 week averaged cycle, may be organised such that employees can work shorter or longer hours on one or more days, provided that over a defined the 4 week work cycle the average ordinary hours worked do not exceed 150. Time worked in excess of these ordinary hours shall be paid for at the rate of time and will a half for the first three hours and double time thereafter, such overtime to be calculated at the end of the 4 week cycle. 11.3 An employee performing shift work shall be paid at the rate of ordinary time calculated at the relevant rate in this Agreement plus 17 per cent provided that in respect of the ordinary hours of any shift which fall between midnight and 6.00 am or for the whole of a shift, the major portion of which occurs between midnight and 6.00 am the rate shall be ordinary time plus 20 per cent. The shift work allowance shall not commence before 5.00pm apply for the purposes of overtime provided that the minimum rate to be paid to any employee performing shift work between midnight on Friday and midnight on Saturday shall be time and a half. The minimum rate to be paid to any employee performing shift work between midnight on Saturday & midnight on Sunday night. Such Ordinary Hours are or any holiday provided for in sub-clause 12 hereof shall be double time. 11.4 No shift worker shall be required or permitted to work during the specified shift for more than four hours under each shift Employee's without a meal break of at least 30 minutes which shall count as time worked. 11.5 Notwithstanding the terms of employment this clause, alternative shift systems, including those based on a twelve hour ordinary time roster per day may be operated by reference to which annual leave and personal/carer's leave accrue. (5) Prior to the commencement of shift work, the Company shall seek with the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice majority of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shiftsemployees concerned. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holiday. (7) A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift Work. ‌ (1a) Except as varied by this Clause, all other aspects of Section 4 of the Agreement shall apply to the working of shift work. (2) The Company has the right to direct Employees Where an employee is required to work a rostered shift work as required and the Employees shall work the shift work as directed. Shift work will be worked and paid for in accordance with this subclause. (3) Shift work is deemed to be any arrangement of Project Working Hours where which has the majority of the Ordinary Hours are worked working hours falling outside of the spread ordinary day work hours, the employee shall be paid an additional shift penalty as prescribed calculated on the employee's base rate of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as suchpay for all ordinary hours worked on that shift. (4b) Ordinary Hours for Short Term Shift - Short term shift Employees will comprise thirty-six (36) hours per week averaged shall be a shift that is worked or expected to be worked over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms period of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less more than five (5) consecutive shifts are days, where the employee has not been given at least 24 hours notice of the requirement to work shifts. Short term shift employees shall be paid at the averaged shift work loading of 75%. Transferring from Day Work to Shift Work - Employees shall be given at least 24 hours notice when being transferred to shift work. If 24 hours notice is not given, and the employee transfers to shift work, the overtime rate shall apply until the 24 hours notice would have occurred. Transfer from Shift Work to Day Work - Employees shall be given at least 24 hours notice when being transferred to day work. If 24 hours notice is not given, and the employee transfers to day work, the overtime rate shall apply until the 24 hours notice would have occurred. c) LONG TERM SHIFT WORK - Shall mean work performed daily in recurrent periods, mainly outside of the ordinary hours defined in Clause 9 – Hours of Work, and for a period of more than 50 days (inclusive of weekends). Where a shift is worked or expected to be worked over more than 50 days, then Employees the employee shall be paid a shift loading of 25%. d) If the employee works overtime in addition to the ordinary hours for that shift, he or she shall be paid at overtime rates in lieu of the prescribed by this agreement but no shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will not be deemed penalty shall apply to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holidaythose overtime hours. (7e) A Where an employee engaged as a day worker is transferred to shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-period of less than 5 consecutive nights, those hours worked shall count towards the employee's ordinary hours for that week but the employee will be paid at overtime rates. f) All employees, when changing from one shift to another shall observe a minimum ten hour break commencing at the conclusion of the previous shift (including any overtime worked beyond the normal completion of that shift) and shall be released from duty without deduction loss of pay for rostered or ordinary hours failing within the purpose of taking a meal ten hour break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.

Shift Work. ‌ (1a) Except as varied by this ClausePrior to shift work being worked, all other aspects of Section 4 of the Agreement Employer shall apply seek employees from their workforce to volunteer to work shifts and subject to the working of shift work. (2) The Company employees who volunteer having the appropriate skills, shall utilise those employees to work the required shifts. If there are insufficient employees who volunteer, the Employer has the right to direct Employees employees to work shift work as required and the Employees employees shall work the shift work as directed. Shift work will be worked and paid for in accordance with this subclausesub-clause. (3b) Shift work is deemed to be any arrangement of Project Working Hours working hours where the majority of the Ordinary Hours ordinary hours are worked outside of the spread of Ordinary Hours defined at hours specified in sub- clause 16 - Hours of Work of this Agreement (1) hereof and when Employees employees are working as such. (4c) Ordinary Hours hours for shift Employees employees will comprise average thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm 8.00pm on Sunday night. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, Sunday or RDO or on any public holiday. (7f) A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for The ordinary hours on each hour worked. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle Work Cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue. (5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's weeks’ notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu of the shift loading prescribed at subclause (7) of this clause. The overtime rates applicable shall be paid at the rate of time and a half for the first two hours and double time thereafter. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holiday. (7) A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken taken, without deduction of pay pay, by Employees working the Project Working Hours on any night shift.

Shift Work. ‌6.4.1 Employees accept to undertake Afternoon or Night Shift work when required. In the event that this rest period overlaps with the Employee’s next shift the Employee shall not be required to commence work until 10 hours has elapsed and such an Employee shall be entitled to payment for hours not worked. 6.4.5 Subject to clause 11.3, on selected projects, where there is a need (5due to client requirements or the nature of the project) Prior for variation to the commencement hours of work and/or shift work, the Company shall seek and any individual Employee may agree for the agreement spread of hours and /or shift system to be tailor made to suit the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts. (6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates individual project needs with provisions drafted in lieu of the shift loading prescribed at subclause (7) of this clauseabove. The consecutive nature of shifts Any such agreement will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holidayreplace the above provisions. (7) A shift Employee shall receive a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked. (8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break. (9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements. (10) The Company shall structure the Project Working Hours for Employees working night shift to include one (1) half-hour rest break to be taken without deduction of pay by Employees working the Project Working Hours on any night shift.
