Copies of Evaluation Clause Samples
The "Copies of Evaluation" clause establishes the requirements and limitations regarding the distribution or reproduction of evaluation materials provided under an agreement. Typically, this clause specifies how many copies of the evaluation materials a recipient may make, under what circumstances, and for what purposes—such as internal review or testing. By clearly defining these parameters, the clause helps prevent unauthorized duplication or dissemination, thereby protecting the intellectual property and confidential information of the disclosing party.
Copies of Evaluation. Any employee shall be given a copy of any observation or evaluation report prepared by the evaluator at least one (1) day before any conference to discuss it. No such report shall be submitted to the central office, placed in the employee's file or otherwise acted upon without the knowledge of the employee. The employee shall sign and return his/her completed evaluation. A signature shall not imply agreement with the contents of the evaluation.
Copies of Evaluation. A teacher shall be given a copy of any class visit or evaluation report prepared by that teacher's evaluator at least one (1) day before any conference to discuss it. No such report shall be submitted to the central office, placed in the teacher's file or otherwise acted upon without prior conference with the teacher. No teacher shall be required to sign a blank or incomplete evaluation form.
Copies of Evaluation. Support staff shall be given a copy of any evaluation report prepared by the evaluator at least one day before any conference to discuss it. No such report shall be submitted to the central office, placed in their file or otherwise acted upon without affording the staff member an opportunity to conference with the evaluator as set forth below. The staff member shall sign the evaluation when completed, it being expressly understood that said signature in no way indicates agreement with the contents of the report. The staff member shall have 5 work days after the conference to submit a written response to the evaluation report, and the response shall be attached to the file copy of the report.

An employee shall be given a copy of any evaluation report prepared by this evaluators within ten (10) days and a conference, which follows within fifteen (15) days of the observation/evaluation. If an employee or the Administration, having received a copy of an evaluation report, wishes one or two (2) days' delay before conferring on the subject matter of the report, such limited delay shall be a matter of right. No such report shall be submitted to the Central Office, placed in the employee's file, or otherwise acted upon without prior conference with the employee. No employee shall be required to sign a blank or incomplete evaluation form. In the event that an employee refuses to accept an evaluation report and refuses to sign an acknowledgment of receipt of same, the Administration shall forthwith certify the offer or deliverance of the evaluation report and file certification with the report to the employee's file and forward to the Association a copy of the certification only.

No such observation report shall be submitted to the central office or placed in the employee’s file without the employee having the opportunity to discuss it within a reasonable period of time

(1) work day prior to the evaluation conference. Such report shall not be submitted to the central office or placed in the employee's file without a prior conference. Such a conference shall occur during regular work hours as scheduled by the evaluator. At the conclusion of the conference the employee shall confirm that he/she participated in the evaluation by signing the evaluation report. Such signature does not affirm that all parts of the report are agreeable to the employee. Should an employee refuse to sign such report, the report shall be filed and the refusal shall be noted on the report. An employee shall not be required to sign a blank or incomplete evaluation report.
