Exercise Seniority Rights. An employee who has received a Notice of Lay Off may exercise seniority rights in accordance with the following provisions: (1) To exercise Seniority Rights, the employee must so advise the Director of the Work Unit, in writing, within five (5) working days of the receipt of Notice of Lay Off. (2) An employee who wishes to exercise seniority rights, may be placed into the same or lower classification/position subject to the following: (3) Same or lower classification means same or lower rate of pay and hours of work. (4) The employee may select a classification(s)/ position (same or lower level) of preference. (5) The employee must meet the minimum qualifications that would normally be posted for the classification/position into which the employee wishes to be placed. (6) If there is a vacant position within the classification selected (and the employee is qualified for the position), the employee shall be placed in the vacant position. (7) Where there is no vacant position within the classification selected (and the employee is qualified for the position), the employee may "bump" the least senior incumbent/employee in the classification providing the employee has greater seniority than the incumbent. (8) In the implementation of Clause 12.14.4 (a) (3) to (7), an employee shall be entitled to exercise seniority for placement in a vacant position or "bump" into a position with the same hours of work and
Exercise Seniority Rights. An employee may elect to exercise their seniority rights and relocate to another Safeway store at the time of conversion. Transfer to another store will be accomplished in the following manner: i. A Grid A vacancy may be created in the receiving store through a voluntary severance program offered by the Employer; ii. As per Article 13.15 of the current Safeway collective agreement. It is understood that no store, unless agreed to by the Employer, will receive more than five percent (5%) of such employees by classification.

Shifts periods are Day Shift - 6AM to 6:00 PM and Night Shift - 6:00 PM to 6:00 AM. The shift period (Day or Night) is determined by the period in which the majority of hours of the shift fall. The shift option provided for herein shall not preclude an employee from "bumping" the least senior incumbent/employee if that is what the employee (bumping) chooses.

  • Seniority Rights An employee who returns to employment at the time of or prior to the expiration of military leave shall be given such status in employment as would have been enjoyed if employment had been continuous from the time of entrance into the Armed Forces.

  • Seniority Rosters The Employer agrees to furnish the Union each January 31 and July 31 with rosters of all employees who accrue seniority, their current and prior classifications, and start date in each classification and University start date per Section 1. Employees who have accepted positions outside the bargaining unit do not accrue class seniority in the bargaining unit when employed in positions outside the bargaining unit, but retain prior seniority earned in the bargaining unit. When two (2) or more employees have the same classification seniority date, ties shall be broken by recognizing the employee with the greater University seniority first. If a tie still continues, the employee's seniority position shall be determined by lot.

  • Seniority Roster The District shall maintain an updated seniority roster, indicating employee's class seniority and hire date seniority. Such rosters shall be available to CSEA.
