Advisory Panel. In the case of disagreement about the meaning or application of this document or if an agreement is not reached during negotiations, the matter will be submitted to an advisory panel within ten (10) days after the request of either party to the other. The Board will name one member and the Association will name another. A third member who shall be the chair shall be designated by the first two noted members. Members of such an advisory panel shall not be members of the Board of Education or employees of such Board. In case the first two members fail to agree on a third member within ten (10) days after receiving a written request by either party to so act, the American Arbitration Association shall be requested to submit to them a list of seven (7) arbitrators. The selection of the arbitrator shall be according to the voluntary rules of the American Arbitration Association. The advisory panel shall have the authority to hold hearings and to confer with any persons deemed advisable in seeking to effect recommendations for resolving the disagreement. Within fifteen (15) days after receiving the matter(s) under dispute, or by mutually agreed date, the panel shall first report recommendations for settlement to the negotiation teams. The Association shall take action upon the recommendations of the advisory panel within fifteen (15) days after the receipt of said recommendations. The Board shall take action upon the recommendations of the advisory panel at a special or regular meeting conducted not less than fifteen (15) days nor more than thirty (30) days after the receipt of said recommendations.
Advisory Panel. In the event an agreement is not reached by negotiation after full consideration of proposals and counter-proposals, either of the parties shall have the option of declaring impasse, and thereby creating an Advisory Panel of three (3) persons within ten (10) days of said declaration. One member shall be designated by the Board, one member by the recognized classified employee organization, and these shall select a third person. The third person, who shall act as chairperson, shall be named by the first two appointed members. If the two cannot agree on the third, the third person shall be selected from the list or lists of arbitrators from the American Arbitration Associations in accordance with their voluntary rules and regulations. The Advisory Panel shall act as fact-finders, conferring with both parties and making recommendations for settlement of the issue(s) in question. Each party will pay the expenses of its own representative on the Advisory Panel. However, the expenses of the chairman will be shared equally by the Board and the recognized classified employee organization. The recommendations of the Advisory Panel shall be submitted to the negotiators for consideration. If agreement is not reached within ten (10) days, or a mutually agreed upon date, it shall be submitted to the recognized classified employee organization for action and the Board for action within ten (10) days after being submitted. Said report shall be made public after the action of both parties. If the two parties agree on the panel’s recommendation for settlement, it shall be approved in accordance with Article VII Agreement.
Advisory Panel. If after sixty (60) calendar days from the first negotiation session agreement has not been reached on all items under negotiation, either party may call for the services of the Federal Mediation and Conciliation Service to assist in negotiations. If a party calls for FMCS involvement, the other party shall join in a joint request. The Board and the Association agree that the Federal Mediation shall supersede all other dispute settlement procedures contained in Section 4117.14 of the Ohio Revised Code. This does not limit the Association’s right to strike under 4117.14(D)(2) in the Ohio Revised Code (ORC). The Association retains the right to strike for health and safety reasons after compliance with the procedures of ORC 4117 and the ruling of SERB.
Advisory Panel. The director of the ICMPD shall be assisted by an advisory panel, in which political and scientific representatives from various interested countries and international organizations shall be able to participate. The panel shall have no authority over the director but may propose projects and assist in obtaining the requisite funds.
Advisory Panel. (A) PDE will establish the “Bureau Director’s Advisory Panel on Least Restrictive Environment Practices” (the Advisory Panel), a special advisory group to the Bureau Director. The purpose of the Advisory Panel will be to review system-wide progress in the delivery of individualized specially designed instruction in regular education classrooms to students with disabilities in Pennsylvania, to analyze and report periodically on the status of implementation of this agreement, and to advise PDE on implementation.
(B) The Advisory Panel will consist of fifteen members, at least nine of whom will be parents of children with disabilities who are not employed by PDE or by any school district or other local educational agency in Pennsylvania. During the life of the Settlement Agreement, the members will be selected annually as follows:
(1) Twelve members will be selected by the organizational plaintiffs, as provided in Section IV.2(B)(5) of the Settlement Agreement.
(2) Three members will be selected by the Bureau Director.
(3) All members will serve for terms of one year, and will be eligible for reappointment to additional terms up to a maximum of five terms in succession.
(4) The membership of the Advisory Panel will be representative of the population of children served in special education in Pennsylvania with respect to race, ethnicity, cultural characteristics, geography, and age.
(5) The organizational plaintiffs will be responsible jointly for selecting twelve members of the Advisory Panel. These members will include persons with recognized expertise in research and practices related to the provision of a free appropriate public education to children with disabilities in the least restrictive environment. The names of the organizational plaintiffs’ initial representatives will be forwarded to the Bureau Director by no later than the sixtieth day following the effective date of the Settlement Agreement, and by no later than March 31 of succeeding calendar years during the life of the Settlement Agreement.
(6) In the event of a vacancy, the party or parties who selected the member will designate a replacement.
(C) Advisory Panel members will receive reimbursement at Commonwealth rates for their travel costs to participate in the work of the Advisory Panel.
(D) The initial meeting of the Advisory Panel will be held no later than ninety days following receipt by PDE of the names of the organizational plaintiffs’ twelve initial nominees.

Advisory Panel. An advisory panel consisting of approximately four (4) representatives, unless the parties otherwise mutually agree, from each party (the “Panel”) shall be established as soon as reasonably practicable after commencement of the Initial Term. The Panel shall meet on an annual basis, unless otherwise agreed, to address issues relating to the origination, merchandising, operations and finance.
Advisory Panel. An advisory panel consisting of approximately three (3) representatives, unless the parties otherwise mutually agree, from each party (the "Panel") shall be established as soon as reasonably practicable after commencement of the Initial Term. The Panel shall meet on a quarterly basis, unless otherwise agreed, to address issues relating to the origination and merchandising of the Toledo Grain; provided, however, that the parties shall strictly follow the Guidelines in all communications between representatives of the Panel.
Advisory Panel. If the parties are unable to satisfactorily resolve the dispute, the employee may have the appeal submitted to a 3 member panel comprised of 2 members of the Civil Service Commission and 1 individual who is not a Commission member. This panel will be charged with the responsibility of making findings of fact and recommendations in connection with the employee's appeal for presentation to the Sheriff and the EPS Director. Such recommendations shall be advisory in nature. If the employee elects to have his/her appeal heard before such a panel, the employee shall choose 1 Civil Service Commissioner and the Sheriff shall choose a second Commissioner. These 2 members shall select a third member of the panel, who shall be the panel's chairperson and cannot be a member of the Civil Service Commission. If the 2 commissioners selected by the employee and the Sheriff cannot agree on a third member, the EPS Director shall choose the third member. Upon conclusion of its hearing the panel shall present its finding of fact and recommendations to the EPS Director and Sheriff. If the Sheriff and Director reject the panel recommendation they must so inform the employee, with reasons in writing. Any decision reached by the Sheriff and the EPS Director shall be final.

The Association recognizes that under Texas law, the Board shall have and exercise the exclusive con trol of the public schools within the Fort Worth Independent School District. This agreement in no way attempts to alter or diminish such statutory authority. The final decision will be made by the Board.
Advisory Panel. The Board of Directors, by resolution or resolutions adopted from time to time, may designate an advisory panel, made up of prominent and knowledgeable individuals qualified to assist the Board of Directors, to advise the Board of Directors with respect to policies and programs.
