System Performance. The Contractor shall ensure, following consultation with the State, that CIVLS is properly sized and ensure that the system has the capacity to deliver at the high performance levels demanded by high transaction volume environments such as DMV, as further set forth in this Agreement. The Contractor acknowledges and understands that rapid response time is critical in such demanding customer service environments and has architected CIVLS in order to minimize latency. CIVLS shall meet the system performance standards set forth in Schedule D.

System Performance. In connection with the hosting of the Systems and during both the Work Order Term, Sabre will comply with the Service Level Agreement set forth in the attached Appendix H.
System Performance. Both the Participant and VDOT shall report to the other within two business days any system failure or degradation that may affect Violations Processing Services. In the event that the Participant is unable to send transactions for periods in excess of two business days, the Participant must notify the manager of the Violations Processing Center prior to sending any backlogged violations transactions. If the Violations Processing Center is unable to process violation transactions for the Participant for any period in excess of 24 hours, VDOT shall notify the Participant within two business days of such occurrence.

Client and SunGard K-12 Education will work together to isolate performance bottlenecks, should they occur, and to identify whether they are related to the data communications link, the SunGard K-12 Education computer server, or the Client’s local network. SunGard K-12 Education will provide sufficient Internet access bandwidth and server capacity for the duration of this Agreement to meet the reasonable performance requirements of the number of concurrent system users provided for in this Agreement.

In the event that the Participant is unable to send E- ZPass transactions for the Facility for periods in excess of 24 hours, the Participant must notify the Authorized VDOT Representative prior to sending any backlogged E-ZPass transactions for the Facility. If VDOT is unable to process E-ZPass transactions for the Facility for the Participant for any period in excess of 24 hours, VDOT will notify the Participant as promptly as possible and no later than 72 hours of such fact.
(b) Any E-ZPass transactions for the Facility not sent within 60 business days of occurrence are subject to deletion from the patron’s account and related revenue may not be recorded or transferred unless the delay is due to failure by VDOT, in which case the related revenue will promptly be transferred to the Participant.
System Performance. ▇▇▇▇▇▇ may use data concerning Customer’s or its Users’ use of the Services (“Usage Information”), including but not limited to compiling statistical and performance information related to the operation of the Services. For the avoidance of doubt, Usage Information excludes all Customer Property. The foregoing shall not limit, in any way, ▇▇▇▇▇▇’s confidentiality obligations as set forth in Section 7 of the Agreement. Customer agrees that ▇▇▇▇▇▇ may make Usage Information publicly available, provided that such use does not identify Customer or any Users either directly or indirectly. Jasper retains all intellectual property rights in Usage Information.
