WORKING HOURS AND OVERTIME. (1) The number of working hours and overtime shall be regulated in accordance to the Employment Act.
(2) The hourly rate of pay for overtime after midnight shall be double the hourly rate of pay.
WORKING HOURS AND OVERTIME. A. The workweek shall be Monday through Sunday. For full-time em ployees, eight (8) hours shall constitute a day's work and forty (40) hours, consisting ot five (5) eight (8) hour days out of seven (7) shall constitute a regular week's work. All time worked in excess of eight (8) hours in any one single day or in excess of forty (40) hours in a week shall be paid for at time and one-half (1-1/2) the current regular straight-time hourly rate. In no event shall any employee work in excess of ten (10) hours in any one single day, unless by consent ot the Union.
B. The regular day's work for employees shall be worked within nine (9) consecutive hours, and one (1) hour off for lunch shall be allowed at approximately the middle of the working day.
C. As used herein, the words "store or stores" shall include, but not be limited to, establishments selling food and food products to consumers for consumption off the premises, including grocery stores, delicates sens, fruit and produce stands, dairy stores, bakeries, liquor and cigar and candy stores within the jurisdiction of Local 399 as specified herein.
D. A work schedule for all employees shall be posted no later than the end of the first shift on Friday preceding the first day of the following workweek. In the event of an emergency, or other reasonable cause, such schedule may be altered by the Employer during the workweek.
E. Where a five (5) day, full-time employee is scheduled to work more than seven (7) consecutive days in any combination of workweeks, said employee shall receive time and one-half (1-1/2) (or such higher pre mium as may apply) for all time worked after the seventh (7th) consecu tive day, until such time as his consecutive days of work have been in terrupted by a prescheduled day off. The above*shall not apply to em ployees scheduled for more than forty (40) hours per week, provided that overtime and/or premium rates are paid where applicable. For the purpose of this paragraph, a prescheduled day off, worked or not worked, shall interrupt the continuity of consecutive days worked.

Possible use of rest days other than Saturday, Sunday or Monday, where these may be required under this Agreement, to be explored by the parties.
8.4 All hours worked in excess of 8 hours in any one day, or 40 hours in any one week, shall be paid at one and one-half times the hourly rate of pay. This does not apply to positions as outlined in Article 8.1.1.
8.4.1 All hours worked in excess of 10 hours in any one day, or 40 hours in any one week, as specified in Article 8.1.1 shall be paid at one and one-half times the hourly rate of pay.
8.5 Employees, if required to work on regularly assigned rest days, shall be paid at the rate of time and one-half time on the actual minute basis with a minimum payment of 4 hours at the pro rata hourly rate.
8.6 Where work is required by the Company to be performed on a day which is not part of any assignment, it may be performed by an available extra or unassigned employee who will otherwise not have 40 hours of work that week. Overtime shall be allocated on the basis of seniority wherever possible, in a voluntary manner, within the work classification and shifts, provided the employee is capable of performing the duties; however, upon reaching the bottom of the seniority list in that classification and shift, the junior employee(s) will be required, in reverse order, to work the overtime.
8.7 Excluding Linehaul operations, employees shall not be required to take more than 60 minutes for a meal period and, if practical, 30-minute meal period will be utilized. During the term of this agreement, the normal Fire Duty Cycle for Firefighter/Engineer and Captain shall consist of two twenty four (24) hour shifts followed by ninety-six (96) hours off duty. Shifts shall not exceed forty-eight (48) hours duration, commencing at 7 o’clock a.m. Regular overtime is time worked by a Firefighter/Engineer or Captain, beyond forty-eight (48) hours in the standard fire duty cycle. For purposes of computing regular overtime, vacation, sick and compensatory time shall be considered time worked.
b. Overtime for Fair Labor Standards Act (FLSA) purposes is time worked by a Firefighter/Engineer or Captain beyond one hundred eighty-two (182) hours in a twenty-four (24) day work period (as that term is used by the wage and hour division of the Department of Labor) and is the time frame in which hours worked will be counted for the purpose of computing overtime under FLSA regulations.
c. All overtime work authorized by the Chief or his/her designee shall be paid at time and one-half. Employees shall have the option to accumulate Compensatory Time Off (CTO) in lieu of pay for overtime worked. CTO may be accumulated at a rate of 1.5 to 1.0 up to a total of 240 hours maximum, and may be taken at a time mutually convenient to the employee and employer and subject to the vacation schedule. Total accumulated hours by employee will be calculated on July 1 of each year. Employees who have accumulated more than 240 hours as of July 1 will be notified by the employer of that fact, and allowed to schedule time off to bring the hours accumulation to below 240 hours. CTO in excess of one (1) hour shall be calculated in 1/2 hour increments. No employee shall be allowed to carry more than 240 comp time hours on the books.
d. All overtime worked, up to a maximum of eight (8) hours, shall be computed at a minimum of one-hour overtime computed on a 40 hour work week rate. For time worked between 8 and 12 hours, the employee shall be paid eight (8) hours at the 40 hour work week rate. Any overtime in excess of 12 hours is paid based on a 56 hour work week rate.
e. Employees may exchange shifts in accordance with the shift trade policy appended hereto as Exhibit "B”.
f. The Chief may assign, at his or her discretion, for a period not exceeding thirty

WORKING HOURS AND OVERTIME.
A. The work week is Monday to Sunday inclusive. It will consist o f five ( 5 ) work days totaling forty hours and two ( 2 ) days off. The work day will, where practicable in the Company’s opinion, be scheduled to provide a meal period of a minimum of one-half (V 2 ) hour and a maximum of one ( t ) hour, exclusive ol working time.
B. Overtime for full-time employees is that time worked in excess o f the scheduled hours o f work for any one ( 1 ) day or in excess of forty ( 4 0 ) hours in a work week. Overtime for part-time employees is that time worked in excess of forty ( 4 0 ) hours in the work week. Such overtime worked will be paid for at the rate o f time and one-half (1 Vi ) the hourly rate and for Station Managers and Assistant Station Managers time and one-half ( 1 V2 ) on proportionate Incentive pay.
C. Station Manager will be permitted the option of taking Sundays~offi
D. Scheduled hours for full-time employees will provide at least eight ( S ) consecutive hours elapsed time between shifts. A full-time employee will not be required to work more than three ( 3 ) consecutive shifts which end later than 8 p.m. This limitation does not apply to the early morning shift at all-night stations. These provisions will not apply where shift changes are required because of the failure or inability of an assigned employee to work his shift or because of an employee's leaving service without reasonable notice or on single coverage stations.
E. Regular employees will not be required to work an actual closing shift later than 8:00 p.m. prior to his days off.
WORKING HOURS AND OVERTIME. A. FULL-TIME EMPLOYEE
1. Full-Time Pharmacist. Full-time Pharmacists shall receive forty (40) hours work per week. The workweek shall be Monday through Sunday. Eight (8) hours shall constitute a regular day’s work, and forty (40) hours, consisting of five (5) eight (8) hour days shall constitute a regular week’s work. All employees hired to work on a full-time basis or who are scheduled and work at least forty (40) hours in ten (10) consecutive weeks shall be guaranteed forty (40) hours work per week, except in a holiday week, in which it shall be thirty-two (32) hours, provided the employee is available and able to work the required work schedule. Part-time jobs shall not be created or scheduled for the purpose of destroying the forty
