The Employer will continue its efforts to schedule consecutive days off while taking into consideration the requirements and efficiency of operations and the wishes of the employees concerned. Work schedules shall provide for at least a twelve hour interval following the completion of any regularly scheduled shift before the start of the next regularly scheduled shift. The scheduled starting time for an employee following a scheduled day off or two scheduled days off shall be at least nine hours later than the completion time of his last scheduled shift prior to the time off. No employee shall be scheduled to work more than seven consecutive days. A scheduled employee shall receive overtime premium for time worked by him in excess of the normal work week or work day. An employee who is required to work on a scheduled day off shall receive overtime premium for work performed that day. If an employee is required to work a second scheduled day off in a week, or a second consecutive scheduled day off, he shall receive two times his basic salary for work . performed by him on that day. Employees shall be entitled to a ten-minute rest period, on the employer’s time, for each four hours of working time. Rest periods shall be scheduled shift before as close as possible to the mid-point of the work period. Each Paraeducator’s schedule will reflect the rest period. The District will ensure that employees shall be provided compensated, transition time, so that the employee is able to access their entire lunch and/or break periods. 3.5 When an employee is scheduled to travel from one work assignment to another, travel time shall be provided in addition to the employee’s duty free lunch break. Paraeducators may claim mileage for required travel between work assignments. Mileage is to be reimbursed at the Internal Revenue Service current rate. 3.6 Any in-service training jointly organized by the Association and the District at which attendance is required will be at the employee’s regular rate of pay. Fiscal resources permitting, each Paraeducator shall be provided an opportunity to participate in eleven (11) hours per year of in- service training at regular pay at the direction of the building principal. The District will reimburse all approved direct costs to employees whom it requires to take classes or trainings. The district shall provide specialized staff development opportunities for all OPA members to stay current with the best practices and promote professional growth. Up to two (2) hours of the available eleven (11) hours of staff development time will be provided in order to disseminate and discuss a school’s School Improvement Plan (SIP) or similar document reflecting a school’s goals, plans and initiatives. 3.7 Each employee for whom constructive tasks are available shall maintain his/her regular hours of employment during conference week unless, prior to conference week, the employee requests shorter hours to conform to the student schedule. An employee who works shorter hours during conference week may either submit a time slip to deduct the number of hours not worked, or the employee’s administrative supervisor shall direct alternate work responsibilities in lieu of shortened hours for those employees who do not want shortened hours. Any hours deducted will appear in the payroll warrant for the month submitted. Employees will have the option of working up to four hours, on other than a student day, in exchange for release time from an early release day or a day that parent/teacher conferences take place. The use of this time shall be cooperatively planned with the principal or Paraeducator’s direct supervisor. Health room Paraeducators may work an additional eight hours prior to the start of the next regularly scheduled shiftschool year and three hours at the end of the school year for the preparation and closure of the health room. 3.8 Employees who chaperon for the Cispus Outdoor Program shall be compensated at their regular rate of pay, per hour, for their usual daily hours worked; for the remaining time, they shall be compensated at the base rate. Compensation is based on a twenty-four-hour (24) workday. Employees shall also receive the usual IRS mileage reimbursement. 3.9 The scheduled starting District shall provide adequate planning time for an employee following Paraprofessionals responsible for individual students, or groups of students, based primarily on - but necessarily not limited to - the total time and the particular requirements of individual, and group, direct instruction. 3.10 All Paraeducators required to participate in department meetings, staff meetings, IEPs and site- based meetings beyond their scheduled work day will be time slipped at their regular hourly rate of pay. 3.11 A stipend will be provided as compensation for unit members involved in staff development planning and presentations. When planning activities are necessary in order to prepare for staff development presentations, a stipend of $50 per actual workshop hour will be provided to be shared equally among those involved in the planning process. If the planning activity occurs during the individual’s scheduled day off or two scheduled days off workday, the individual must be in a leave without pay status to be eligible to receive stipend compensation. Compensation will also be provided at the individual’s normal hourly rate during the workshop presentation as long as the workshop is conducted outside the normal workday. 3.12 The District agrees to pay the cost of the ParaPro Assessment, for all currently employed Paraeducators. Each Paraeducator shall be at least nine able to use any portion of the eleven (11) hours later than referenced above in Section 3.6 to participate in trainings or other activities designed to promote success on the completion time of his last scheduled shift prior to the time offParaPro Assessment. No employee Testing shall be scheduled provided within the Paraeducators workday. 3.13 In the event of snow or other such natural events, employees will make an effort to work more than seven consecutive days. WORK AND OVERTIME. The normal regular scheduled work week for employees each employee consists of five eight-hour days, Mondaythrough Friday, inclusive. However, this is thirty-five hours, and in not to be construed as a guarantee of full employment. The foregoing does not constitute a guarantee of either daily or weekly hours. The Company will pay for employees is thirty-five hours, and hours worked except where stated in the case Agreement. Over- time regulations shall not be a limitation upon the number of scheduled employees hours per day or days per week that the normal Company may operate its Plant or schedule its employees. Scheduled hours within a shift will be consecutive, with the exception of the meal period. While it is the Company’s preference to sched- ule work week day is seven hoursMonday through Friday, it may due to the needs of the business, schedule regular shifts on Saturday Sunday. If such shifts are to be introduced, the Company and the Union shall meet prior to the implementation of the new shifts to discuss and resolve issues around staffing and the recognition of seniority during the staffing process. Overtime premium will be one at the rate of time and one half times the straight time hourly rate shall be paid for all authorized hours worked in excess of hours per week or hours per day. Time and one half the straight time hourly rate shall be paid for all authorized hours worked on calendar Saturday, except for employees whose work regularly falls on Saturday. Double the straight time hourly rate shall be paid for all au- thorized hours worked on calendar Sunday, except for em- ployees whose work regularly falls on Sunday. Employees who regularly work on Sunday shall receive another day off in lieu of Sunday. If they work on such off day, they shall receive double time for hours worked on that day. Where an employee works scheduled day on Sunday and has two week days off, the second day shall be considered to be the day in place of Sunday. Employees working on shifts regularly scheduled to com- mence prior to on Sunday shall receive a pre- mium of per hour for all hours worked at regular rates on calendar Sunday. Such premium shall not be considered as part of such employee’s basic salary or compensating time and one-half off with basic salary, rates. Any employee who is called in to work shall receive a min- imum amount equal to four (4) hours work at the option of the employee. Any such time off will be taken at a time mutually agreeable between the employee and the employee’s Bureau Chief or department supervisor. Commencing with time owing accumulated on or after January the employee will be notified of any outstanding time owing accumulated since the previous January 1 on December of each year. That time must be taken by December of the following year or will be paid in cash at the rate applicable when it was earned. (a) The Employer will post work schedules of days and hours in each bureau for employees working at or out of the bureau, and whose normal work week is not averaged, three weeks in advance of the week for which they apply. Work schedules may be changed subject to the requirements of operations provided that the affected employee has been consulted and the Employer has taken into consideration the wishes of the employee. The Employer shall arrange its work schedules so that an employee does not have to work day shifts, night shifts and overnight shifts in the same week. The Employer will to schedule within the week all day shifts, all night shifts and all overnights consecutively. The Employer will continue its efforts to schedule consecutive days off while taking into consideration the requirements and efficiency of operations and the wishes of the employees concerned. Work schedules shall provide for at least a twelve hour interval following the completion of any regularly scheduled shift before the start of the next regularly scheduled shift. The scheduled starting time for an employee following a scheduled day off or two scheduled days off shall be at least nine hours later than the completion time of his last scheduled shift prior to the time off. No employee shall be scheduled to work more than seven consecutive days. A scheduled employee shall receive overtime premium for time worked by him in excess of the normal work week or work dayprevailing rate. An employee who is required to work on a scheduled day off shall receive overtime premium reports for work performed that day. If an employee is required to work a second scheduled day off in a week, or a second consecutive scheduled day off, he shall receive two times his basic salary for work . performed by him on that day. In either case, the minimum payment will be four hours pay at the appropriate premium rate. An employee working averaged work weeks shall be entitled to holiday pay in accordance with Article meal allowance as defined in Article and shift differential in accordance with Article for each week in which the employee works seven or more hours between p.m. and a.m. . An employee who is required to report for work and does so on a call back shall receive a minimum of four hours work or four hours pay at the appropriate premium regular straight time rate. There shall be no duplication In the event of forced shutdown or pyramiding curtailed operations for reasons beyond the con- trol of overtime premiums the Company, or any other premiums under this Agreement. For the purpose in cases where an employee fails to notify ▇▇▇▇▇▇▇ of this Agreement, “week” or “calendar week” shall mean intention to return to work following a period of seven days commencing Sunday at A.M. The averaging provisions of Sections and of the Agreementabsence, this provision shall not apply. Regular employees shall be suspended for employees assigned given as much notice as reason- ably possible but not less than two (2) working days notice when required to full-time election coverage during an election campaign or when assigned for change shifts on a temporary basis. WORK AND OVERTIME. The following paragraphs and sections are intended to define the normal hours of work and shall not be construed as a guarantee of hours of work per day or per week or of days off per week. The working day for all full time employees covered by this Agreement shall consist of seven and one-half (7 hours, excluding a thirty (30) minute meal period which, except under emergency conditions, shall be continuous and uninterrupted. The work week for all full time employees is over a two (2) week cycle shall be an average of thirty-five seven and one-half (37 hours, with an average of five (5) working days per work week. Shift schedules shall be arranged so that an employee is not scheduled to work more than six (6) consecutive days. Any employee that works in excess of six (6) consecutive days shall be paid overtime for each consecutive day.
