Subject to the provisions of the overtime section, voluntary overtime shall be distributed equally among qualified volunteers with similar skills and duties. Three “no-contacts” will be considered to be a refusal of eight (8) hours of overtime for equalization purposes. Only one “no-contact” may be charged for hours worked.
(d) Employees who to an employee in a day. Such records shall also be available for inspection by the Union. If an agency chooses not to post overtime and records, the employees shall not be charged overtime hours. Employees transferring to a different division shall receive for purposes have the absolute right of overtime equalization the average amount of overtime worked that the existing personnel within the division and classification possess at the time of transfer in order to equalize overtime under Article 11. Equalization of Overtime. 1. Overtime work shall be equalized on a voluntary basis (except as much provided for in Section 1(i)), and shall be distributed as equally as possible to qualified employees working within each divisionthe same department.
2. 3. Division Overtime lists will be broken down into the employee’s overtime hours in his/her regular division for the purpose of equalizing the overtime within the division.following categories:

d. Non-Departmental Employees shall These categories will be required to provide one (1) telephone number in order to be contacted utilized for call-out assignments. C. The Director of Buildings and Grounds will maintain a list of all overtime assigned and called and/or refused by each Employee in the Maintenance Department. Each Building Engineer will maintain in their building the same type of list. Questions regarding distribution of overtime will be discussed by the supervisor and the ▇▇▇▇▇▇▇ involved as they arise, and the remedy shall be limited to balancing of the overtime hours. A maintenance department overtime log, based on overtime hours paid, will be updated each pay period and it will be a continuous log.
D. In the event an Employee has been assigned to work regularly on an overtime basis, he/she will be charged the overtime worked. Alsomay request, an employee who is off due to military service is considered not available for overtime and shall not be charged overtime hours. Employees transferring to a different division shall receive for purposes of overtime equalization the average amount of overtime worked that the existing personnel within the division and classification possess at the time of transfer in order to equalize overtime under Article 11. For the purposes of this Agreement, any refusal of overtime in other divisions will be charged least two (2) weeks prior to the employee in day to be off, the Director of Maintenance exchange his/her regular division as if he/she had actually worked those hours, in accordance work assignment with Article 12(E) (Temporary Reassignments)another bargaining unit Employee. The parties recognize that there may be the need to schedule weekend overtime due to breakdowns or to meet customer requirements.
B. For the purpose of meeting customer requirements, forge shop employees may be required to work up to two hours past their regular quitting time. The ▇▇▇▇▇▇▇ will be required to give at least a one hour notice prior to the end of the shift. This provision cannot be applied to any employee more than twice a week.
C. All the overtime within a department shall be distributed among the employees as evenly as possible within a department, within a shift on a group basis, as set forth in Appendix A, as provided in the equalization program below:
1. Extra work in periods of part time operation and overtime shall be equalized among the employees in the group or department who are engaged in similar work. Overtime hours will be maintained within a 50 hour spread within an equalization classification, by shift. It will be the ▇▇▇▇▇▇▇'▇ responsibility to ask the employees to work overtime in proper order of their overtime hour accumulation and to post on the board those employees scheduled to work. It will be the employee's responsibility to look at the posting and speak out if there is an error.
2. When there are employees outside the 50 hour spread in a classification by shift, such employees will be offered overtime in sequence beginning with the employee who has the least hours.
3. Notwithstanding the foregoing, daily overtime in any department shall be performed by the employee performing the work during regular hours.
4. Employees will not change shifts to equalize overtime. At the beginning of each calendar year the low overtime employee in the department by shift by classification will be returned to zero. All other employees will subtract this amount from their total overtime hours.
5. An employee who is working overtime such as a crane operator or truck driver, shall be used if the actual work of driving or operating crane is of short duration, the driver or crane operator will help the other workers involved in the overtime work.
6. Committeemen will be carried on the equalization chart the same as other employees, except when they are in for representation purposes they will not be credited with hours worked. At the conclusion of their term of office, the committeeman will be credited with the average hours of the group to which he or she is assigned.
(d) Employees who are off work due 7. Hours credited shall be credited as straight time hours, i.e. 3 hours of overtime equal 4 and ½ hours regular time on the chart.
8. Monday through Friday in the Forge Department, overtime before or after the regular shift will first be offered to vacation, compensatory time, sick leave for someone other than themselves the person or light duty (providing crew normally performing the call-out assignment is consistent with the applicable light duty restrictions), shall at their choice be available for call-out situationswork. If the employee chooses person or crew is unable to work the call-outovertime, he/she the offer will then be charged made to those qualified and in keeping with the overtime worked. D. No employee will be charged scheduled to work in another classification or department on an overtime basis unless all employees in the classification or department on that shift have been given the opportunity to work the available overtime or a scheduled employee fails to report off in his/her regular division as if he/she had actually worked those hours, in accordance with Article 12(E) (Temporary Reassignments)a manner timely enough to schedule a replacement from that classification or department.

4. Employees, shall at the beginning of the school year, will indicate their choice be available for call-out situations. If the employee chooses desire to work overtime outside of their regularly assigned building. Any employee refusing to work when called on two consecutive times, will be removed from the call-outovertime list for the year. Exceptions may be made in proper cases.
5. The Board agrees that the President of the local Association may examine the records on overtime outside of the buildings upon reasonable notice.
6. When a new employee is assigned to a building, he/she he will be charged the overtime worked. Also, an employee who is off due to military service is considered not available for overtime and shall not be charged overtime hours. Employees transferring to a different division shall receive for purposes of overtime equalization with the average amount of overtime worked hours that the existing personnel within other employees assigned to the division and classification possess building have at that time.
7. Custodial substitutes will only be used to fill in for absenteeism.
8. Probationary employees shall not be used for overtime unless seniority employees in the building or trade are not available. After probationary employees have been asked, then the Board shall follow other provisions of this Section.
9. The equalization of overtime shall be carried over from year to year. On July 1 of each year, the Board will subtract the overtime hours of the lowest man on the list from the overtime of the other employees.
A. An additional eighty cents (80 cents) per hour shall be paid for runs which take place on a Saturday. If, however, such Saturday work exceeds forty (40) hours worked for such week, then all hours in excess of forty (40) shall be paid at the overtime rate.
B. Whenever an individual school closes for an in-service education day for teachers and this results in a loss of a driver's normal working hours, such hours shall be paid for that day.
C. Drivers shall be paid for layover time in regular runs or early dismissal when the time is not over one hour.
D. Seniority employees in the Transportation department shall be provided with a work year consisting of transfer 190 days. This provision, however, is not to be construed as a guarantee of 190 days' pay. It is merely to set forth the scheduled work year and employees shall be required to work in order to equalize overtime under Article 11. For the purposes of this Agreement, any refusal of overtime in other divisions will be charged to the employee in his/her regular division hours as if he/she he had actually worked those the overtime hours not to exceed twelve (12) hours. An employee who does not report to work because he has taken a personal day, compensation day, or a vacation day, shall become eligible for offered overtime by notifying the Service Department Administrator in writing that he is available for overtime during the period of his absence. Employees who do not notify the Employer shall not be called. An employee taking a personal day, compensatory day, or vacation day will be credited with the offered overtime hours as if he actually had worked the overtime. The City may call in or hold over employees assigned to the second or third shift within four (4) hours of said shift (abutting) without having to resort to the overtime equalization list. The equalization record of overtime hours will be “zeroed-out” on December 1st of each year. The order of the emergency and casual lists will remain in the order as they appeared on November 30th.
23.04 Any employee who works at least six (6) consecutive hours of overtime immediately before the start of his day shift and who works at least four (4) hours of his work day, may take the remaining four (4) hours, in accordance with Article 12(Eor less, off without pay and still be paid the overtime rate for the six (6) (Temporary Reassignments)hours of overtime work providing there is no operational emergency requiring the employee’s presence. If the employee has accumulated compensatory time or unused vacation, he may use such paid time instead of taking the time off without pay.
23.05 All Bargaining Unit employees shall work under the equalization of overtime provision herein contained.
23.06 The regular overtime list shall be utilized for emergency snow and ice control call outs on holidays.

Equalization of Overtime. Overtime a. All overtime hours shall be equalized as much evenly as possible within each divisionand distributed among employees of the Department. To effectuate this policy, an overtime list will be maintained at the Command Desk. All refusal of overtime will be noted. No officer will refuse overtime when ordered to work.
b. Overtime for legal proceedings and late calls are not to be included.
1. A master overtime list shall be kept at the Uniform Command Desk to be used by all uniformed supervisors. The parties agree C.LD. will maintain their own overtime list. A copy of the overtime lists will be available, posted, and maintained on a daily basis.
2. When additional officers are needed on a particular shift as determined by the Chief of Police, his designee and/or Station Commander, officers from that when bargaining unit employees work overtime in divisions shift shall be given preference. (An exception would be the second day off). All other than his/her regular divisionover- time, then those hours for example, special events, parades, park detail, shall be offered first to the employee credited with the lowest number of overtime worked are to hours. If the low overtime employee cannot be figured into reached by telephone or otherwise refuses, he shall be passed over and the employee’s next lowest employee in overtime hours in his/her regular division for the purpose of equalizing the overtime within the division.
(a) Employees shall be required to provide one (1) telephone number in order to be contacted for call-out assignments. Employees at their option may provide a second telephone number at which to be contacted. HoweverThis procedure shall be followed until overtime assignments have been made. In the event two or more employ- ees have the same number of overtime hours, failure the senior em- ployee will be called first.
3. The supervisor may hold over the low overtime employees without calling members of the affected platoon when there is less than two hours' notice.
4. An employee may file a written request with his command officer that he be eliminated from the overtime list and not considered for overtime. The employee may, at any subsequent time, but in no event more than once in any twelve-month period, withdraw this request, in writing, at which time he will be placed on the overtime list at the highest number of hours within his platoon.
5. An employee who refuses overtime when contacted, shall be credited with the number of hours worked on that occasion for purposes of equalization.
6. A new list will be implemented with each new contract.
7. The supervisor requesting an employee to provide a second number work overtime will be responsible for recording the entries on the overtime list. Entries to be recorded are: date, hours worked or refused, and attempts to notify. Attempts to notify are not to be used as refusals, but to show that he or they did attempt to notify the low overtime employee first.
8. In no event will double time be paid for shortages without the approval of the Chief of Police or his designee.
9. If an employee is transferred or hired during the term of this contract, he will be charged with the maximum of overtime hours from date of hire or transfer following his probationary period.
10. The above procedures do not apply in cases of major civil disorders, natural disasters, or in emergencies as declared by local governmental authorities.
11. Officers called upon to work for one and one-half hours or less shall not be considered have this overtime charged to the overtime list. In addition, those officers who refuse overtime due to not having at least eight hours off prior to reporting for their regular shift shall not have this overtime marked as a loss and/or denial of an overtime opportunityrefusal.
(b) Failure to respond and 12. In the event a refusal to any call-out/member is off sick, injured, or on leave of absence, with or without pay for a period of five consecutive work days, overtime opportunity hours starting on the sixth day of absence shall be charged against to his name on the employee overtime list, as if worked.

Equalization of Overtime. Overtime shall be equalized as much as possible within each division. The parties agree that when bargaining unit employees work overtime in divisions other than his/her regular division, then those hours of overtime worked are to be figured into the employee’s overtime hours in his/her regular division for the purpose of equalizing the overtime within the division.
(a) Employees Overtime work shall be required on a voluntary basis (except as provided for in Section 1(i)), and shall be distributed as equally as possible to provide one (1) telephone number in order to be contacted for call-out assignments. Employees at their option may provide a second telephone number at which to be contacted. However, failure to provide a second number shall not be considered a loss and/or denial of an overtime opportunityqualified employees working within the same department.
(b) Failure to respond Overtime lists for the Department of Public Works and a refusal to any the Department of Technical and Planning Services shall be maintained, showing the number of overtime hours each employee has worked or been charged with, and will be posted at the end of each pay period by the City on Union bulletin boards, unless mutually agreed otherwise.
(1) Division Overtime lists will be broken down into the following categories:
a) Division Employees
b) Non-Division Departmental Employees
c) Departmental Probationary New Hires
d) Non-Departmental Employees These categories will be utilized for call-out/in purposes when overtime exists, resulting in a fair and equitable distribution of overtime for both Departmental and Non Departmental employees.
(2) The qualified employee with the least amount of overtime on each Division list will be given the first opportunity to the available overtime and so on up the list in an attempt to equalize the overtime hours. Those jobs, by their nature, requiring a continuity of personnel, or an uninterrupted flow of work from straight time to overtime shall be exempt from this provision.
(3) Any employee refusing to work overtime will be charged against with such refused overtime hours on the employee as if workedappropriate Division overtime list, regardless of the cause of refusal.
(4) If the number of employees needed for overtime cannot be filled from the fully qualified and trained personnel within the specific Division, the City may offer overtime to other employees.
(c) Employees who respond All overtime hours will be recorded on a continuing basis by each Department and will be reverted to zero (0) at the call/out overtime beginning of each fiscal year. Probationary new hires, employees transferring into a Division or Department, and actually work shall be charged for hours worked.
(d) Employees who are off work due to vacationNon Departmental Employees, compensatory time, sick leave for someone other than themselves or light duty (providing the call-out assignment is consistent with the applicable light duty restrictions), shall at their choice be available for call-out situations. If the employee chooses to work the call-out, he/she will be charged with the highest number of overtime workedhours accrued by employees in the same Division or Department.
Section 3 The City acknowledges and agrees that it is bound to follow all applicable provisions of both State and Federal Wage and Hour laws. Also, an No employee who is off due will be required to military service is considered not available for overtime and shall not be charged overtime work more than sixteen (16) consecutive hours. Employees transferring to a different division shall receive for purposes After any such period of overtime equalization the average amount of overtime worked that the existing personnel within the division and classification possess at the time of transfer in order to equalize overtime under Article 11. For the purposes of this Agreementwork, any refusal employees requesting fatigue time shall be released from work and not required to return to work for at least eight (8) hours or the beginning of overtime in other divisions will the next scheduled work shift, whichever is later. Employees shall be charged to the employee in his/her regular division as if he/she had actually paid for actual time worked those hours, in accordance with Article 12(E) (Temporary Reassignments)only.

Equalization of Overtime. Overtime 20.01 The Employer shall be equalized as much as possible within each divisionthe sole judge of the necessity for overtime. The parties agree that when bargaining unit employees work overtime in divisions other than his/her regular divisionEmployer shall endeavor, then those hours insofar as it may be reasonably practicable, to make an equitable distribution of overtime among qualified employees within a departmental classification by plant from a rotating seniority list. Employees who are offered overtime and for any reasons refuse or fail to work the overtime shall be credited as if they had worked are to be figured into the employee’s overtime hours in his/her regular division for the purpose of equalizing overtime distribution.
20.02 The following rules shall apply to overtime opportunity equalization:
A. Overtime lists shall be developed and posted at the beginning of each quarter, e.g., January 1, May 1, September 1, each calendar year. The posting each quarter shall be for fifteen (15) days. The overtime list shall be by job classification by plant, Liverpool, ▇▇▇▇▇▇▇▇, and Chippewa. Employees who sign up on the overtime within list shall be ranked in accordance with seniority. After the division15th day of the posting, if an employee requests to be added to the overtime list, he/she shall be added at the bottom of the list. An employee can go off the overtime list only once each quarter. If an employee comes back on the overtime list during a quarter, he/she shall be added to the bottom of the list for that quarter.
B. The supervisor in charge of the shift shall call employees on the overtime list in rotating order. An employee who does not answer the call or respond within ten (a10) Employees minutes, or who is offered but refuses overtime, shall be required dropped to provide one (1) telephone number in order the bottom of the list. If all employees on the list are called and none agree to work the overtime, it will be contacted for call-out assignmentsoffered to those currently on duty. Employees at their option may provide a second telephone number at which If none of those currently working agree to work the overtime, the least senior qualified employee will be contactedordered to stay until relief is found. However, failure to provide a second number shall not be considered a loss and/or denial of When an employee's name comes up on the overtime opportunity.

Equalization of Overtime. A. The equalization of overtime for shift shortage, special events, and other overtime is an ongoing and continuous obligation. The Patrol Operations Division shift shortages and a separate Special Events/Other Overtime list shall be equalized as much as possible within each divisionmaintained and available for review by officers. The parties agree that All refusals of overtime shall be recorded. No employee shall refuse overtime when bargaining unit employees work overtime in divisions ordered to work.
B. A special event is any event other than his/her regular divisiona shift shortage.
C. Overtime for legal proceedings and late calls are not to be included in the equalization of overtime.
D. An employee may be asked, then those hours or allowed to work but shall not be charged a refusal of overtime worked or ordered for shift shortages or special events when:
1. An employee takes that day off as a vacation day.
2. An employee takes that day off as a personal day.
3. An employee takes that day off in compensatory time.
4. An employee takes that day off as a holiday.
5. An employee trades with the book or another employee.
6. An employee takes that day off as a citation day.
7. An employee takes that day off as a sick day.
E. When all employees eligible for shift shortages or Special Event/Other Overtime have been offered and refused the overtime and all eligible employees have refused the overtime, part-time officers shall be offered the shift shortage before the eligible employee with the least seniority shall be ordered to work the shift.
F. Equalization of overtime shortages in the Patrol Operations Division:
1. When additional officers are needed on a particular shift as determined by the Public Safety Director, officers from that shift shall be given preference. All other overtime, for example, special events, shall be offered first to the officer credited with the lowest number of overtime hours. If the low overtime officer cannot be figured into reached by telephone or otherwise refuses, they shall be passed over and the employee’s next lowest officer in overtime hours in his/her regular division shall be contacted. After all full-time officers have been offered and refused part-time officers shall be utilized. This procedure shall be followed until the overtime assignments have been made. In the event two (2) or more officers have the same number of overtime hours, the senior officer shall be called first. This language shall not impact previously scheduled part-time officers.
2. A supervisor may hold over the employees with the lowest seniority who are working without calling employees of the next platoon when there is less than four (4) hours notice.
3. An employee who refuses overtime when contacted shall be credited with number of hours worked on that occasion for the purpose of equalizing equalization of overtime.
4. A new Patrol Operations overtime list will be implemented with each new contract.
5. The supervisor requesting the employee to work overtime shall record the entries on the Patrol Operations overtime list. Entries to be recorded are:
i. Date overtime was offered
ii. Hours worked or refused
iii. Attempts to notify
iv. Supervisor hiring the overtime Attempts to notify are not to be counted as refusals; they are recorded to demonstrate that attempts were made to contact the low overtime employee first. When a hiring error occurs the remedy for the error shall be that the grieved officer be offered the next available overtime.
6. An employee transferred to, or hired into the Patrol Operations Division during the term of this contract, shall be charged with the highest number of overtime hours within the division.
(a) Employees Patrol Operations Division. Upon the successful completion of the Field Training Officer Program and Fire Orientation Program, a probationary employee shall be required to provide one (1) telephone charged with the highest number of overtime hours in order to the Patrol Operations Division and be contacted for call-out assignments. Employees at their option may provide a second telephone number at which to be contactedplaced on the overtime list. However, failure an employee may be called in to provide fill a second number law enforcement only staff shortage if that employee has not yet completed the Fire Orientation Program.
7. The above procedures do not apply in emergencies which require the immediate mobilization of department personnel. Emergencies may be natural or man-made situations that occur unexpectedly and demands immediate attention to prevent significant loss of life and/or property as determined by the Public Safety Director or his/her designee.
8. Employees called upon to work for one and one-half (1 ½) hours or less shall not be considered a loss and/or denial of an have this overtime opportunitycharged to the Patrol Operations overtime list.
9. Employees who refuse overtime due to not having at least eight (b) Failure 8) hours off prior to respond and a refusal to any call-out/reporting for their regular shift shall not have this overtime opportunity shall be charged against the employee marked as if workedrefusal.
(c) Employees who respond to the call/out overtime and actually work shall be charged for hours worked.
(d) Employees who are off work due to vacation, compensatory time, sick leave for someone other than themselves or light duty (providing the call-out assignment is consistent with the applicable light duty restrictions), shall at their choice be available for call-out situations10. If the employee chooses to work the call-out, he/she will be charged the overtime worked. Also, When an employee who is off due to military service is considered not available sick, injured, on Family Medical Leave, or another leave of absence, with or without pay for a period of five (5) consecutive work days, overtime and hours shall not be charged overtime hours. Employees transferring to a different division shall receive for purposes of overtime equalization the average amount of overtime worked that the existing personnel within the division and classification possess at the time of transfer in order to equalize overtime under Article 11. For the purposes of this Agreement, any refusal of overtime in other divisions will be charged to the employee in on the sixth (6th) day of absence as if the employee actually worked the overtime. The overtime shall be recorded on the Patrol Operations overtime list by the supervisor. The employee will have overtime charged to him/her only when it is his/her regular division turn to fill a shift shortage as determined by the Patrol Operations shift shortage overtime list.
11. Shift preference will be given when overtime is offered.
12. Special Duty Officers assigned to community policing or School Resource Officer may be ordered in to work overtime, provided that they do not work more than sixteen (16) consecutive hours. Bargaining unit employees assigned to the Support Operations Division, VIPER, MMCCTF, or other special “out” units may be offered overtime for the Patrol Operations Division, but may not be ordered in.
13. Any employee who is a member of this bargaining unit and is able to serve in a uniformed capacity consistent with the Rules and Regulations and General orders of the department shall be eligible for special event overtime.
14. An employee assigned to the Support Operations Division may file a written request with his/her command officer requesting to eliminate his/her name from the Special Events/Other overtime list, thus eliminating them from consideration for overtime for Special Events/Other. The employee may, at any subsequent time, but in no event more than once in any twelve (12) month period, withdraw this request in writing. When an employee requests, and receives permission from the Public Safety Director or the PSD’s designee, that his/her name be placed back on the Special Events/Other overtime list, the employee will be placed on the Special Events/Other overtime list with the highest number of overtime hours within the Special Events/Other overtime list. Officers assigned to the Patrol Operations Division may not request removal from this list. Sixty days beyond the successful completion of the Field Training and Evaluation Program, probationary employees shall be charged with the highest number of overtime hours on the Special Events/Other overtime list.
15. Supervisors shall record overtime hours and refusals to work at the time the hours are offered. Adjustments to the recorded hours will not be made if an employee works less or more than the offered hours. If an employee fails to actually work the overtime after accepting the overtime hours, he/she had actually worked those is charged with the hours. The only exception to the above is in the circumstance that an entire event day is cancelled. (Note: Incorporates Letter of Understanding dated 9/2/04)
16. Except for extreme emergencies, in accordance with Article 12(Eno officer will be ordered to work more than 16 consecutive hours.
17. After each hiring block (up to 12 hours) (Temporary Reassignments)overtime hours will be recalculated to determine the next available officer, which may be the same officer. This provision shall not apply to Fourth of July hiring blocks.
