The Emergent Situations clause defines how parties should respond to unexpected or urgent events that may impact the performance of their contractual obligations. Emergent Situations. An employee has the right to refuse overtime except in emergencies as determined by the Board, and the Board agrees that there shall be no intimidation or discrimination against any employee by reason of their refusal to work overtime.
Emergent Situations. In the event operations cannot commence or continue as normal when so directed by civil authorities; or because of other government regulations; or the interruption of work is caused by an Act of God, civil disruption, acts of terrorism or other such uncontrollable, emergent events, the Authority and the Union will meet to discuss the impacts of the emergency on daily operations. The CEO or designee shall have the ability to temporarily modify work assignment provisions of the Agreement that reasonably relate to the Authority’s response to the emergency situation. All provisions of the Agreement shall be followed once the emergency situation is determined to be ended. The CEO or designee shall ensure there is no loss of employment for employees, or any loss of pay or benefits because of the work assignment changes. All work assignment changes will be discussed with the Union before being implemented. Should a disagreement arise as to the reasonableness of any work assignment change, such challenge may be submitted by the Union to arbitration.
Emergent Situations. In emergent situations the Employer shall have the right to fill a shift as deemed necessary. In an urgent situation in which time is of the essence, seniority may be overlooked.
Emergent Situations. 15.1.1. It is understood that situations may arise during the course of a Job Action that may call for immediate action because otherwise it may endanger the life, personal safety or health of the University community or public on an emergent basis. These situations are inherently unplanned and unscheduled and it would be impossible to foresee every situation that may give rise to such an emergency. It is recognized, however, that the Board and ULFA have a responsibility to ensure emergencies are dealt with in an expeditious manner under the provisions of this Essential Services Agreement. 15.1.2.   • Emergency Situations If the condition is an emergency, this will be communicated to the Contractor with the request that corrections are to be accomplished immediately. The Contractor shall respond to the notice in emergency situations within twenty-four hours. If the Contractor fails to respond within this time limit, the Owner may correct the defect and charge the Contractor for the Work. If it is determined the complaint is not the responsibility of the Contractor, the Contractor shall be promptly paid for the cost of the corrective work. The Contractor shall give notice in writing to the Owner when corrections have been completed.

  • Special Situations ▇▇▇▇▇▇▇ BENEFICIARY agrees to inform AGENCY within one (1) business day of any circumstances or events which may reasonably be considered to jeopardize its capability to continue to meet its obligations under the terms of this Agreement. Incidents may include, but are not limited to, those resulting in injury, media coverage or public reaction that may have an impact on the AGENCY’S or GRANTEE BENEFICIARY’S ability to protect and serve its participants, or other significant effect on the AGENCY or GRANTEE BENEFICIARY. Incidents shall be reported to the designated AGENCY contact below by phone or email only. Incident report information shall not include any identifying information of the participant.

  • Emergency Situation In the event of an emergency situation beyond our reasonable control, such as an "act of God," war, fire, or natural disaster, services involving your account could be available only in a modified or reduced form or could be entirely unavailable. Unless expressly prohibited by applicable law, you agree that we will have no liability to you for such modification, reduction, or unavailability of services caused by an emergency situation.

  • Business Partners Red Hat has entered into agreements with other organizations (“Business Partners”) to promote, market and support certain Software and Services. When Client purchases Software and Services through a Business Partner, Red Hat confirms that it is responsible for providing the Software and Services to Client under the terms of this Agreement. Red Hat is not responsible for (a) the actions of Business Partners, (b) any additional obligations Business Partners have to Client, or (c) any products or services that Business Partners supply to Client under any separate agreements between a Business Partner and Client.

  • Infrastructure Vulnerability Scanning Supplier will scan its internal environments (e.g., servers, network devices, etc.) related to Deliverables monthly and external environments related to Deliverables weekly. Supplier will have a defined process to address any findings but will ensure that any high-risk vulnerabilities are addressed within 30 days.
