Use of Project Site. During the Term of this Lease Deed, the Lessee agrees to use the Project Site for implementing the development of Project Site as defined in the Concession Agreement. Lessee is not permitted to utilize the Project Site for any other purpose.

Use of Project Site. Borrower shall not (nor shall Borrower allow any Project Company to) use, or permit to be used, the Project Site for any purpose other than for the construction, operation and maintenance of the Projects as contemplated by the Operative Documents, without the prior written consent of Administrative Agent (with the consent of the Majority Lenders, acting reasonably), or locate any portion of any Project on a site other than as permitted by the Operative Documents, except, in each case, to the extent such use does not conflict with the business of Borrower (or the Project Companies) or Borrower’s (or the Project Companies’) compliance with the Material Project Documents in effect from time to time.
Use of Project Site. 3.6.1 Design/Builder shall confine operations at the Project Site to areas permitted by law, ordinances, permits, and the Contract Documents. 3.6.2 Design/Builder shall perform no operations of any nature on or beyond the limits of the Work or premises, except as such operations are authorized in the Contract Documents, or authorized by the District. 3.6.3 Design/Builder shall provide and maintain a temporary construction fence and suitable temporary barriers to prevent public entry; protect the work and existing facilities, persons, trees and plants from damage or injury from construction operations, or trespassers. Temporary barriers shall be maintained in a structurally sound condition and neat appearance. 3.6.4 Should regulatory requirements necessitate construction of temporary barriers, barricades, or pedestrian walkways not indicated or specified, Design/Builder shall construct such barriers at no increase to the Stipulated Sum. If required, Design/Builder will paint such items in a color selected by the District.
Use of Project Site. 3.13.1. CMR shall confine operations at the Project Site to areas permitted by law, ordinances, permits and the Contract Documents. 3.13.2. CMR shall perform no operations of any nature on or beyond the limits of Work or Site, except as such operations are authorized in the Contract Documents, or authorized by the Judicial Council, in writing. 3.13.3. CMR shall ensure the limits of Work to be free of graffiti or other similar defacements during the time of the Contract. 3.13.3.1. If defacement occurs, then the CMR shall promptly and properly remove, repair, or correct the affected area(s), or as otherwise directed by the Judicial Council. 3.13.3.2. CMR shall protect all exposed surfaces within the limits of Work, with anti-graffiti coatings, and maintain adequate protection at all times during the Contract Time. 3.13.4. Prohibitions. 3.13.4.1. The use or possession of alcohol, weapons, or illegal controlled substances by the CMR, or others under the CMR's control, on Judicial Council property or the Site is not allowed. 3.13.4.2. CMR, or others under CMR’s control, shall not reside on the Site at any time during the Contract Time.

Use of Project Site. 4.3.1 Notwithstanding anything contained in this Agreement, the Concessionaire hereby unconditionally and irrevocably confirms, acknowledges and agrees that the Concession Assets Project Site shall be used for the sole purpose of implementation of the Project and for enjoying the rights and benefits of the Concession granted hereunder and that the Concessionaire shall use the Concession Assets Project Site only for the purposes of implementing the Project thereupon and for purposes incidental or necessary thereto subject always to the terms and conditions of the Applicable Standards. The Concessionaire shall, in carrying out its obligations under this Agreement, utilize all existing roads and land areas at the Concession Assets Project Site. 4.3.2 The Concessionaire hereby undertakes that it shall not without prior written consent of the GoS use the Project Site for any purpose other than: (a) for the purposes of the Project and purposes incidental thereto; (b) as permitted under this Agreement (including for the purposes set out in Article 29 (Additional Matters); or (c) as may otherwise be approved by the GoS in writing.
Use of Project Site. The Borrower shall not use, or grant consent for any third party to use, the Site for any purpose other than for the construction, operation and maintenance of the Project as contemplated by the Operative Documents, without the prior written approval of the Controlling Party. Notwithstanding the foregoing, the Borrower shall have the right to amend the PILOT Agreements (a) to delete the Switchyard Easement and the Transmission Line Easement from the premises leased thereunder; (b) to direct the City to convey the Switchyard Easement and the Transmission Line Easement to Entergy at such time as the switchyard and related transmission facilities have been constructed pursuant to the Interconnection and Operation Agreement provided the City retains a nonexclusive easement (the “Retained Easement”) over the Switchyard Easement and grants the Borrower and the Co-Participants the right to use such easement pursuant to such amendments to the PILOT Agreements; and (c) to provide for the development, construction, ownership, operation and maintenance of Unit II and the Shared Facilities (to the extent such amendments are not materially adverse to the Borrower or the Secured Parties). At the Borrower’s request and subject to the procedures set forth in Article V of the Collateral Agency Agreement, the Collateral Agent shall execute and deliver such documents as may be reasonably required to release the Switchyard Easement, Transmission Line Easement, and the Unit II and the Shared Facilities parcels from the Lien of the Mortgage encumbering such property. Upon the execution and delivery of such amendment to the PILOT Agreements, the Borrower shall execute such documents as may be reasonably required to subject the Borrower’s interest in the Retained Easement to the Lien of the Mortgage and provide any reasonably requested date-down endorsements.
