Conditions of Implementation. 1. The sending Party shall take necessary measures to oblige the Official to comply with the following conditions: (a) to comply with relevant laws and regulations of the Country of the host Party, and not to act, without legitimate reasons, in a manner inconsistent with relevant instructions by the Host Agency as to his or her activities therein; (b) not to engage in intelligence-related activities on behalf of any government when participating in the Programme; and (c) not to reveal any information that the Host Agency advises the Official is classified. 2. Before sending the Official to the Country of the host Party, the Sending Agency shall send to the Host Agency through the diplomatic channel, a document signed by the Official, stating the Official’s consent to comply with the conditions set out in sub-paragraphs (a), (b) and (c) of paragraph 1 above. Non-compliance with the above conditions may be grounds for termination of the participation of the Official in the Programme. 3. The host Party is not responsible for salaries and benefits for the Official and any other necessary expenditure of the Official, including travel expenses and living costs.

Conditions of Implementation. If during two of the three prior quarters, not including summer quarter, a discipline demonstrates a net deficit weighted student enrollment, using the appropriate formulas from appendix B, the Vice President of Academic Affairs, the Department Coordinator, the Division Chair and a Union representative appointed by the HCEA President will meet to discuss potential solutions. The Vice President of Academic Affairs will provide written notification of this meeting including substantiating data. This meeting will take place by the end of the third week of the triggering Quarter.

Conditions of Implementation. 1) If during two of the three prior quarters, not including summer quarter, a discipline demonstrates a net deficit weighted student enrollment, using the appropriate formulas from appendix B, the CAO, the Department Coordinator, the Division Chair and a Union representative appointed by the HCEA President will meet to discuss potential solutions. The CAO will provide written notification of this meeting including substantiating data and the meeting will be held by the 3rd week of the following quarter (summer excluded). 2) Any discipline whose quarterly enrollment is not sufficient to meet anticipated/planned teaching loads for tenured and tenure-track faculty after reassignment of any sections taught be part-time faculty will be designated as having a net deficit enrollment for that quarter. If two out of the three prior quarters are in a deficit enrollment situation, then the CAO, the Department Coordinator, the Division Chair and a Union representative appointed by the HCEA President will meet to discuss potential solutions. The CAO will provide written notification of this meeting including substantiating data and the meeting will be held by the 3rd week of the following quarter (summer excluded). 3) If a discipline demonstrates a net deficit weighted student enrollment for three of the next six quarters then a reduction in the number of tenured faculty in that discipline may be initiated. If a reduction in tenured faculty is necessary because of low enrollment the order of layoff will begin with those having the least seniority in the discipline. Seniority within a discipline is determined using the criteria of section 501.2.10 applied to the members of the discipline. The faculty member with the least seniority in the discipline will be the first to be laid off unless a majority of that faculty member's assignment is composed of classes or services identified as the most necessary and no one with more seniority can provide comparable services. In this case the least senior member will be passed over and the faculty member in the discipline with the second lowest seniority will be laid off. Written notification of the pending action will be provided to the affected faculty member, the Division Chair and the HCEA President. Furthermore, if the condition persists during the three quarters subsequent to the above written notification to the affected faculty member, additional layoffs can be made following the above procedure.

Conditions of Implementation. 4.1. In order to facilitate the implementation of any projects or programmes of cooperation, all equipment, services and materials financed by the Dutch Party within the scope of this Agreement shall be exempted from taxes, dues except customs fees which shall be borne by the Ukrainian beneficiaries) and other obligatory charges. 4.2. The Ukrainian Party shall grant the permits necessary for the temporary importation of the equipment required to implement the projects or programmes within the scope of this Agreement free of charge and without delay. The Ukrainian Party shall ensure that any certification and registration required to implement the projects or programmes within the scope of this Agreement shall proceed without delay and free of charge. 4.3. The Ukrainian Party agrees that for the payment procedures related to the projects or programmes of financial assistance, project management units acting on behalf of the corresponding Ukrainian projects or programmes partners can be designated by agreement between the partners of each project or programme. For payments in local currency (Ukrainian hryvnas) counterpart funds, special accounts can be opened with these project management units in accordance with Ukrainian legislation. The use of these deposited funds will be decided upon between the partners of the project or programme. 4.4. The personal possessions of experts commissioned for the implementation of projects or programmes within the scope of this Agreement, who are not citizens of Ukraine and are not permanent residents within the territory of the latter shall be exempted from dues, taxes and other obligatory charges when they are brought into the customs territory of Ukraine. If such goods are disposed of in the customs territory of Ukraine, the excise owing shall be assessed in accordance with the existing legislation of Ukraine. 4.5. The Ukrainian Party shall, within the framework of the national legislation, issue free of charge and without delay entry visas for experts and representatives participating in the agreed projects or programmes.

Conditions of Implementation. (a) Problems may be identified or may arise which are not covered by this letter of understanding, or which were not contemplated at the date of the signing of this letter of understanding. Should this occur, both parties will meet to resolve the problem(s) in the spirit of this letter of understanding to the end that no additional cost should be incurred by the company. (b) It is understood and agreed that either party has the right to cancel this agreement by providing thirty (30) days written notice to the other party, either on a departmental basis or the entire local. (c) It is understood that no premium time will be paid as a result of a change from an eight (8) hour to a twelve (12) hour shift schedule, or conversely as a result of a change from a twelve (12) hour to an eight (8) hour shift schedule.

The Beneficiary or their assignees shall then communicate to the Assistance Company, directly or through his/her travel agency, the following documents: • statement of the airline company mentioning the cause of the delay, the number of the flight, initial scheduled arrival time and actual arrival time • copy of the travel ticket • copy of the boarding pass • notice of compensation granted by the concerned airline. • the original invoices of expenses incurred because of the delay. The Assistance Company reserves the right, if need be, to request additional documents to the Beneficiary.

  • Conditions of Use CLIENT acknowledges that its use of the Site is subject to and conditioned upon the following terms and agrees that TAILGATE GUYS may exercise any of the remedies set forth herein for CLIENTS failure to comply: a. CLIENT shall comply with all rules and regulations established by TAILGATE GUYS, Auburn University, and any other applicable authority, including but not limited to parking regulations in effect on campus. A copy of current rules and regulations is attached hereto as Exhibit A, which shall be subject to adjustment at any time by TAILGATE GUYS, Auburn University or other applicable authorities. b. CLIENT shall be permitted to access the Site at the respective times set forth in the rules or otherwise determined by TAILGATE GUYS and Auburn University. c. CLIENT acknowledges all risks related to its attendance and use of the Site, including risk of damage to or loss of property or risk of serious personal injury or death, and accepts sole responsibility for such risks. CLIENT shall secure all personal property in and around the Site and shall take all precautions necessary to prevent theft or destruction thereof. CLIENT expressly acknowledges and agrees that TAILGATE GUYS shall not be responsible for any personal property of or injury to CLIENT at any time. TAILGATE GUYS will not remove or hold for safe-keeping any personal items left on the Site after event closing and same will be subject to removal by Auburn University facilities. CLIENT may be subject to costs and fees associated with such removal. d. Eligibility for any TAILGATE GUYS drop off service is determined by Tailgate Guys in its sole discretion and is based on University restrictions, staffing availability and other factors. If CLIENT is eligible to participate in any TAILGATE GUYS drop off service, the CLIENT is responsible for properly packaging all items that will be transported and otherwise agrees to comply with procedures established by TAILGATE GUYS for this “drop off service,” including but not limited to any limitations with regard to the amount and size of items to be transported. TAILGATE GUYS will not be responsible for any damaged or broken items during unloading or loading and transportation to or from the Site. e. CLIENT shall respect the interests of other fans and clients of TAILGATE GUYS and shall not engage in or permit disorderly or offensive conduct in or around the Site. CLIENT further agrees not to exceed the maximum number of guests allowed within the as set forth in the Exhibit A. Should CLIENT violate these provisions, TAILGATE GUYS management will give CLIENT a verbal warning. If CLIENT fails to promptly come into compliance, TAILGATE GUYS may immediately revoke CLIENT’s rights to the Site and in its sole and absolute discretion terminate this Agreement. Upon such revocation or termination, all amounts paid to TAILGATE GUYS with be forfeited by CLIENT and retained by TAILGATE GUYS. f. CLIENT shall not move, alter, or disrupt operation of any media equipment provided by TAILGATE GUYS. In the event of inclement weather, TAILGATE GUYS reserves the exclusive right to cover and protect all equipment associated with the Media Package with such materials and coverings as it deems appropriate, which may include gator covers or hard cases for TV’s, plastic bags for receivers and generators or the like (collectively, the "Protective Equipment"). CLIENT shall not remove any Protective Equipment or items contained inside Protective Equipment, and expressly acknowledges and agrees that only TAILGATE GUYS staff shall have authority to do so. CLIENT acknowledges and agrees that its right to use the media equipment may be suspended, without refund, at TAILGATE GUYS option, for violation of these provisions, and CLIENT further assumes all responsibility for any damages to media equipment resulting from violation of these provisions and shall reimburse TAILGATE GUYS for the cost to repair or replace damaged equipment. g. CLIENT shall keep the Site in a neat and orderly manner at all times and may incur fees set forth on Exhibit A, attached hereto and made a part hereof. h. CLIENT acknowledges and agrees that the signage identifying each Site is uniform and provided by TAILGATE GUYS, who reserves the right to omit any vulgar, offensive or discriminatory content requested by CLIENT, in the sole and absolute discretion of TAILGATE GUYS. i. TAILGATE GUYS reserves the right to immediately terminate CLIENT’s use of the Site for violation of the conditions of use. In addition, CLIENT shall be responsible for payment of all damages incurred by TAILGATE GUYS as a result of CLIENT’s failure to comply with the foregoing conditions of use or as a result of damages by CLIENT of any equipment of TAILGATE GUYS. To insure compliance and payment of damages or fines, CLIENT agrees to keep a credit card on file with TAILGATE GUYS, and hereby authorizes TAILGATE to charge said credit card amounts owing as a result of its breach; provided that TAILGATE GUYS delivers to CLIENT an itemization of said charges and receipt for payment thereof.

  • Conditions of Eft Services (a.) Ownership of Card(s). Any Card we supply to you is our property and must be returned to us, or to any person whom we authorize to act as our agent, or to any person who is authorized to honor the Card, immediately according to instructions. The Card may be reclaimed at any time at our sole discretion without demand or notice. You cannot transfer your Card to another person.
