DAYS AND HOURS OF WORK AND OVERTIME. Warehouse and Drivers and Branches and Retail Accountant and Advertising Co- ordinator and Computer Operator 20.01 Employees shall work and be guaranteed eight (8) hours each day, provided they commence work at the start of their shift, with a half (½) hour off for lunch. The normal work week shall be five (5) consecutive days, forty (40) hours per week, 00:01 a.m. Sunday through Saturday midnight, except that Okanagan Drivers may be scheduled on a Monday through Sunday shift. Part time employees may work any time to replace regularly scheduled employees who are absent for vacation, sick, A.T.O., or leave of absence, to meet overload requirements, and to supplement staff levels provided full-time employees have been scheduled to the maximum of the basic work week as outlined above. Part time employees hired after April 19, 2007 may be scheduled to work shifts that are less than eight (8) hours in duration. Full-time employees performing regularly scheduled shifts commencing on Saturday or Sunday will receive a premium of ten dollars ($10.00) per shift worked. Drivers on Okanagan runs are not eligible for the weekend premium. 20.02 Any hours worked in excess of eight (8) on a regular day, as defined in Section 20.01 above in any one (1) day, shall be at the rate of time and one-half (1 ½) for the first one (1) hour and double time thereafter. −21− 20.03 Employees shall work and be guaranteed seven and one-half (7 ½) hours each day, provided they commence work at the start of their shift, with a half (½) hour off for lunch. Any vacancy created as a result of a current full-time person who resigns, retires or is terminated must be filled by a full time employee provided that the Company had not previously advised the Union that it is considering a reduction of the position to part time. 20.04 Any hours worked in excess of seven and one-half (7 ½) on a regular day, as defined in Section 20.03 above, in any one (1) day, shall be at the rate of time and one-half (1 ½) for the first hour and double time (2X) thereafter. 20.05 All time worked on the sixth (6th) day shall be paid at the rate of time and one-half (1 ½) for the first two (2) hours and double time thereafter. All hours worked on the seventh (7th) day shall be paid at the rate of double time, with a minimum of four (4) hours guarantee. 20.06 The Driver on the Okanagan run shall work a period of twenty-four (24) hours over a forty-eight (48) hour period of any two (2) consecutive days, Sunday through Saturday at straight time rates of pay. Whenever there is an available trip to the Okanagan and a driver has had two (2) trips in that particular week that driver may take a third (3rd) trip provided that the available trip has first been offered to all other drivers in order of seniority and no other driver wishes to take the trip. The third (3rd) trip will be paid at the applicable rates plus any applicable premiums. 20.07 Any hours worked over the twenty-four (24) hours shall be paid at double time rate of pay. Overtime worked on his other two (2) work days shall be paid as set out in 20.02 above. 20.08 Upon representation of expense receipts, this driver shall be reimbursed. 20.09 Drivers who make deliveries to Vancouver Island shall continue to work the five (5) days as set out in 20.01 above for any one (1) day, and shall receive $8.00 lunch money and be given one-half (½) hour lunch time. Effective August 1st, 1995, the lunch money will be increased to $9.00. 20.10 Any employee called back to work in any emergency after his working day has been completed shall be paid a minimum of three (3) hours' pay at the rate of double time. 20.11 If an employee reports late for work, that employee will only be paid from the time he commences work and for the time actually worked. 20.12 All overtime shall be broken down into five (5) minute units, based on one-twelfth (1/12th) of the applicable hourly rate, times the appropriate overtime rate. 20.13 When employees are advised to report for work at a specified time on any day, they shall be paid for that day, even though there may be no work for them to do, provided they are ready for work, excepting as set out in Section 20.06 herein. 20.14 The Employer agrees that when it is necessary to work overtime in a department or work area, such overtime will be distributed to the employees of that department or work area. The person in charge of that department shall go to each employee in the department in order of seniority and request if they desire to work overtime. When overtime is available in the office, and the work to be done does not belong to any particular classification, that overtime must be distributed in order of overall office seniority. Some examples of this are: transferring files to boxes for storage, meat department receiving, month end work, stock taking work, and special projects, etc. Employees may for a legitimate reason refuse to work overtime, however if all employees so refuse, then the junior employees in the number required shall be obligated to work. 20.15 Non bargaining unit persons shall be allowed to take stock, provided that there is one (1) bargaining unit employee with each non-bargaining unit person who is tabulating figures of stock items. 20.16 The day shift for warehouse and drivers shall be eight (8) consecutive hours from 5:00 A. M. to 6:30 P.M. with a half (½) hour for lunch. Employees will be scheduled the same shift time for five consecutive days except that drivers recognize that some flexibility in the scheduling of shifts may be required to supply an acceptable level of service. The day shift for office personnel shall be seven and one-half (7 ½) consecutive hours between 7:00 A.M. and 5:00 P.M with a half (½) hour for lunch. Whenever two (2) or more employees are performing essentially the same job and an option to start at a different time than other employees on the shift is available, the option must be given to the senior employee. When two (2) or more floaters can perform the same positions they are scheduled to relieve, the senior floater will be given any scheduling option that might be available. 20.17 Any shift starting prior to the regular starting time for any Department as set out above or ending after the quitting time set out above, shall be a premium shift and any second or third shift shall be a premium shift and paid for as follows. 20.18 Employees shall work seven (7) hours and receive eight (8) hours' pay, with a lunch period of thirty (30) minutes without pay. July 31, 2000 shift length 8 hours. July 31, 2000 shift premium $3.00/hour. August 5, 2001 shift premium $2.00/hour. August 4, 2002 shift premium $1.00/hour. 20.19 Where there are only two (2) men on a second or third shift and one (1) has to leave due to injury or illness, the other may also leave for safety purposes and be entitled to his full eight (8) hours' pay for such shift, provided the Employer is notified and given the opportunity to replace staff. 20.20 The Employer shall give to each employee whose shift is to be changed a minimum of twenty-four (24) hours advance notice prior to such shift becoming applicable. 20.21 Where help is required for unloading at Cash & Carry or I.G.A. loads, such help will be provided at destination. 20.22 It is intended that every employee should have a minimum of eight (8) hours rest between the end of one (1) shift and the commencement of another. In the event that any employee is recalled to work before a period of eight (8) hours elapses, he shall be paid at overtime rates of double time for the entire shift that he is called in to work before he has received his full eight (8) hour break. No employee shall be permitted to resume work on his own accord until eight (8) full hours have elapsed. 20.23 Where shift work is in operation, it is agreed that all employees in such job classifications involved shall not be rotated or altered unless specifically requested by a particular employee that he be changed.

Employees on a Wednesday to Sunday schedule will receive a premium of $1.00 per hour for all hours worked during the week plus any other premiums to which they are entitled. For purposes of clarification, forty ASeasonal Employees@, as provided in Article 1(e), may be assigned work, during the seasonal period, on a Monday to Friday, Tuesday to Saturday or Wednesday to Sunday basis, the latter for merchandising work only. (40b) hours per week, 00:01 a.m. Sunday through Saturday midnight, except that Okanagan Drivers No more than five (5) current employees may be scheduled on a Monday through Wednesday to Sunday merchandising shift. Part time employees may work any time to replace regularly scheduled However, for those employees who are absent for vacationbegin employment after the date of ratification (June 5, sick, A.T.O., 2005) or leave of absence, to meet overload requirements, and to supplement staff levels provided full-time employees any existing employee that elects so may have been scheduled to the maximum of the basic their merchandising work week as outlined above. Part time employees hired after April 19, 2007 may be scheduled on a Wednesday to work shifts that are less than eight (8) hours in duration. Full-time employees performing regularly scheduled shifts commencing on Saturday or Sunday will receive a premium of ten dollars ($10.00) per shift worked. Drivers on Okanagan runs are not eligible for the weekend premiumbasis. 20.02 (c) Any hours worked in excess of eight (8) on a regular dayMonday to Friday, Tuesday to Saturday, and Wednesday to Sunday as defined in Section 20.01 above (a) above, in any one (1) day, day shall be at the rate of time and one-half (1 ½12) for the first one two (12) hour hours and double time thereafter. −21−, except as set out below. 20.03 Employees shall work and be guaranteed seven and one-half (7 ½d) The first four (4) hours each day, provided they commence work at the start of their shift, with a half (½) hour off for lunch. The normal work week shall be five (5) consecutive days, thirty-seven and one-half (37 ½) hours per week, Sunday through Saturday. Employees hired after April 19, 2007 may be scheduled to work shifts that are less than seven and one-half (7 12) hours or eight (8) hours as applicable. Any vacancy created as a result of a current full-time person who resigns, retires or is terminated must be filled by a full time employee provided that the Company had not previously advised the Union that it is considering a reduction of the position to part time. 20.04 Any hours worked in excess of seven and one-half (7 ½) on a regular day, as defined in Section 20.03 above, in any one (1) day, shall be at the rate of time and one-half (1 ½) for the first hour and double time (2X) thereafter. 20.05 All time worked on the sixth (6th) day day, Saturday, shall be paid at the rate of time and one-half (1 ½12) for the first two (2) hours and double time thereafter. All hours worked on the seventh (7th) day shall be paid at the rate of double time, with a minimum of four (4) hours guarantee. 20.06 The Driver , the subsequent hours paid at the rate of double time and all hours worked on the Okanagan run seventh (7th) day, Sunday, shall work a period of twenty-four (24) hours over a forty-eight (48) hour period of any two (2) consecutive days, Sunday through Saturday at straight time rates of pay. Whenever there is an available trip to the Okanagan and a driver has had two (2) trips in that particular week that driver may take a third (3rd) trip provided that the available trip has first been offered to all other drivers in order of seniority and no other driver wishes to take the trip. The third (3rd) trip will be paid at the applicable rates plus any applicable premiumsrate of double time with a minimum of four (4) hours guarantee. In the case of Tuesday to Saturday work week, Sunday and Monday will replace Saturday and Sunday. In the case of Wednesday to Sunday, Monday and Tuesday will replace Saturday and Sunday. 20.07 Any hours worked over the twenty-four (24e) hours shall be paid at double time rate of pay. Overtime worked on his other two (2) work days shall be paid as set out in 20.02 above. 20.08 Upon representation of expense receipts, this driver shall be reimbursed. 20.09 Drivers who make deliveries to Vancouver Island shall continue to work the five (5) days as set out in 20.01 above for any one (1) day, and shall receive $8.00 lunch money and be given one-half (½) hour lunch time. Effective August 1st, 1995, the lunch money will be increased to $9.00. 20.10 Any employee called back in to work in any emergency after his regular working day has been completed and he has gone home shall be paid a minimum of three (3) hours' hours pay at the rate of double time. 20.11 (f) If an employee reports late for workwork or leaves before his shift is completed, that employee will only be paid from the time he commences commenced work and for the time actually workedworked but persistent tardiness will subject him to dismissal. 20.12 (g) All overtime shall be broken down into five (5) minute units, based on one-twelfth (1/12th) of the applicable hourly rate, times the appropriate overtime rate. 20.13 (h) When employees are advised to report for work at a specified time on any day, they shall be paid for that day, day even though there may be no work for them to do, provided they are ready for work, excepting as set out in Section 20.06 Sections (a) and (d) herein. In the Sales Department if off-day overtime is required, the opportunity for such overtime will be awarded on a seniority basis provided that the employee is qualified to perform such duties. 20.14 (i) The Employer agrees that when if it is becomes necessary to work overtime in a department or work area"off-day" overtime, the opportunity for such overtime will be distributed to the employees given on a seniority basis, by department, by location (Richmond/Mayfair), except as detailed in Letter of that department or work area. The person in charge of that department shall go to each employee in the department in order of seniority and request if they desire to work overtime. When overtime is available in the office, and the work to be done does not belong to any particular classification, that overtime must be distributed in order of overall office seniority. Some examples of this are: transferring files to boxes for storage, meat department receiving, month end work, stock taking work, and special projects, etc. Employees may for a legitimate reason refuse to work overtime, however if all employees so refuse, then the junior employees in the number required shall be obligated to workUnderstanding #1. 20.15 Non bargaining unit persons (j) No person other than an employee who is covered by the Certificate of Bargaining Authority and this Agreement, who is a member of the Union, shall be allowed to take stockinventory, provided that there is one (1) bargaining unit employee with each non-bargaining unit person who is tabulating figures of stock itemsbook in loads, reconcile loads, or add recap sheets, the foregoing does not prohibit management from verifying or adjusting the work done. 20.16 The day (k) In order that an accurate record of hours worked are kept, the Employer shall provide an electronic time keeping system which the employee shall be required to activate at the beginning and end of his shift as well as when the employee leaves and returns to the building during his shift. Where an employee requests such form the Company, he shall be supplied with a record of his overtime hours worked. In order to minimize payroll errors, the Company agrees to update time records on a daily basis, except in cases of emergency where supervisors are not available to complete them. Except that employees will not be paid for warehouse and drivers time prior to or after completion of their normal shift except when overtime is authorized. (l) If an afternoon shift is employed, the hours of work shall be eight (8) consecutive hours from 5:00 A. M. to 6:30 P.M. per shift with a half designated thirty (½30) hour for lunchminute lunch period on Employer time. Employees A sixty-five cent (654) premium will be scheduled paid for each hour paid for on the same second shift. (m) If a graveyard shift time for five consecutive days except that drivers recognize that some flexibility in is employed, the scheduling hours of shifts may be required to supply an acceptable level of service. The day shift for office personnel work shall be seven and one-half eight (7 ½) consecutive 8) hours between 7:00 A.M. and 5:00 P.M per shift with a half designated thirty (½30) minute lunch period on Employer time. A seventy-five cent (754) premium will be paid for each hour paid for lunch. Whenever two (2) or more employees are performing essentially the same job and an option to start at a different time than other employees on the shift is available, the option must be given to the senior employeethird shift. When two (2) or more floaters can perform the same positions they are scheduled to relieve, the senior floater will be given any scheduling option that might be available. 20.17 Any shift starting which commences from 6:00 a.m. but not later than 9:00 a.m. shall be considered a day shift. A shift commencing after 9:00 a.m. and prior to the regular starting time for any Department 5:30 p.m. shall be considered an afternoon shift. Any shift commencing after 5:30 p.m., and prior to 6:00 a.m. shall be considered a third or graveyard shift. In Sales Departments with fixed shifts, shifts as set out above or ending after the quitting time set out provided above, shall be selected on a premium seniority basis by employees. Any shift and any second or third shift differentials shall be included in overtime calculations. Where a premium shift and paid for as followsmay contain multiple start times, such times will be assigned by the Company on a non-discriminatory basis. 20.18 Employees shall work seven (7n) hours and receive eight (8) hours' pay, with a lunch period of thirty (30) minutes without pay. July 31, 2000 shift length 8 hours. July 31, 2000 shift premium $3.00/hour. August 5, 2001 shift premium $2.00/hour. August 4, 2002 shift premium $1.00/hour. 20.19 Where there are only two (2) men on a second or third shift and one (1) has to leave due to injury or illness, the other may also leave for safety purposes and be entitled to his full eight (8) hours' pay for such shift, provided the Employer is notified and given the opportunity to replace staff. 20.20 The Employer shall give to each employee whose shift is to be changed a minimum of twenty-four (24) hours advance notice prior to such shift becoming applicable. 20.21 Where help is required for unloading at Cash & Carry or I.G.A. loads, such help will be provided at destination. 20.22 It is intended that every employee should shall have a minimum of eight ten (8) 10) hours rest between the end of one (1) shift and the commencement of another. In the event that any employee is recalled to work before a period of eight ten (8) 10) hours elapses, he shall be paid at overtime rates of double time for the entire shift that he is called in to work before he has received his full eight ten (8) 10) hour break. No employee shall be permitted to resume work on his own accord until ten (10) full hours have elapsed, except employees who have worked overtime may resume work after eight (8) full hours have elapsedlapsed. 20.23 (o) The Employer shall give to each employee whose shift is to be changed a minimum of forty-eight (48) hours advance notice prior to such shift change becoming applicable. Such shift changes shall be limited to one (1) per week for regular full-time employees. Should additional shift changes be required, these shall be worked on a voluntary basis. (p) Where shift work is in operation, it is agreed that all employees in such job classifications, within each department involved shall be rotated on each of the shifts every two (2) week period, providing that they do not volunteer to remain on the graveyard or afternoon shift. The foregoing shall not apply in instances of an employee who has bumped a junior employee to avoid being laid off. (See Letter of Understanding #1 - Item 6 attached). (q) Employees may, for what they consider to be a legitimate reason, refuse to work overtime, however, if insufficient volunteers are available, the junior employees in those classifications involved which are required for work, must work such overtime, but will not be required to work more than eight (8) hours overtime during the normal work week (excluding Saturdays). Once an employee has worked at least eight (8) hours of overtime work during the normal work week, any overtime work required on an employee's off day will be voluntary and at that employee's option. Where an employee has not worked all of the eight hours of overtime work in his regular work week, he may be scheduled for an additional shift or overtime work on his off day. In the event overtime is scheduled after the last break in a shift, the employees working the overtime shall have an opportunity to make a phone call to rearrange their personal schedule if requested. There shall be twenty-four (24) hours advance notice for Saturday work. (r) An employee who is required to be on call shall receive fifty dollars ($50.00) per seven (7) day week and sixty-five dollars ($65.00) for a week including a Holiday weekend in addition to his regular rate which shall not be rotated or altered unless specifically requested used in overtime calculations. (s) Shift schedules for the following week will be posted on Thursday by a particular employee that he be changed.twelve

(h) All employees engaged in sulph hydrate and other dirty work where he would require a longer wash-up period to get clean, such employees shall receive a paid wash-up period commensurate with the type of work involved. (i) Employees may for what they consider to be a legitimate reason reason, refuse to work overtime. (j) An employee may elect to have any overtime, however if all employees so refuseup to a maximum of forty (40) hours at any given time banked to his credit. The employee will have the option at the time the overtime is worked to bank it or be paid for it with the next pay. Banked overtime will be accrued January 1st to June 30th and July 1st to December 31st each year. Overtime, then the junior employees in the number required once banked shall be obligated to workutilized as follows: (i) it shall be taken as time off during the period in which it was banked. 20.15 Non bargaining unit persons (ii) if not taken as time off it shall be allowed paid out on the first pay following the end of the period in which it was banked. The pay-out of all, or part, of banked overtime hours prior to take stockthe end of a period will not be permitted. Application for time off will be in accordance with the following: (i) Application for time off will normally be received two (2) weeks in advance of the date of absence and will be subject to the approval of the Warehouse Manager. (ii) In the case of an emergency, an employee may be permitted to use banked overtime without having given the required two (2) week notice, provided that there is the Warehouse Manager agrees. (iii) Banked overtime can be taken during peak vacation periods (i.e. summer, Christmas, Easter only after all other employees have had an opportunity to schedule their vacation time. (iv) Banked overtime leave will not be approved where additional costs will result for the Company or Company service will suffer. (v) Banked overtime must be taken in periods not less than one (1) bargaining unit employee with each non-bargaining unit person who is tabulating figures of stock items. 20.16 The working day shift for warehouse and drivers shall be eight (8) consecutive hours from 5:00 A.
