The Planned Completion Date may be extended in the event of a delay, provided that Developer duly requests a time extension in accordance with this Section 5.4 and such extension is authorized under this Article V.
Without prejudice to the Authority's right to terminate this Agreement pursuant to Clause 8.8 and Clause 43 (Contractor Failures) or otherwise, Clause above shall apply in respect of any failure to meet any revised Planned Completion Date.
