Bona Fide Request (BFR). The process described in the UNE Attachment that prescribes the terms and conditions relating to a Party's request that the other Party provides a UNE that it is not otherwise required to provide under the terms of this Agreement.
Bona Fide Request (BFR). 48.1 Through the BFR process, CLEC may request: (a) Interconnection or access to a Network Element CenturyLink is required to provide under Applicable Law, but such Interconnection or Network Element is new, undefined or otherwise required to be provided but not available under the terms of this Agreement; (b) access to facilities and equipment that are not Currently Available, or to UNEs that are superior or inferior in quality than those that CenturyLink provides to itself; and (c) certain other services, features, capabilities or functionalities defined and agreed upon by the Parties as services to be ordered via the BFR process. 48.2 Notwithstanding anything to the contrary in this Agreement, CenturyLink shall only be required to provide or continue to provide Interconnection or UNEs and/or other arrangements and services that CenturyLink is otherwise obligated to provide under Applicable Law pursuant to the provisions of this Agreement, including the BFR process. While CenturyLink may permit CLEC to submit BFR requests for Interconnection or Network Elements, arrangements or services that CenturyLink is not obligated under Applicable Law to provide, CenturyLink is not required to provide such Interconnection or Network Elements, arrangements or services, and CenturyLink may elect or decline to provide same at its sole discretion. 48.3 Process 48.3.1 CLEC shall submit to CenturyLink a written BFR application (Request), in a form to be provided by CenturyLink and as published on CenturyLink’s Website. The Request shall specifically identify relevant technical requirements and descriptions, drawings, locations and/or any other such specifications that are reasonably necessary to clearly define the Request such that CenturyLink has sufficient information to analyze and prepare a response. 48.3.2 If fulfilling the request involves construction or engineering analysis, CenturyLink will notify CLEC in writing of the requirement for construction or engineering analysis and CenturyLink will not perform the analysis unless CLEC, at its discretion, remits the non-refundable, non-recurring (NRC) payment set forth in Table 1 to compensate CenturyLink for its costs to perform the required analysis. Bona Fide Request (BFR). 2.31.1 AT&T, Bona Fide Request Process 2.31.1.1 A Bona Fide Request (“BFR”) is the process by which CLEC may request AT&T to provide CLEC access to an additional or new, undefined UNEs, combinations or commingling (a “Request”), that is required to be provided by AT&T under the Act but is not available under this Agreement or defined in a generic appendix at the time of CLEC’s request. CLEC may request a single BFR for development of a single new UNE within AT&T. 2.31.1.2 The BFR process set forth herein does not apply to those services requested pursuant to Report & Order and Notice of Proposed Rulemaking 91-141 (rel. Oct. 19, 1992) paragraph 259 and n. 603 and subsequent rulings. 2.31.1.3 All BFRs must be submitted with a BFR Application Form in accordance with the specifications and processes set forth in the sections of the CLEC Handbook. Included with the Application CLEC shall provide a technical description of each requested UNE, combination of UNEs, or Commingling of UNEs, drawings when applicable, the location(s) where needed, the date required, and the projected quantity to be ordered with a 3 year forecast. 2.31.1.4 CLEC is responsible for all costs incurred by AT&T to review, analyze and process a BFR. When submitting a BFR Application Form, CLEC has two options to compensate AT&T for its cost incurred to complete the Preliminary Analysis of the BFR: 2.31.1.4.1 Include with its BFR Application Form a deposit to cover AT&T’s preliminary evaluation costs, in which case AT&T may not charge CLEC in excess of the deposit to complete the Preliminary Analysis; or 2.31.1.4.2 Not make the deposit, in which case CLEC shall be responsible for reasonable and demonstrable preliminary evaluation costs incurred by AT&T to complete the preliminary Analysis (regardless of whether such costs are greater or less than the deposit). 2.31.1.5 The amount of the deposit under Section 2.31.1.4.1 shall be determined through a method and shall not exceed an amount agreed to by the parties or determined in a cost proceeding. 2.31.1.5.1 If CLEC submits a deposit with its BFR, and AT&T is not able to process the Request or determines that the Request does not qualify for BFR treatment, then AT&T will return the deposit to CLEC. Similarly, if the costs incurred to complete the Preliminary Analysis are less than the deposit, the balance of the deposit will, at the option of CLEC, either be refunded or credited toward additional developmental costs authorized by CLEC. 2.31.1.6...

Bona Fide Request (BFR). 13.1. Any request for Interconnection that is not already available as described herein shall be treated as a Bona Fide Request (BFR). Qwest shall use the BFR Process to determine the terms and timetable for providing the requested Interconnection, if available, and the technical feasibility of new/different points of Interconnection. Qwest will administer the BFR Process in a nondiscriminatory manner. 13.2. A BFR shall be submitted in writing and on the appropriate Qwest form for BFRs. Paging Provider and Qwest will work together to prepare the BFR form. This form shall be accompanied by the non-refundable Processing Fee specified in Appendix A of this Agreement. The form will request, and Paging Provider will need to provide, at a minimum: (a) a new/different points of Interconnection; (b) the desired interface specification; (c) each requested type of Interconnection or access; (d) a statement that the Interconnection will be used to provide a Telecommunications Service; (e) the quantity requested; and (f) the specific location requested. 13.3. Within fifteen (15) business days of its receipt, Qwest shall acknowledge receipt of the BFR and in such acknowledgment advise Paging Provider of missing information, if any, necessary to process the BFR. Thereafter, Qwest shall promptly advise Paging Provider of the need for any additional information required to complete the analysis of the BFR. 13.4. Within thirty (30) business days of its receipt of the BFR and all information necessary to process it, Qwest shall provide to Paging Provider a preliminary analysis of the BFR. The preliminary analysis shall specify Qwest’s conclusions as to whether or not the requested Interconnection complies with the requirements set forth above. 13.5. Qwest may review Paging Provider's credit standing and modify the amount of deposit required.
