The Adaptive Management Strategies clause establishes a framework for modifying project plans or operations in response to new information or changing circumstances. Typically, this clause allows parties to periodically review outcomes, assess risks, and implement adjustments to methods, schedules, or resource allocations as needed. Its core practical function is to provide flexibility and ensure that the project can effectively respond to unforeseen challenges or evolving requirements, thereby reducing the risk of project failure due to rigid or outdated approaches.

Adaptive Management Strategies. Adaptive management strategies allow changes to the conservation measures agreed upon by the Parties to occur in response to changing conditions or new information, including those identified through the annual monitoring program. The primary purpose of adaptive management is to examine potential modifications to existing Conservation Measures or alternative strategies that might be suggested by research, monitoring and evaluation to better achieve the goals and objectives of the Agreement consistent and in concert with other DLL objectives including, but not limited to, livestock production and other wildlife needs. Within this adaptive management framework, if it is determined by the Parties that the results of existing management are not achieving desired results, the Conservation Measures may be modified or an alternative strategy adopted. These modified or alternative, adaptive management strategies will only be adopted through mutual agreement after discussion and evaluation of the Parties that would occur at the annual reporting/coordination meetings. In the event that such modifications or adaptive management strategies are considered minor, it will not be necessary to make changes to the Agreement. If the modifications or adaptive management strategies are considered to be major, then changes to the Agreement may be necessary and in such an event the Parties will determine and agree on a procedure to make amendments in accordance with procedures described in Section 12.

Adaptive Management Strategies. Adaptive management allows for mutually agreed- upon changes to the Agreement’s management activities in response to changing conditions or new information. If the expected results of the management activities appear ineffective after a certain period of time (will vary dependent upon conservation measure, but should be no more than one breeding season), management activities can be changed or alternative activities undertaken to achieve desired results. Adaptive management will be based upon results from the compliance and biological monitoring described in Appendix 4 and provide for readjustment of management activities that have shown to be ineffective and/or amendment of the Agreement to achieve the Agreement’s biological goal.   • SITE MANAGEMENT We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.
