Equalization of Overtime. The city recognizes the principle of equalization of overtime. Such equalization shall be accomplished on the following basis: a. An overtime file will be maintained on the basis of accumulative hours of overtime worked per employee. Accumulative overtime hours shall be based on overtime offered and/or worked. The file will be updated on a daily basis. b. An employee shall not be required to work overtime throughout any scheduled vacation or code day period, except callback. Trades or compensatory time shall not be used by an employee to avoid being charged for overtime, except for an emergency leave. Employees agreeing to work overtime shall be bound by the regular attendance procedure. c. All overtime known one (1) hour in advance will be considered scheduled overtime. d. Overtime shall be equalized within each separate division. Division commanders or persons acting as Division Commanders shall be responsible for the accuracy and fairness of the overtime card file system. They shall notify the prospective employees eligible for overtime twelve (12) hours prior to the unscheduled overtime period offered if possible. The procedure for holdover will be to offer the longest time available to the first employee on the list, the next longest time to the second employee on the list etc. What determines who is first on the list is the person with the least hours in the card file. The holdover list ends at 0700. Personnel refusing the time offered shall have that amount of time added to their card in the card file. Should all personnel on the list be asked to holdover and refuse, the least senior person shall work the highest number of hours available, the next least senior person shall work the next highest number of hours, etc. until all hours are filled. e. New employees that hire into the Department shall be charged with the maximum number of hours of overtime. f. The City and the Union agree that to better insure adequate staffing on Christmas day those employees who work overtime on December 25 will not be charged for those hours worked in the overtime card file. g. A voluntary overtime list will be established and will be posted in the B.C. office. Anyone willing to work overtime on Christmas day will submit his or her name to the Battalion Chief. On the morning of December 25 if the Battalion Chief is unable to fill unscheduled vacancies from the holdover list, the personnel on the voluntary list will be called to fill those vacancies. Equalization of Overtime. The city recognizes the principle of equalization of overtime. Such equalization shall be accomplished on the following basis: a. The employee's name will remain on the list until he or she removes it. 14.2 The Company shall also maintain a separate "voluntary out of class" list for each classification by seniority by shift. The list shall consist of previously qualified employees who wish to sign the list in the event that voluntary overtime cannot be obtained within the classification. 14.3 The Company shall first offer overtime to the employees in the classification (who have not signed the Overtime Rejection Sheet) on a "turns and rotation" basis. "Turns and rotation" basis means that each employee will be updated offered available overtime in descending order of seniority until the overtime opportunity has been filled. When the next opportunity occurs, the overtime will be offered to the employee next junior to the employee last offered overtime. Employees not at work will be considered to have been offered overtime when their “turn” was reached. 14.4 An employee who has signed the Overtime Rejection Sheet will be charged a turn each time the employee had the opportunity to work available overtime. 14.5 If an insufficient number of employees in the classification volunteer for overtime then employees who have signed the "voluntary out of class list" shall be offered the voluntary overtime on a daily basis"turns and rotation" basis as described above. b. 14.6 If an insufficient number of employees volunteer for available overtime, the least senior employee(s) who is low on turns in the classification shall be scheduled for the overtime assignment. Employees not at work will be considered to have been offered overtime when their "turn" was reached. If an employee is passed on turns and rotation you do not go back at next available overtime, always go forward on turns and rotation. Employees with machine rights will be assigned to their bid machine (home base machine), if open without regard to seniority. After these machine assignments have been made, further openings will be filled by seniority choice. The intent of this provision is that this principle be applied on-shift before offering the preferred machine assignment to an off-shift employee. 14.7 Except in the case of twelve (12) hour shifts schedules, daily overtime will be offered as follows: A. Overtime for the last four (4) hours of the shift will be assigned to the employees of the next shift. B. Overtime for the first four (4) hours of the shift will be assigned to the employees of the preceding or current shift. C. In the Company's discretion, subject to production or maintenance needs, overtime can be offered in less than four (4) hour increments. D. No employee can be scheduled for daily overtime unless it is before or after their normal scheduled shift. 14.8 In the case of twelve (12) hour shift schedules voluntary daily overtime will be offered to the employee on the shift(s) which are scheduled off. If split shifts are operated concurrently, a rotational overtime basis will be used. 14.9 An employee shall on a twelve (12) hour shift may not be required scheduled to work overtime throughout any more than one twelve (12) hour shift in a scheduled vacation work week and only to cover an absence. 14.10 The Company will post all overtime under the time guidelines in this Agreement.
