Specific Functions. The Stanislaus Council of Governments shall have the common power of the Parties hereto to plan, establish, administer, and operate an independent area planning organization and in the exercise of that power the Stanislaus Council of Governments is authorized in its own name to:
14.1.1. Employ an Executive Director as the chief administrative officer of Stanislaus Council of Governments.
14.1.2. Employ agents and employees and contract for professional services.
14.1.3. Make and enter into contracts.
14.1.4. Acquire, hold and convey real and personal property, including the power to acquire property by eminent domain.
14.1.5. Undertake the planning, design, environmental clearance and construction of transportation and other projects.
14.1.6. Cooperate with other agencies, counties and other local public agencies and participate in joint projects as necessary.
14.1.7. Incur debts, obligations and liabilities.
14.1.8. Accept contributions, grants or loans from any public or private agency or individual, or the United States, the State of California or any department, instrumentality, or agency thereof, for the purpose of financing its activities.
14.1.9. Invest money that is not needed for immediate necessities, in the same manner and upon the same conditions as other local entities in accordance with Section 53601 of the California Government Code.
14.1.10. Have appointed members and ex-officio members of the Stanislaus Council of Governments serve without compensation from the Stanislaus Council of Governments, except that members of the StanCOG Policy Board may be reimbursed for all reasonable expenses and costs relating to attendance at Stanislaus Council of Governments meetings or other Stanislaus Council of Governments business.

2) Initial resolution of disputes associated with implementation;
3) Providing recommendations to the Leadership Committee on amendments to this IMA;
4) Providing recommendations to the Leadership Committee on creation, modification or termination of Derivative Agreements to address routine, procedural or operational elements of this IMA;
5) Providing guidance and recommendations for any other issues that may arise within the scope of this IMA.
b. Evaluating the terms of agreements with Non-Party Users and Indirect Users;
c. Evaluating population impacts, flow projections and service area boundaries;
d. Providing analysis of flow measurement and data collection efforts, as well as flow management programs and their flow capacity impacts;
e. Evaluating the Parties’ flows and conformance with Allocated Flow Capacity and Peak Flow Limitations;
f. Defining and assessing the Parties’ Projected Flow Capacity Needs, loading requirements and options;
g. Evaluating proposals regarding any capacity reallocation;
h. Evaluating proposed permit conditions, including potential capacity and financial impacts;

Specific Functions. The incumbent’s responsibilities and duties shall include, but not limited to the following functions:

a. Derivative Agreements, except for Limited Party Agreements, and amendments to or termination of Derivative Agreements, except for Limited Party Agreements, entered into pursuant to Section 11, in order to address routine, procedural or operational elements of this IMA;
b. Final interpretations of this IMA and Derivative Agreements for matters referred to it by the Regional Committee or when dispute resolution has been invoked;
c. Action on issues covered by this IMA and Derivative Agreements that have a potential policy or fiscal impact on the Parties, or on the capability of Blue Plains to effectively provide wastewater treatment; and
d. Other duties as set forth in this IMA.
Specific Functions. Policy development and review. Overview & Scrutiny Committee and its Sub- Committees may:
i) Assist Council Assembly and the Executive in the development of its Budget and Policy Framework by in-depth analysis of policy issues;
ii) Conduct research, community and other consultation in the analysis of policy issues and possible options;
iii) Consider and implement mechanisms to encourage and enhance community participation in the development of policy options;
iv) Question members of the Executive and Chief Officers about their views on issues and proposals affecting the area; and
v) Liase with other external organisations operating in the area, whether national, regional or local, to ensure that the interests of local people are enhanced by collaborative working.
vi) Decide whether to consult with Community Council’s as part of the consideration of the Budget and Policy Framework.
i) Review and scrutinise the decisions made by and performance of the Executive and Council Officers both in relation to individual decisions and over time;
ii) Review and scrutinise the performance of the Council in relation to its policy objectives, performance targets and/or particular service areas;
iii) Question members of the Executive and Chief Officers about their decisions and performance, whether generally in comparison with service plans and targets over a period of time, or in relation to particular decisions, initiatives or projects;
iv) Make recommendations to the Executive and/or Council Assembly arising from the outcome of the scrutiny process;
v) Review and scrutinise the performance of other public bodies in the area and invite reports from them by requesting them to address the scrutiny committee/sub-committee and local people about their activities and performance; and
vi) Question and gather evidence from any person (with their consent).
