Sick Leave Pool. The purpose of the emergency sick leave pool is to furnish additional sick days for certified staff under the negotiated agreement. This leave can only be used during the school year after the teacher has exhausted all regular accumulated sick leave and discretionary leave. Leave will be granted for catastrophic illness or injury of the employee only, on a first-come, first-ask basis. The emergency sick leave pool will be funded by the days certified staff has over the 80-day maximum sick leave this is given to each employee on July 1 of each year. All days over the 80-day accumulated sick leave the employees receive will be put into an emergency sick leave pool with an accumulation not to exceed 80 days for the pool. The maximum number of emergency sick leave pool days that may be accumulated during the school year is 20 days. A written application along with a physician’s statement documenting the nature of the catastrophic illness or injury must be sent to the building principal. The Emergency Sick Leave Pool Committee will meet within 10 calendar days after receiving the application to consider the request. The application may be sent to the building principal before the employee’s regular sick leave ends. The Emergency Sick Leave Pool Committee will consist of six members. One member from each of the four schools (“Primary, Intermediate, Middle, and High School”) the Superintendent and the building principal from the building of the applicant. All members will meet to determine ach request; however, the committee member representing the same building as the applicant will not vote. The building principal and superintendent will vote in all cases. The committee members will serve for a period of two years. The Primary and Middle School members will be elected on even calendar years and the Intermediate and the High School members will be elected on odd calendar years. If a member of the committee leaves the employment of the USD 210 before the end of his/her term, the committee will appoint a new committee member form the affected building. The committee members will be in place by September 1 of each year. The emergency sick leave bank may not be used to cover employees who are receiving pay, salary protection payments, and disability insurance payments or are eligible to receive compensation from workers’ compensation or KPERS disability.
Sick Leave Pool. A Sick Leave Pool Committee shall be established to administer the District Sick Leave Pool. The committee shall be composed of an equal number of members appointed by the Association and the District and will develop procedures for the operation of the Pool.

Sick Leave Pool. A. A Sick Leave Pool will be established in the Oregon City Schools for OAPSE members. The purpose of this pool shall be to provide a classified staff member a leave for catastrophic (serious) illness or injury. To be eligible, a classified staff member must have exhausted all accumulated sick leave, or other eligible leave with pay. B. Application to draw days from this pool shall be made on an appropriate form which will then be sent to the Sick Leave Bank Committee for consideration. C. Initially, a bargaining unit member may be granted up to 30 days from the sick leave pool. If, during this time, the bargaining unit member cannot return to work, then he/she may request an additional 30 days from the sick leave pool. To be eligible to draw the additional 30 days, however, the bargaining unit member must make an application for SERS disability during the initial 30-day period. If a bargaining unit member fails or refuses to make application for SERS disability within 30 days from the date of the first draw, they will lose the privilege of using the Sick Leave Bank beyond the initial 30 days. The bargaining unit member may continue to use the Sick Leave Bank until SERS disability decision is rendered or until 90 days has been used per person. If application for SERS disability is denied, the bargaining unit member may apply for an additional 20 days, after which he/she will not be able to draw from the pool for the remainder of the year. D. The maximum days to be carried in the pool shall be 185 days per school year or 90 per person, and each classified staff member may donate up to two days of sick leave (per year) from his/her individual sick leave accumulations. These donations are irrevocable. The Treasurer’s office shall be notified in writing by OAPSE of all such donations. The donation of days to the Sick Leave Pool shall not affect the classified staff members’ opportunity to receive a stipend for not using sick days. E. Once the total accumulation in the pool drops below 100 days, the OAPSE President shall solicit additional days from classified staff members in the district, provided they have not already donated their maximum number of two days each in the current school year. Sick Leave Pool. There is hereby established a pool of sick leave days for use by teachers. The sick leave pool shall be used in the event of major illness or disability. This pool is not intended for brief absences and will be implemented as follows: 1. Each teacher shall be a member of the sick leave pool and eligible for the benefits therein. 2. Each teacher shall transfer one (1) leave day each year to the sick leave pool. If the accumulated days in the sick leave pool are more than 300 days on August 1 of any year, employees that have donated to the pool for a minimum of 3 years will not be required to transfer their 1 leave day. 3. Days transferred by an employee become a permanent part of the pool and will not be returned. At the end of each contract year, the unused days in the sick leave pool shall be carried over into the sick leave pool for the next contract year. 4. If the accumulated days in the sick leave pool are less than 100 days on August 1 of any year, each employee shall contribute two days to the pool that year. Additionally, if the pool is depleted during any year, the committee shall take action as needed to meet the needs of the members of the pool. 5. Before using the sick leave pool, each employee shall have depleted his/her accumulated sick and personal leave. 6. Sick leave pool days are intended to provide for absences caused by prolonged and serious diseases or disabilities for the employee or his/her immediate family as described below. That would include intermittent absences due to follow-up care related to the initial condition. Except as related to the underlying serious medical condition, sick leave pool days are not intended for medical or dental appointments. 7. The application form will include a written statement from the employee's physician certifying that the employee is incapable of performing his/her duties as a result of the prolonged illness or disability. The physician may be asked to certify in writing the number of days absence the given illness or disability requires. The completed form should be returned to the office of the Superintendent who will forward it to the committee. 8. Employees would be eligible for a number of days depending on longevity of sick leave pool membership. These limits are for each illness/disability; a separate situation would also be eligible for consideration by the committee in the same school year.

Participation in the sick leave pool shall be voluntary on the part of each full-time employee. C. All full-time employees shall be eligible for participation in the sick leave pool after one (1) year of employment by the Okaloosa County School Board provided said employee has accumulated a minimum of twelve (12) days accrued sick leave. D. Any sick leave pooled pursuant to this Article shall be removed from the accumulated sick leave balance of the employee donating such leave and shall not be available to the donating employee as sick leave. E. Any sick leave time drawn from the pool by the participating employee must be used for the employee’s personal catastrophic illness, accident or injury. F. Each participating employee shall contribute one (1) day of sick leave in the first month of eligibility. No other sick leave contribution will be required, except that each participating employee shall be required to contribute an additional day of accrued sick leave if the sick leave pool balance has been reduced below one (1) day for each two (2) participating employees. In the event a member does not have any days at the time of request for an additional day, they shall contribute the next day they earn to the sick leave pool. 1. Employees shall be eligible to join the sick leave pool during the first twenty (20) school days of each school year. 2. The employee who cancels membership in the sick leave pool shall not be eligible to withdraw the days of sick leave the employee has contributed to the pool. G. A participating employee shall not be eligible to use sick leave days from the pool until all of the employee’s sick leave has been depleted. An employee so situated shall be eligible to use up to a maximum of sixty (60) days, in 20-day increments, from the pool within a twelve-month period and only for approved absences of five continuous workdays or more. H. A participating employee who is eligible to use sick leave days from the pool shall not be required to re-contribute such days, except as a regular contributing member. I. An employee who transfers into another school district within the state shall not be eligible to have sick leave days from the pool transferred to that district’s sick leave pool. J. The Pool shall be regulated by the following minimum requirements: (1) No participant shall be eligible to use more than one hundred (100) days during the course of any one school year. (2) No participant shall be eligible to use the Pool until she/he has exhausted all personally- accrued sick, and annual leave. (3) No participant shall be eligible to use the Pool until he has been absent for at least ten (10) consecutive days of which at least five (5) consecutive days have been without pay. (4) The pool shall be applicable only to the injury or illness of the participant. (5) Participants applying for days from the Sick Leave Pool must file with the committee an application, accompanied by a medical certificate and justification for protracted leave. The committee can request a second medical opinion at the cost of the applicant. (6) Participants who are proven guilty of abuse of the Pool will repay the days drawn from the Pool and be assessed appropriate penalties. (7) Any participant withdrawing sick leave from the Pool shall not be required to replace those days except as a regular contributing member. (8) All participating members shall contribute one (1) day at the window entry period if the Pool balance reaches below two hundred fifty (250) days. (9) In no event will the balance of days assigned to the Pool be below zero (0). (10) Participants who choose to withdraw from the Pool shall not have their contributed sick leave and/or annual leave days returned.
