For purposes of this Lease, the number of square feet of rentable area in the Premises, Building and Project (including without limitation, the Common Building Areas), has been and will be determined by measuring from the exterior face of exterior walls, and from the midline or centerpoint of interior or party walls.
Subject to and in accordance with the terms of this section, Subtenant and Sublandlord each shall have the non-exclusive right to use the “Server” room and “IT Office” that are part of the Shared Building Areas, as shown on Exhibit E (collectively, the “Shared IT Areas”), for the limited purpose of installing and operating computer servers, telecommunication systems and related equipment serving its operations at the Project and activities incidental thereto.
Sublandlord and Subtenant each shall have the right to use the training and conference rooms that are part of the Shared Building Areas, in accordance with reasonable scheduling procedures established by Sublandlord, from time to time.
Without limiting the scope of such discretion, Landlord shall have the full right and authority to designate a manager for the parking facilities, Building Areas, Common Areas and other facilities who shall have full authority to make Landlord enforce rules and regulations regarding the use of the same or to employ all personnel to and necessary for the proper operation and maintenance of the parking areas, Building Areas and Common Areas and other facilities.
Tenant shall have the nonexclusive right to the use in common with other tenants in the Building, subject to the Rules and Regulations referred to in Section 13.16 below, the Common Building Areas appurtenant to the Premises, as they may change from time to time.
Landlord covenants that the location of buildings and other tenant space therein will only be within the "Permissible Building Areas" as shown on the Site Plan, and the parking ratio for the Shopping Center shall be at least as shown thereon, but in no event shall said ratio be less than the greater of (i) three and one-half (3-1/2) spaces per 1,000 square feet of gross leasable area (excluding mezzanine space and outside sales area) or (ii) that required by applicable zoning requirements.
Notwithstanding the foregoing, Building Areas shown on EXHIBIT A-2 shall not be deemed to become a permanent part of Common Area where buildings have not yet been constructed or have been demolished in connection with anticipated redevelopment of such Building Area.
The term "Common Areas" shall include, without limitation, (i) all interior common mechanical rooms, utility rooms, restrooms, vestibules, stairways or corridors within the Building not intended to selectively serve one or more tenants (herein, "Common Building Areas"), and (ii) all exterior pedestrian walkways, patios, landscaped areas, sidewalks, service drives, plazas, malls, throughways, loading areas and parking areas not exclusively reserved to Tenant, entrances, exits, driveways, and roads.
Tenant covenants and agrees that all Tenant’s Property of every kind, nature and description which may be in or upon the premises or Building, or in the Building Areas during the term hereof, shall be at the sole risk of Tenant.
