Substitute Differential Clause Samples

The Substitute Differential clause defines the financial adjustment made when a substitute is used in place of an original party, product, or service under a contract. Typically, this clause specifies how the difference in cost or value between the original and the substitute will be calculated and who is responsible for paying or receiving the differential. For example, if a supplier cannot deliver a contracted item and a replacement is sourced at a higher price, the clause determines how the extra cost is handled. Its core function is to ensure fairness and clarity in financial obligations when substitutions occur, thereby preventing disputes over unexpected costs or savings.
Substitute Differential. When an employee is absent from his/her duties on account of illness or accident for a period of five months or less, whether or not the absence arises out of or in the course of employment of the employee, the amount deducted from the salary due him/her for any month in which the absence occurs shall not exceed the sum which is actually paid a substitute employee employed to fill his/her position during his/her absence.
Substitute Differential. Upon exhaustion of all accrued sick leave credit, if the worker is unable to work because of illness, injury or pregnancy disability, the worker may commence substitute difference leave, a paid leave, wherein the worker shall receive the difference between the worker’s regular salary and the amount actually paid to a substitute, hired to temporarily replace the disabled worker. Workers may utilize substitute difference leave only upon exhaustion of accrued sick leave and only for a maximum of five (5) months including days when the worker utilized accrued sick leave benefits. If no substitute is hired the employee is entitled to their regular pay during this five month period. Workers may qualify for substitute differential from the first date of illness covered by this section when a doctor’s note is presented which includes a statement of necessity to be absent from work identifies the nature of the illness, and indicates the dates authorized to be absent. 8.3.1 The worker must exhaust all sick leave. 8.3.2 The worker must provide a doctor’s verification of illness or accident acceptable to the District.
Substitute Differential. A differential of fifty percent (50%) will be added to the hourly rate for education assistants who substitute for an absent teacher. Substitutions of less than one-hour time will not be eligible for this differential. A time sheet must be submitted by the employee to request payment of the substitute differential.
Substitute Differential. An employee substituting in a higher classification, will be paid the wages for that classification after the second consecutive day retroactive to the start of the substitute service.
Substitute Differential. Whenever any non-certificated employee is designated by the immediate supervisor, principal or Superintendent to substitute for and perform the duties of another employee at a higher rank, the substituting employee shall receive the higher pay differential, based on his or her step on the higher-rank salary guide, retroactive to the first (1st) day of assignment provided he/she performs the duties of another employee at a higher rank for five (5) consecutive days in the position.

Entitlement to sick leave provisions under this 18 section shall be used after entitlement to all regular sick leave, 19 accumulated compensation time, vacation time, or other available 20 leave has been exhausted.
Substitute Differential. An employee substituting for a head custodian shall receive the differential after the second consecutive day retroactive to the start of the substitute service.

  • Shift Differential A. Shift differential will be $.60 cents per hour. B. Employees eligible for shift differential are those whose work shift begins before 6:00 a.m. or ends on or after 7:00 p.m. and are scheduled by their supervisor for a total shift of at least six (6) hours in duration. This shift differential shall not apply to those employees who have requested and have been granted flexible work scheduling.
